Rapist convicted on federal gun charge

BANGOR, Maine — A federal judge has sentenced an Aroostook County man serving 14 years in state prison for assaulting and raping his wife to more than five additional years in federal prison on a gun charge.

U.S. District Judge John Woodcock on Monday ordered that Horace W. Salley III, 36, of Smyrna begin serving his 63-month federal sentence after he completes his time at the Maine State Prison in Warren. The judge also sentenced Salley to three years of supervised release after he completes his federal prison term.

Salley was convicted in November 2007 by a federal jury of possessing a gun after being convicted in 2003 of misdemeanor domestic assault on a former girlfriend. He was convicted last August in Aroostook County Superior Court of gross sexual assault, assault, and tampering with a witness for a 2006 incident involving his wife.

He faced up to 10 years and a fine of up to $250,000. Under the prevailing federal sentencing guidelines, Salley’s recommended sentence was between 51 and 63 months.

In motions filed before the sentencing, Assistant U.S. Attorney Gail Malone described Sally as a serial abuser and outlined his history of domestic violence against four women over more than a decade. She recommended a sentence at the high end of the guideline range.

Salley represented himself at the sentencing hearing, according to court documents, after asking that his court appointed-attorney, Don Brown of Brewer, be dismissed.

The investigation that led to state and federal charges began in November 2006 when Salley’s wife called police to file a domestic violence complaint. She told them that Salley had a gun, according to court documents.

It could not be determined Tuesday exactly when Salley would complete his state sentence and begin serving the federal one. The timing will depend on if and how much “good time” Salley earns in state prison.

Salley most likely will serve about 3½ years in federal prison on the gun charge. He is expected to be credited for the two years he was held without bail after his indictment by a federal grand jury on April 11, 2007, until he began serving his state sentence in November.

yes sex is suposed to be a given when u get married...but there are some women out there(no offense) that like to play hard to get or be a tease....so they end up getting it in the cram hole and they dont like it so they cry rape...

midnight_toker and Richard28, I probably shouldn't get involved here, but then. . .if a man holds a gun to his wife's head and forces her to have sex, that's not called making love. It's called rape. SEX should be a consenual act between consenting adults, regardless of orientation. The key word here is consenual.

last I knew a woman could tell her husband that wasn't in the mood. Marriage is far more than sex folks! And if a woman is married to an ass, maybe, just maybe she doesnt want to have sex with the jerk!

midnight_toker, are you for real? Forced sex, whether one is married or not, is RAPE. And there are more men like you here in Maine who truly don't know the difference than I realized. A woman has a right to refuse sex, whether she is married or not. However, if she refused too many times, divorce might make more sense.

A wife may have the right to so no to sex; however, the husband also has the right to say no to her no. Isn't all about equality after all?

I am glad he is in the clink. Granted I get frustrated when I hear I have a headache BUT I NEVER get pissed about it. That guy should stay in the clink longer if possible. I hope the wife is better off and getting the help that she needs.

Our judicial system is a joke. What is this................. time off for good behavior. Oh please, I never got extra time off from school for being a good girl. I never got extra time off for going to work when I should and being on time. I never got time off as a mom for doing my motherly duties. So why do we give criminals time off because they didn't pick a fight or etc while serving their sentence well whoop dee doo for them. This is why we have repeat offenders, because they got lite sentences in the first place.You do the crime you do the time to the full extent of sentencing.

If this guy was sentanced right the FIRST time around, he wouldn't be out for it to happen again. People like this never change. If this man was abusive- why the heck was she with him in the first place? Your a woman- stand up for yourself. This just proves what happens if you don't.
