Ex-Milo chief pleads not guilty to assault

DOVER-FOXCROFT, Maine — Former Milo Police Chief Michael Poulin has pleaded not guilty to assault in connection with an alleged altercation he had last month with his wife.

Neither Poulin nor his attorney, Pamela Ames of Waterville, made an appearance in 13th District Court on Monday; rather, Ames entered the plea on Poulin’s behalf by letter. She also requested a jury trial in the matter.

Poulin, who resigned as chief earlier this month, allegedly grabbed his wife, Elaine Poulin, by the arms and pinned her against a wall in Elaine’s Basket Cafe and Gift Shop, the business she operates on West Main Street.

The alleged assault occurred shortly after 7 p.m. March 20 when Michael Poulin, accompanied by the couple’s son Chris Poulin, 25, came into the cafe, where an argument erupted over marital problems, according to Lt. Robert Young of the Piscataquis County Sheriff’s Department. The cafe had closed for the day when the in-cident occurred, but two Milo police officers and a friend of Elaine Poulin’s were inside the cafe when Poulin and his son arrived, Young said.

After the incident, town officials suspended Poulin with pay pending the outcome of the continuing investigation. Poulin’s resignation came just days after Milo selectmen voted to take disciplinary action against him.

Poulin was hired as Milo’s police chief in June 2006 and had been in law enforcement for more than 30 years.

He's such a disgrace to the officers who truly are in law enforcement to do their job and do it well. I hope the state takes steps to take his guns away from him and denies him the right to ever be in law enforcement in this country again. He even looks creepy!!

well..he'll be judged by a jury of his peers ( good ole boys) and probably go before judge Stithum. it will be interesting to see how this all pans out..I'll bet he walks...

They should transfer the case to another county as there has been a lot of exposure and the fact that Milo is in Piscataquis County which will hear the jury trial. Jurors could be from the Milo area.

Poulin is such a creep! There are eye witnesses and he is pleading non-guilty. Jeeze. Take some responsibility for your actions! Knowing our luck, he will get in front of a bias judge and jury and get no sentence.

I read these posted comments all the time , and I just wonder about you folks and all the negativity. Number one just sol that ypu know I DO NOT CONDONE ANY MAN GETTING PHYSICAL with a woman.

Number two- who that posts comments here with legal opinions is a lawyer. Who here knows what the actual Maine law is ( says ) about domestic violence ??? Who here does understand that Judge Stitham is a DISTRICT COURT Judge, and as such does NOT hear JURY trials. GOT IT.

I have no doubt that if Mr. Poulin IS found guilty in a jury trial that he will receive a sentence commensorate with his crime.

Booney~ VERY doubtful that he will receive adequate sentencing IF he is found guilty. It seems you haven't been reading all the information about what goes on in the Milo area and all the hoopla concerning Judge Stitham. Furthermore, this man left Florida and came to Maine after committing the same crime in Florida... and got a second chance when he came to Milo... he blew it AGAIN! He's a total LOSER!!!

What accused person ever pleads guilty on there initial court appearance?

If he stands convicted, he can never own or have in his control a firearm ever again.

If he stands convicted, the state of Maine Criminal Justice Academy will take action on his certification as a law enforcement in the state of Maine. This only impacts his ability to hold a job in the state of Maine requiring certification.

I have read the allegations concerning Florida several times on here but no one ever provides the evidence to back up the allegations. I for one would like to see the evidence that he committed a similar crime in Florida and then was hired by Milo.

Last time I checked, there are more cities and towns in Piscataquis County then Milo. If he was a county deputy or held a county wide position, then yes move the trials out of the county. But since he is not, let him be tried in the county he is from and let the DA and defense council seat the jury from the pool of registered voters.

Of course, he could wave his right to a jury trial and have his quilt or innocence decided by the judge.

I think that if his lawyer was smart she would have the case moved to Penobscot county. Yes the charges are filed within Piscataquis County but however since the eligible Jury candidates are within the same county there is a very good chance of having a Juror who had been arrested or pulled over by Chief Poulin having a personel grudge against them. Some people don't realize that Milo provides mutual aid to Brownville, so they get their fare share of dealings with the people up there as well as LaGrange if necessary in an emergency situation. If he were to remain in Piscataquis County, it would not be Judge Stitham proceeding over the case since he is not a Superior Court Judge, and a Jury trial comes under the Superior Court rulings. Only time will tell what will happen.

I stand corrected Milo does assist the Penobscot Sheriffs Department with LaGrange if necessary, but I meant to say that they also help out with Sebec if needed as well. So right there you already have 3 towns plus anyone that passes through Milo from other areas that could be a possible Juror applicant.

I am not an attorney so I do not know how many challenges each side has in the state of Maine. I do know they will need to fill out questioners and some jurors will be eliminated through that process. Others will be removed for cause through challenges. Maybe they will move the trial but that will add to the cost. Only time will tell.

Moving to another county for a court case is what is known as A Change of Venue What a Change of vebnue means is to chnge the location of the trail "IF" there is indeed a trail by jury in order to receive a fair and impartial jury.

Tht is what happenswhen there is a lot of widespread publicity or to obtain jurors who can be more objective in their duties.

The case could be moved to another county or all the way acrross the state.

The main perception fro me is that in Picastaquis County their is a very real "Cronyisitc" or Good ol' Boy network which may have indeed put false witness againt Poulin.

Very possible there especially with the nepotist postition held by his ex wife.

I DO NOT Condone domestic abue sut too again in America one is innocent until poven guilty and by obtaining a fair and impartial jury that would more realistic in this case. The Change of Venue.

There are not enough facts here for a judgement call. I don't think he should be treated any differently becuase he is a cop. Cops are people and they have the same problems in their homes that we have in our homes.

I do not condone violence on the part of either part, but it should be judged as a man against his wife or vice versa if that is the case. If he is convicted, it will likely be a felony conviction and I believe Domestic Violence has a manatory sentence so the judge may not have as much discretion in this case as with others.

An unfortunate event for the Poulin family.

The sixth Amendement to the United States Constitution is part of the Bill of Rights.

That is the part that regulates the rights that relate to criminal prosecutions in federal courts.

That right is applied through the Fourteenth Amendment of the Due process Clause. You with me on this so far? While he has the right to a speedy and impartial jury by the state and district where the crime was commited he also has the right to confront the witness against him and compulsory process for obtaining witness in his favor ( this is from the bill of rights not my fine thinking)

Remember that Change of Venue I wroe about? Well if there is sound reason to believ that he would not have an impartial jury after confronting witness against him then because he has the Right to Counsel in his defense ( from the same bill) then the counsel may obtain the Change of Venue.

Mr Poulin is not being treated any different because he works as law enforcment as a matter of fact I think he is getting screwed by the surrounding community which these sickening posts lead me to believe.

He came into Milo at a time whn Milo needed a new cheif. He has done a damn good job. Marrigaes fall apart ho sad and domestic abuse occurs but why is the community that posts on here crucifying im before court?

MurielM, do get grabbed by the arms and pinned against a wall often? If you do, there are shelter's available where you can get away from your abuser. As a father, I teach my children that there is no excuse for this kind of behavior.
