‘A Wise Latina Woman’


A minority who looked for an issue to try to sink President Obama’s first nomination for the Supreme Court quickly seized on Judge Sonia Sotomayor’s remark in a 2001 speech. She said she “would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who has not lived that life.”

A few Republican members of Congress, and GOP pundits, denounced her as a racist. Most others have ignored this flap, some for fear of alienating Hispanic voters but mostly out of pure fairness. Newt Gingrich and Rush Limbaugh interpreted that line in Judge Sotomayor’s address as meaning that she thought Hispanic women were better judges than white males. She neither said nor meant any such thing, which may be why both men have backed off their attacks. Confirmation hearings for Judge Sotomayor are slated to begin next month.

In her lecture, Judge Sotomayor started right off by showing her taste in food has been “a very special part of my being Latina.” She said her “particularly adventuresome taste buds” led to her liking for pig intestines, and pigs’ tongue and ears.

That led to her observation that America takes pride in ethnic diversity while at the same time insists on ignoring those differences and living by a colorblind and race-blind standard. She agrees that judges should transcend their own sympathies and prejudices, but she said, “I wonder whether by ignoring our differences as women or men of color we do disservice both to the law and society.

“Our experiences as women and people of color affect our decisions,” she said. “The aspiration to impartiality is just that — it’s an aspiration because it denies the fact that we are by our experiences making different choices than others.”

She questioned an often-quoted statement that “a wise old man and a wise old woman reach the same conclusion.” She agreed with Harvard Law School professor Martha Minnow that there never can be a universal definition of wise. Then came her controversial remark about “a wise Latina woman.”

Pursuing that argument, she recalled that “wise men like Oliver Wendell Holmes and Justice Cardozo voted on cases which upheld both sex and race discrimination in our society,” while conceding that nine white men on the Supreme Court in the past had often shown an understanding of the values and needs of a different group, as in Brown v. Education and other decisions.

She concluded: “I can and do aspire to be greater than the sum total of my experiences, but I accept my limitations. I willingly accept that we who judge must not deny the differences resulting from experience and heritage but attempt, as the Supreme Court suggests, continuously to judge when those opinions, sympathies and prejudices are appropriate.”

With that understanding of herself and the proper role of a judge, a wise Latina woman, if found to be qualified — based on her years of legal work, not one speech — should add a welcome fresh dimension to the present court.

I have no doubt that Sonia Sotomayor will become a Supreme Court Judge and am looking forward to her confirmation. I am sure the hearings to confirm her (or not) will be thorough and very spirited....and I think she will do just fine.

I think she isn't a racist, but a bigot. Only a bigot could make sweeping statements such as hers about a wise Latina woman. Firstly, there is only one human race. There is no gene that identifies one as being "Caucasian". "Negroid", "Hispanic"... those terms are merely societal terms to separate the family of man, to divide us. Because Sotomayor's surname happens to be Spanish, it doesn't give her any special intelligence. When she speaks so idiotically, it points to her shallowness and THAT makes her not a good candidate for the Supreme Court. She's willing to judge a person, based on skin color, last name and not only on facts. I'm sure she will be approved by the Senate which is controlled by the Democrats.

When she broke her leg I hope she wasn't treated by a wise white male physician. Rumor has it that the White House has blamed Bush for her misfortune and Pelosi is calling for an investigation.

Imagine if a male white member of the GOP had made a statement like the following..........He" would hope that a wise white male with the richness of his experiences would more often than not reach a better conclusion than a Latina woman who has not lived that life.” ................

Justice is supposed to be blind. I do not believe Sotomayor has the "objectivity" required of a judge on the Supreme Court .

I can't believe I just wasted 5 minutes of my life reading this waste of space.

If you're on record in this day and age making sweeping, bigoted statements, you can't be very intelligent.

I would hope that a wise Caucasian male with the richness of his experiences as a member of the majority would more often than not reach a better conclusion than an Hispanic female who has not lived that life.

She said it many times, not in just one speech. It's absurd that someone could say something like this and even be considered for the Supreme Court. In this day and age, racists and bigots should at least have sense enough to keep it to themselves. People who think their own particular ancestry, gender, or racial background, gives them any special insights or abilities, and assume other groups lack this, are pretty much the definition of racist, and that should NOT be tolerated in 2009. I had hoped we had all outgrown this brand of overt racism years ago.

Leftists who like to put people into boxes, to categorize them and to separate the family of man simply don't understand what conservatives/right wingers are talking about. Liberals presume that every group of people, humans, that they can categorize MUST think and act in the same way. To them "diversity" means "one of them and one of them and one of them"...based simply on some physical characteristic that THEY identify. Science has told us that there is only ONE race. The physical differences found in all of us don't make us part of any particular group. Only bigoted thoughts divide us.

I had a college friend who was about 6'6" tall. He introduced himself to me: "My name is Joe. I don't play basketball. I don't even watch basketball." Think about it.

Not a big surprise the biggest liberal hack in Maine would give her a pass. God help her if she had been a Bush appointee. The liberals would already have hung her.

Folks, It is not about "Conservative" or "liberal". or even Republican or Democrat, it is about government attempting to keep us divided. watch the Democrats support this nomination, and the Republicans avoid strong criticism, much like the nomination of Clarence Thomas, only reversed. If the people are divided they are easy to control... Oops, I mean govern.

If she said or feels remotely this way; “I wonder whether by ignoring our differences as women or men of color we do disservice both to the law and society." Then she does not belong on the Supreme Court. Judges are blind to all these things. Laws should not make any exception to race, color, creed, or sex.

Another double standard rationization by the liberal press. If a White guy had said that - he'd be tarred and feathered. She also said similar things on multiple occasions. All this on top of the fact that she ruled against the White firemen in New Haven, CT who clearly demonstrated they were the best qualified for promotion. All because the Blacks in the Department either were not smart enough or didn't study to apply themselves. Either way it is an injustice as racial/gender preferences usually are. Affirmative Action = Racial Discrimination! Those on the left have no problem with racial discrimination as long as the right people are discriminated against.

Typical liberal hack. According to people who subscribe to this type of thinking:

*The only people who are ever capable of racial or gender bias are white males. In no instance is a minority ever capable of being a bigot or a racist. In no instance is a woman ever capable of being gender biased. Think about it, when was the last time you EVER saw a liberal accuse a minority or a woman of any type of bias? Again, only white males are capable of this type of mindset.

*When someone who you like has clearly stated their opinion, and it is contrary to the above type of thinking, just write an editorial and use the following phrase "She neither said nor meant any such thing" (even if they clearly stated and meant that exact thing). Repeat similar phrases for emphasis. Remember, the more you repeat something, the more true it becomes.

*When someone you like has a history of making many similar remarks in many different venues and speeches, write an editorial and include the phrase "based on her years of legal work, not one speech" even though the person has said similar things many times over a number of years. Again, printing something makes it true even if it is not.

anne od mdi - you illustrate the thinking perfectly - racial discrimination is just fine as long as the right people get discriminated against. Me, I wan't the most qualified whether it is a man woman, black, white or brown. I don't want to play diversity games to make sure I have just the right mix though.

Sotomayer needs to answer some tough questions concerning her view on racial identity politics. Also, she needs to wexplain her membership in the Latin racist group - La Raza, which literally "the race."

Yes, La Raza means "the race," meaning the Hispanic race. The organization is for the advancement of Hispanic people. It's kind of like the National Association for the Advancement of Colored People. Do you have a beef with the NAACP because they have "Colored People" in the title? What about the Sons of Italy? They're all Italians, you know.

I couldn't have illustrated it better myself. People like anne of mdi and are everywhere in the liberal sector. They will tell you they are against racism and discrimination, but what they really mean is that they are against racism and discrimination of only certain classes of people.

They believe that the best way to counteract generations of racism and bigotry is through continued racism and bigotry.

I have said it before.....from reading what some read here and other comment sites, I don't think that the white males can take it that things are changing. Oh, I can accept if someone was really opposed to her for "legitimate" reasons......but, I doubt it that is what this is all about. Things are just changing too much for some to handle. They would still like white men running most everything....you can just bet on it....but they will never ever admit that that is part of it.

The Hispanic population is by far, the fastest growing segment of the population in this country. Of course, that does not mean , because of that, that a Supreme Judge should automatically be an Hispanic. (of course not.) But the fact remains about the Hispanic population being the majority in this country, before long.....and if "white" Maine has a problem with that.....well, good luck!

How horrific. Did you hear what happened today at the Halocaust Museum in Wash DC? Luckily, I do not think anyone was killed, but it was an attempted murder(s). The perpretrator is a white supremacist! Maybe some lone terrorist like the murderer of Dr. Tiller in Kansas. But one wonders if some of the words lately (from certain commentatosr,etc.) isn't stirring up some of these madmen who already harbor enough evil? Hispanics are the fastest growing minority group, but you liberals are racist to put them all in the same category. They don't all think or vote the same way. Further, sometimes they have conflicts with Blacks.

Also, note fastest growing minority group does not mean majority. What it means is that at some future point, Whites will comprise the largest minority group in a demographic plurality. Whites will still have the most clout for some time.

What is deliciously ironic though is that some of these racial minority groups are socially conservative on issues like abortion and particularly gay marriage. So as in what happened in California, a larger segment of racial minorities may keep gays on the losing side for some time - - LOL!

I can't say if she is a racist or not, she has made some good decisions on the bench, but she has a bad track record of the Supreme Court rejecting her decisions. All I can say is if a white male had made the same comment she had made, as Ladyslipper pointed out, The BDN would nor anyone else defending her comment would be singing the same tune.
