LINCOLN — Town Councilor Rod Carr recused himself from a 4-2 vote awarding First Wind of Massachusetts a 20-year tax break Monday after he was accused of a conflict of interest in working as a paid lobbyist for landowners who would benefit from the project.

Carr looked down, stonefaced, as attorney Lynne A. Williams read a one-page letter to Carr dated Monday in which she wrote that H.C. Haynes Inc. and W.T. Gardner and Sons had paid $3,000 and $2,000, respectively, in 2008 “for your lobbying on behalf of their interests.”

Carr’s lobbyist registration statements indicate that he expects to receive $5,000 in 2009, Williams said during the council meeting at Mattanawcook Academy on Monday. Those companies own a portion of land on which First Wind seeks permits to build 40 1.5-megawatt turbines along the Rollins Mountain ridgelines that run through Burlington, Lee, Lincoln and Winn as part of its $130 million project.

Williams represents the Friends of Lincoln Lakes group, which opposes the Rollins Mountain project.

“We believe that there is no doubt that it would be unethical for you to exercise your vote on this matter, as it was to vote on the TIF in March,” Williams said Monday. “If you do vote on this matter on April 13, it will, of course, be up to the Penobscot County district attorney and the attorney general to decide whether you have violated a criminal law by so voting.”

Carr denied any unethical conduct, saying that he was “really disappointed” at being accused after more than 20 years of honest public service to the town. He recused himself after a 15-minute recess in which he unsuccessfully attempted to telephone his attorney for advice.

Carr’s work for Gardner and Haynes, he said, involved “only advising and assisting” on forestry issues — not lobbying for First Wind.

“I never discussed First Wind in my discussions with them,” Carr said. He called Williams’ letter something “done to embarrass me, and it did.”

Council Chairman Steve Clay called the letter “character assassination.

“My reaction has always been that I don’t get involved in their mudslinging and I have let their arguments go, but there comes a time where enough is enough,” Clay said. “What they did tonight to Rod Carr, who has been a public servant for 30-plus years, has always done the right thing, has always been honest, I think is a sign of desperation.”

Williams defended her letter as an attempt to shed light onto dealings surrounding the project. She said that there was “at least a need to discuss the potential conflict and then let people decide.”

“He [Carr] did not disclose to the council his relationship [with Haynes and Gardner] and then he voted on it,” Williams said in reference to the council’s first try at a tax increment financing deal for First Wind. The council deadlocked in that 3-3 vote on March 9 with Carr voting in favor of the TIF.

Clay said he wasn’t “specifically” aware of Carr’s relationship with Haynes and Gardner until Monday.

“Do I think it matters? No,” Clay said, reiterating his belief in Carr’s honesty. Also, he said, if the TIF had been rejected again Monday night, First Wind likely would have reapplied for another TIF, as the vote does not deny reapplications.

Under the first TIF agreement — a proposed 60-40 split over 20 years between First Wind and the town of the taxable value of First Wind’s estimated $50 million investment in Lincoln — First Wind would have received $8.8 million in sheltered tax money over 20 years, while the town would have received an estimated $9.8 million in TIF funds over 30 years.

Under the version that passed, the 60-40 split lasts 10 years, with a 50-50 split over the last 10, which adds about $600,000 more to the town’s coffers, officials said.

Clay and Councilors Thora House, Clay’s brother Samuel Clay and David Whalen voted for the TIF. Husband and wife Councilors Michael and Marscella Ireland opposed it.

I think the Friends of Lincoln GROUPIES sould just take a chill pill and stop trying to degrade everyone associated with this project!!! Enough already!! They are just a group who deem to be so concerned about the enviorment, but on the flip side have dealt out many mean and dirty dealings. I would believe Rod Carr ANYDAY over a group of people who oppose such a great idea...a natural way to produce electricity. (and the millions of dollars it would bring to our community!)

I have known Rod Carr for almost 20 years and have no doubts about his honesty and integrity. This is typical behavior of liberal tree-humpers. If the facts or even reality are not on your side, then tear the other side down with baseless accusations and lies. Go back to your granola and devise some new clean-energy alternatives, instead of tilting at windmills.

am so tired of the NIMBY people, and they are trying to dictate how one can develope their own land. how dare they, there are enough rules and regs in place by government that tells you what u can and can't do with your land I really hate to see some small group be allowed to do this also. how dare they, if you don't like what u see looking out over the horizon pull the shade or better still sell and go back to the state u came from

"Dedicated public servants" understand that the appearance of conflict of interest is to be avoided at all costs. Carr should have been upfront about his business dealings and let the board help him decide whether to participate. The Friends of Lincoln Lakes have every right to challenge the back room dealings and flawed decisions of local government. They understand that wind turbines on Lincolns ridges, overlooking beautiful lakes and lake shore communities will be disastrous for property values and will replace the dead quiet rural nighttime environment with a cacaphony of low frequency thumping noise that is 20 decibels or more louder than the background sound levels. Who in their right mind would not object to such an atrocity? Its a shame that Lincoln's council can't see further than the tips of their outstretched hands. The real tragedy in this, which is being repeated in town after town confronted with the invasion of wind turbines, is the destruction of the fabric that holds communities together. The huge dangling carrot of windfall payments, which will never be paid if the wind turbines do not meet their exaggerated capacity factors, is a form of bribery that should be banned. TIF payments blind decision makers to the realities of this industry, which, if carefully considered, would lead to the inevitable conclusion that Maine will not benefit from wind power, and neither will the electric grid. Perceptions are realities when it comes to government. He should have known better The statements arent accusations, the statements are attacks, the statements are facts. A direct conflict of interest. Acknowledgement and apology are far more credible than the "someone is picking on me" response.

Leave it to a woman to dig and slander a mans character. I bet being an attourney she has done some shady deals if someone was to look into her back ground. I bet she would fight Maine Yankee if it was up and running. How much stock does she have in the oil industry, coal industry, dirty air industry if the was one. With type person and the ones she represents, we will be buying all our power from Canada. The bad part is it will put Mainers out of work. Non-disclosed Freedom of Information Act executive session meetings. Preplanned strategies to prevent moratorium. Breaking the ordinance laws in the town which clearly prevent construction of an Industrial Electrical Generator in a Rural Residential Area.

A planning board with a chair of the board directly employed by Haynes Inc (a primary benefactor of the Turbine project.), controlling the gavel and limiting speech. Cutting off and limiting speech to an opposition citizen group from the start, preplanned. Denial of their appeal by declaring them non-existent.

Years of preplanning by a prior Town Manager with Firstwind. A tax accessor who runs the town pushing the Firstwind project . A new town manager bent on getting the TIF approved from day one. Closed executive session meeting over objections of a lawyer citing the law on that issue. TIF negotiation with a firm bought and paid for by Firstwind, in a non-competitive “negotiation” with the town.A town lawyer working for the same firm. And now, a town councilor, always occupying center seat on the council, a principal lobbyist for two local corporations that stand to benefit most from the Firstwind project thrust on the community That principal lobbying position taken right after the planning board approval of the project. Tax payers not yet informed on the consequences , both financial and environmental on the area by the town.

And now one councilor is upset because of a situation he created.

It is high time for changes in Lincoln town government for sure.

It is time for citizen representation, not special interest control. Maybe it is the time for more legal action too against this sort of thing in this town. Maybe Firstwind should be looked at as an instigator . It is time to look seriously at what has happened in New York State as well concerning the same sort of things that are happening here.

It is time for transparency in Maine concerning Firstwind and its dealings in Maine communities.

Ahhh. The Flim Flam Man II plot widens. If the selectmen , who are all starry eyed thinking about the gifts coming to them, would spend a little time googling First Winds financial situation , they might make a decision that is good for the community. It won't be long before this story breaks nation wide. It will make Gov. Blago from Illinois look like nickels and dimes compared to the bribery going on in the state of Maine. From state govt. right on down to towns and unorganized territory ..everybody gets a little something to make them feel special.

FOLL should be ashamed of the way they acted at that meeting! It was a cheap, cheap shot. Whats wrong, they don't have anything to stand on? So they take a shot at the most respected members of the council. just like a little kid...they don't get their own way, so they cry about it. They Can't handle that other peple think diffrently. if they had any concerns they could have brought it to Rod before the meeting, I know rod, and he would have answered and qustion you had, but they knew that there wasn't a problem, that why they waitied until the last minute. Well, FOLL if thats how you do Business you should be Ashamed of your selves.

The folks in Lincoln and elsewhere are not nimby's - they are concerned citizens fighting for a way of life. An industrial wind turbine facility is not a neighbor adding a shed or building a house. It's not even a Walmart going in next door - it is a sprawling (destroying miles) industrial electric plant that brings with it hazards and changes you have no idea how to even begin to explain. The state of Maine is scrambling to set new regulation to allow these plants to remain in the state with fewer impacts than Mars Hill but they are struggling to come up with correct setbacks to protect people's property values or issues with health and safety. Anyone within a mile of the project, especially downwind, will have their daily lives altered. If they are downwind, within 3500 feet and deal with the noise and shadow flicker like the people in Mars Hill and Freedom are - they will consider moving once the turbines go on line. It's a promise - one that you won't choose to believe until it happens to you. Why should a person's "right to develop their land anyway they want" interfere with or destroy their neighbor's right to enjoy and live on their land. The state does not have enough "rules and regs" in place to protect the public from the dangers that exist around these plants. If the people of Lincoln do not educate and protect themselves it will be too late - no one else is going to do it for you. I would hope that everyone would want to keep the freedom to fight for their right to live well and safely on their land. Someday it might be your home or your child's home that is put in harms way - let's pray that as a country we still have the right to fight for a say in the process.

This article is already up at windaction.org...with the comments. The First Winders who post here are showing their true colors. Fascism is when corporations and govt. work for profit and against the citizens. Seems we have a huge example of that here in Maine. So why does First Wind get to break the law with their loud noise in Mars Hill and we aren't supposed to oppose the wind farms again? Just trust them? Everywhere they go they are totally surprised when the turbines make so much noise people's windows vibrate. They always say,"We did not know. ..but will work on it."

TIF funds is so funny. The turbines are only supposed to last 20 years. They are such a fire risk , the insurance companies won't even cover them. Since First Wind is a LLC ...limited liability corporation....I am sure in case of fire the town is on their own.

They change their name every year for some reason...Probably the lawsuits against them eveywhere they go. They are now First Wind Holdings. It was Evergreen when they built at Stetson Mt. When we first heard they were going to build here....we started calling their office in Mass. and ME. For 2 months nobody ever answered the phone or returned our calls. They were sued when they built the Mars Hill wind farm for non payment of a transformer. First Wind said it was unmerchantable. Used it anyway. I would not rent a 200 dollar a month camp to people like that.

Folks, this is not about Rod Carr the person. Conflict of interest is about ethics and civic process. Rod Carr was honorable in recusing himself from voting. This was an obvious case of conflict of interest. By recusing himself, he shows far more integrity than if he had put his fellow Council members on the spot to determine that issue. Having said that, Rod Carr's conflict of interest is just a clear example of the atrocious civic process in the town of Lincoln. Re-read what "Mountain Man" says above. Perhaps someday people in Lincoln will appreciate the struggle that Friends of Lincoln Lakes has waged to shine light into a very dark and illegal civic process.

I just came back from Fort Fairfield and had a chance to see these wind turbines myself sitting atop Mars Hill. What an awful and shameful display. They do not add any value to the land, the community and the people of Mars Hill or the surrounding area. You can see these turbines from so far away. I can not even believe that the selectmen are thinking about what is best for the town when they vote on behalf of the wind turbines. This is a clear mistake. Needs to be stopped.

Dear Friends of Lincoln Lakes, you do not represent the citizens of the greater Lincoln area, you are a group representing yourselves and perhaps some of your friends. You do not speak for me, you do not speak for most of the townspeople that I know. You act like these windmills are airplane propellers for goodness sake. These are WINDMILLS, no engines, no emissions. Green as green can be. And quiet, much much quieter than the log trucks going up and down our roads, much quieter than the Mill which runs day and night. (And much less smelly.) Light flicker? Seriously? I daresay that there is much more "light flicker" coming off of your namesake lakes on a nice day. What about the evil farmers who use such infernal devices to draw water from the ground, or the demons from our past who used to grind wheat and corn with them also? I mean really, they aren't going to mount these things on the roof of Marden's! We should be able to put these up and point them out to the world...Look at what we are doing to help the environment while helping ourselves. Personally, I like electricity. A lot. And I would like to pay less for it. And I would like to have my electricity generated in a non-polluting way. So I place my trust in the Council that we elected to make this work in the best way possible for everyone. This conflict of interest stuff is nonsense, as is this crap about the "appearance" of a "possible" conflict. Our councillors are not career politicians like your beloved President, they are the folks who live and work here, and therefore have a GREAT interest in what happens in our town. Mr. Carr never asked you about where your funding came from, or where you get your "facts", or whether people from "away" have a role in your agenda. Are those not legitimate questions? happycamper 1....Google first wind holdings ....that is their new name. They are broke. Plus they are criminals. Broke criminals are running the state. The selectmen are not doing their jobs. They should know this. Instead they look out for their own financial interests. (as in bribes) Maine is in for a war. Demand for electricity is down. We export it already. Why ruin the very thing that is beautiful about Maine.

GurnBlanston- The Friends of Lincoln Lakes are composed of all political parties and both residents and nonresidents. We are not all campowners but we are lake users and appreciate the great outdoors. We have hundreds of members donating over 1000 bucks per week for our war chest. 100% goes toward legal costs. We share your desire for cheaper electricity and realize that offshore wind is way more efficient and does not need schemes like gov. subsidies. Peter Vigue of Cianbro will hopefully get this going before more of rural Maine is lost. Since the REC credits are sold to coal burning power plants so they will not have to clean up,windmills are contributing to continued high CO2 emissions overall. All this power will go to Mass. anyway. Why slam the mill? They recycle sawdust, burn an alternative fuel mix,have a good waste treatment plant, have reduced their SO2 emissions, oxygen bleaching, and more, plus employ 300 plus people for the TIF they were given. Yes the noise should be lessened. The mill is not spread all over 15 miles of ridges and hills either. Who else can use the Rollins TIF area? TIFs should be for in town areas where a business or factory could set up and employ more than the 5 permanent jobs the Rollins debacle will provide. The hills and lakes are for recreation not industry and if the landowners do not want that may be they should sell. Land for Maine's Future?

No Coal Plants, No LNG plants, No Refineries, No Nukes, and now No wind farms, lets just keep sending our cash to the middle east, we all know they will never raise the prices. Lets all turn out our lights, heat, AC, street lights, PC,s traffic lights, stop driving and of course no TV, Radio, or internet for a week or so and then rethink what we want to do about our energy needs.

Gurn Blanston, a 2.5 MW turbine is indeed an engine. It is equal in size and power to a diesel locomotive at about 3000 HP and 50 tons sitting 300' in the air on top of a tower. The blades are 150' long and weigh 8 tons each and rotate with tips speeds approaching 200 mph. They emit over 100 decibels of noise according to noise charts on the manufacturers website. The high pitched noise from the whine of the generator and speed reduction gearboxes sounds like a jet that never flies on. The blades ripping through the air molecules emit low frequency noise that travels long distances through the atmosphere, like thunder. World wide people living near turbines complain of sleep disturbance. Mars Hill residents did nothing to deserve having their lives drastically impacted by the installation of turbines by First Wind. They merely believed what they were told about the noise (no louder than a refrigerator). The day the turbines started turning the families on Mars Hill knew they had been lied to. There is no reason for people to be harmed by this industry. You can't possibly be that insensitive. As for the price you will pay for wind generated electricity - it will cost First Wind about $100 per megawatt to generate electricity with their wind turbines. Electricity sells for about $40 per MW on the day ahead ISO New England market. Who makes up the $60 difference? You do. Along with every other tax payer. That doesn't include the additional subsidies that allow them to offer TIF agreements. Wind power is a scam. It blows only enough to generate about 25% of the capacity of the turbine. Of this 25%, much is generated at low wind speeds and is merely absorbed by the grid as voltage fluctuation or is generated at night or in the winter when the grid demand is low. Studies have shown that the effective capacity of land based turbines is only about 10% of the capacity of the turbine. A turbine costs about $5 million installed on a mountaintop. At an effective capacity of 10% the 3000HP generator has the capacity of a 300 HP motor running continously. Its like paying $5 million for the engine in a pickup truck. Even if the fuel was free would you pay $5 million for a pickup truck?

The friends of Lincoln Lakes are a small group ( some do not even live in the Lincoln area ). They do not represent the majority of what people in this town want. Shame on them for attacking Rod Carr.

This is a huge issue for the future of the Lincoln Lakes Region. It's not like buying pansies for Main Street. We can not allow this to be decided behind closed doors, over a cup of coffee or with a wink and a nod. The results of this decision will impact this Region forever and it deserves informed, intelligent and open scrutiny. For one of the voting members of the Town Council to have a direct financial tie to stakeholders in this issue is not necessarily wrong. But not making that relationship known to the Council and to the public before any vote IS wrong. Mr. Carr has blatantly violated the trust that his position requires. We should expect more from our 'public servants'.

Good for you. You might be interested to know that First Wind is going to take YOUR wind, make electricity from it, and sell it to people in MASSACHUSETTS.

If you had paid attention, you would know that your rates are NOT going down.

It's true I don't live in the Lincoln area. Would you consider refunding the thousands of dollars I pay in Lincoln taxes? Would you consider letting me vote on Lincoln council folks?

Notice all the new names on wind farm issues? First Wind is in town to push their wind farms on us. I guess if we wanted to know why the insurance companies won't insure the turbines because they are such a risk for fires .....we would be the dreaded NIMBY. I'm all shaky.

We Mainers treasure Brad, Gary and Harry. There are plenty more where they came from. As time goes by and First Wind is broker and broker our numbers will rise. First Wind is funded by hedge funders. They are all sad because their off shore accounts are being looked at now . Karma can be tough.

There you go, lincolnman, calling people names. I have watched and listened to Gary, Harry, Brad, and others from Friends of Lincoln Lakes. They always have well researched facts to back up their statements. They are courageous, articulate and passionate. Remember, this country was founded on principles of free speech and government that represents the citizens, as expressed by the likes of Thomas Paine, Samuel Adams, John Hancock and others.

Friends of Lincoln Lakes has done the town of Lincoln a service by challenging a huge project that will change the area for a long time. There are plenty of people in Lincoln who don't want to see the ridges of Rocky Dundee and Rollins Mt. blasted away to put up these huge, intrusive towers. Friends of Lincoln Lakes are absolutely correct that First Wind should not have a TIF. Instead, First Wind should pay their full taxes like everyone else and pay a yearly impact fee for being allowed to destroy the natural resources of the town and ruin the lives of people in near proximity to this sprawling industrial site.

Shame on the Council for caving in to First Wind on the TIF. But remember, if Friends of Lincoln Lakes hadn't been involved in analyzing the TIF, it wouldn't have been re-written to get Lincoln $600,000 more dollars. The Town Council left millions of dollars on the table because they lack the courage and wisdom to deal with First Wind as the unwelcome out of state scammers that they are.

You should be thanking Friends of Lincoln Lakes, not criticizing them and demeaning three of their spokesmen.

We at Firstwind are very experienced at behaviorial manipulation, collusion, utilizing the legal system to our full advantage and municipal manipulation. We have done it all in Lincoln. Lincoln has rolled over again and given us a good deal, to their own detriment.. We would have paid more , were it not for a council too ignorant to know how to negotiate. That sad citizens group did cost us a few bucks, but what the heck is several hundred thousand dollars when we make millions out of tax payers pockets, like yours every year!.. We would have paid more, but thanks to the council, we got away easy. After all , how could we ever continue this scam of financial hedging if we didnt use your money,environment, and lives. So sad for the simple rural folk there. We have multinational influence to the top, and we use it effectively don’t you think?

Resistance from the citizens group is just a thorn in the side. Rubbed enough, it may fester, but you have to know how to rub it. You don’t. Lincoln, you sad simple folk rural of Maine, Maine , we love ya! When will you ever see what is going on; not yet it seems.

barrybarry, isn't it fun to call people names like you are on the school playground! I guess you haven't attended the same meetings as I have. Friends of Lincoln Lakes always has many more speakers than just the 3 people you and lincolnman castigate. Friends of Lincoln Lakes has a core group of active members much larger than your belittling number and has many supporters who stay "below the radar". If the Lincoln Town Council ever had the sense of civic obligation to put this wind turbine issue out to referendum, a secret ballot vote would surprise people. The Council is afraid to do this, however, because they want to control things.

The Lincoln Town Council has cost the town money by not adopting an adversarial negotiating position with First Wind. Instead they gave a subsidy to an undeserving company when they could have gained so much more. First Wind is laughing all the way to the bank with the millions of dollars the inept Lincoln officials left on the table. The council greased the skids for an out of state corporation in illegal executive sessions while slamming the door shut on open citizen participation. A shame, a travesty.

Lastly, Friends of Lincoln Lakes has not cost the Town of Lincoln any money. The way the civic processes in Lincoln are conducted is the reason it costs the town legal fees. I hope they have some sweetheart deal for First Wind to pay their legal fees that are coming up in the future because they will need it. But then, that would be yet another reason to haul their sorry asses into Superior Court in Bangor.

I have been to the meetings and they are laughable when the fiends of lincoln lakes get their chance to speak. Your friends have lost another one. Suck it up. haul your sorry asses out of town.

These "Friends" are a sad little group that have no moral compass and need a cause to feel that they are righteous. Hey they have their right opinion, but, they have decended into darkness that is beyond opinion. Smearing Rod and others and writing artcles in the Lincoln News with vague sexual references shows that there is a warped element among them.

It is most interesting to see the the civil process at work in Lincoln. One must note that had an open , transparent process been utilized from the start, none of the costs , both now and in the future to be incurred by the town to cleanse the process there, would have been necessary. As the legal process is just beginning , and as anyone can see that there are numerous issues of legality being unearthed in this, hitherto, isolated town with little knowledge of state constitutional law or municipal process, one can only wonder what else ‘lies’ beneath the surface. The town council, the planning board, and other boards are sorely lacking in knowledgeable leadership it appears. They are rich in vested self-interest. The unearthing of the self-interest at the municipal level is starting to show itself. Disdain for citizen input is rampant in this town.

It is wonderful to watch things unfold. The basis of our democracy has always been one of law and fair process. How wonderful it is that the process is still adhered to and used by some citizens there. For the others, a lesson in civics and legal process is being unearthed. Maine is a state where home rule prevails. There is much ahead for legal process utilization in Lincoln and cleansing of its municipal system .The town will learn that they exist for the citizens there, not for special interests, local corporations, or Firstwind, an industrial energy hedging firm of questionable repute.

Like I said - a sad little group. Mountain man pack up your bags. This is a done deal. I guess you just won't be able to stand living in Lincoln anymore.

But no you won't leave because this is your crusade and it's just too much fun.

It is really pathetic that a number of people commenting on here can only make demeaning remarks aimed at people. There are many issues stirred up by the First Wind interlopers. This outfit should be the object of scorn if any is to be dished out.

Coming to Lincoln to blast away miles of our beautiful ridgelines to install a hideous string of 40 wind turbines, each taller than the water tower at LP&T, with aviation lights flashing 24/7. Replacing the calls of the loons with the incessant roar of turbine blades. Killing the eagles, ospreys, hawks and other birds with their blades and exploding the lungs of the bats with the pressure from the blades. Clearcutting hundreds of acres on ridgetops then applying herbicides that wash into our lakes. Ruining the health and sanity of the people unfortunate to live in close proximity. Putting up towers in a poor wind potential area because its not about producing electricity, its about how many different ways to raid the taxpayers and ratepayers for subsidies. Preying on gullible, unsophisticated town officials to pay for their investment with a TIF. Scornful!

I will predict right here and now that should this Rollins project ever get built, there are lots of people in the Lincoln Lakes communities who are going to say "This is terrible what they did to this area! How could this happen?" It will be sad, indeed. Friends of Lincoln Lakes understands what it is about and we cherish and protect our natural surroundings.

Looks like deanhornblower missed his calling. Like the prophetess Cassandra, he can predict the future. Wooooooooooooooo. You should have seen in your premonition the fact that the TIF would be voted for and passed. You should have seen that the planning board would not hear your appeal. You should have seen that attacking a good mans name would backfire on you. I hope harry likes beagles.

Why don't all the FirstWind supporters move to Newton Mass ? If you do not like what this area has to offer don't screw it up for the rest of us. Take the 4 councillors who naively voted for the TIF with you. BYE!!
