BANGOR, Maine — A pregnant, HIV-positive African woman will give birth in a Portland hospital rather than a federal prison after a U.S. District judge on Monday ordered that she be released on personal recognizance bail while her appeal to the 1st U.S. Circuit Court of Appeals is pending in Boston.

U.S. District Judge John Woodcock last month sentenced Quinta Layin Tuleh, 28, of Cameroon to 238 days in prison — twice as long as the recommended sentence of 114 days — for having false documents.

Tuleh did not address Woodcock during the hour-long hearing. But she appeared to be elated as she left the Margaret Chase Smith Federal Building with her attorney, Matthew Erickson of Bangor, and Jennifer Putnam, director of clinical services at the Frannie Peabody Center in Portland.

The mother-to-be declined to speak to a reporter and hid from a photographer behind a pillar after her picture was snapped.

“We’re delighted by the judge’s decision,” Erickson said outside the building. “It was very thoughtful and well thought out.”

Tuleh, whose due date is Aug. 29, agreed Monday to remain in Portland while on bail and receive treatment coordinated through the Frannie Peabody Center. The center offers support to people diagnosed with AIDS and the virus that causes the disease.

If the judge had denied the motion, Tuleh would have been transferred to the Federal Medical Center Carswell in Fort Worth, Texas, at the end of the week, according to the U.S. Marshal Service in Bangor. The facility provides specialized medical and mental health services to female offenders, according to information on the U.S. Bureau of Prisons’ Web site.

In imposing the sentence on May 14, Woodcock rejected a 114-day, or time-served, sentence recommended by her attorney and the federal prosecutor, according to a transcript of the hearing. The judge also imposed a sentence that was longer than the zero to six months recommended in the federal sentencing guidelines.

The judge said that to ensure Tuleh received proper medical care through the birth of her child and to increase its chances of being born free of the HIV virus, which causes AIDS, he was sentencing her to remain in jail until two weeks past her due date. Woodcock also said he was concerned that Tuleh would be deported to Cameroon before giving birth if she were to be released earlier.

Testimony on Monday from Putnam and an agent with U.S. Immigration and Customs Enforcement allayed those concerns, Woodcock said in granting the motion for bail.

“I recognize that the sentence turned out to be controversial,” he said. “I can certainly understand how some have misinterpreted what the court intended to do in this case.”

Woodcock said that what he had wanted to do was “to step in between the prison system and the social [safety] net” to ensure that Tuleh remained healthy and that the child was born healthy.

“At the time of the sentencing, I had no clear understanding of what the community could do,” Woodcock said. “I had no specifics.”

He got them Monday from Putnam, who testified that Tuleh would be put up in a Portland motel until housing in the city could be found for her. The pregnant woman already has been connected with an obstetrician, virologist and pediatrician for treatment, she said.

Her housing, food, medicine and treatment would be paid for by state and federal programs, Putnam said. Tuleh would be assigned a case manager at the center and would be eligible to be visited two or three times a week by a public health nurse. Used furniture and clothing are donated to the center and would be available to Tuleh, Putnam told the judge.

Patrick Mullen, an ICE agent in Portland, testified that removal proceedings against Tuleh would not begin until after her appeal was completed. Once that happened, she would not be taken into custody but would be given a date for a removal hearing in U.S. Immigration Court in Boston.

By staying in Portland, Tuleh also would be close to Zachary Heiden, the Maine Civil Liberties Union attorney who is handling her appeal, and the Immigrant Legal Advocacy Project, which is handling her application to remain in the U.S.

Tuleh is in the process of applying for asylum in the U.S., according to court documents, on the basis that she is the victim of a crime. She may have suffered abuse while working for her former employer, who has not been named, in Aroostook County, according to an affidavit filed by her immigration attorney.

The African woman arrived in the U.S. in September and lived in Maryland until early January, when she went to Presque Isle to work as a nanny for a family, according to court documents. She was arrested Jan. 21 at the Presque Isle Airport after false documents were discovered in her luggage. She told investigators that she had quit her job in a dispute with the woman for whom she worked.

Tuleh became pregnant before she came to Maine, Erickson has said, but did not confirm the pregnancy until after her arrest. Her HIV status was not known until a few days before her sentencing on May 14, according to Erickson.

A three-judge panel in Boston has agreed to hear the appeal on an expedited schedule, but oral arguments are not expected to be held until late July and early August. In addition to appeals filed by the prosecution and the defense, a group of 15 individuals and organizations have filed in Bangor and Boston a “friend of the court” brief in support of Tuleh.

Woodcock said Monday that he found the brief “articulate and helpful” in making his decision about whether to release Tuleh on bail.

Deport her - maybe. But I cannot help but feel like a victim of the state of Maine as well as the United Staes of America. I was diagnosed with both liver and lung cancer 7 months ago. I lost my job due to the economy and since have been on unemployment in the stae of Washington. I have applied for and been denied Social security, Medicare and Medicaid. I have also been denied benefits from the American Cancer Society , Health for All -Washington and several other agaencies.All because I make too much on unemployment, 1200 a month, Trust me this barely covers the bills let alone a movie once or twice a month. The state o fo Maine will foot the bill for this womans unborn child and her as well but yet they would deny a natural born citizen such as myself the same basic right to life,much the way my current home stae of Washington has done in the past with others in her situation..

The state of Washington states that a telephone, basic cable or a PO Box are not needed nor is paying for luxuries like food that does not considt of Top Ramam 7 days a week. I qualify for 26 dollars a month in food stamps and was advised to be thankful by the state worker to be getting that much. I would not quite agree with deporting this poor woman but I would agree 100 % that we need to start learning to take care of those of us that were actually born here first.

If that child is born here , then said child is a citizen and she gets to stay and we get to support them and then she writes home and says come to Maine USA, they hand out homes, medical and money to any one, especially if your not from here and don't work.

The real reason the fat-a$$ed judge had to let her out is that he either knowingly or inadvertently set a precedent of protecting a fetus that Tuleh can still abort if she wants. But it seems unlikely now the V.A.W.A. money is taking care of her. This is her ticket to freedom and at least eighteen years of welfare if she plays her cards right. Thanks to Joe Biden she'll be taken care of better than a taxpayer, I suspect.

We came in with two checking accounts, so his money pays for rent and car repairs and mine pays for cable, phone, ISP, car insurance, electric, cell, gas for the car, my meds (he refuses to take any) and grocery. I only get $653 per MONTH.

Scintillate, thanks, I was wondering when someone was going to bring up the fact that if the child is born in Portland, the child then becomes a citizen of Maine and of course the United States and then we'll automatically underwrite the subsequent costs.

I, like most US citizens dislike the numers of illegal aliens being supported by the taxpayers. If they want to come here, get a green card just as most migrant workers have. One of our problems is that the vast majority of the citizens of the Uniited States do not want to work for the dollars we pay migrants and illegal aliens. In essence, very few jobs are being taken away from the majority of us workers, who are looking for or want a job.

I think that this woman should have a fair trial. She maybe her illegally but everyone has a right to a fair trial. Givre the woman a break she is trying to give her child a better life.

And now, to wait for the appeal to lower this absurd, possibly politically-minded sentence to something reasonable.

As for the woman, still waiting to see the extent of these false documents. If she is here illegally, I am confident she would be deported ASAP. Something appears to be legit, as she's still here.

With that said, I DO have a problem with supporting immigrants who have not been granted citizenship yet. She did break the law by having some form of illegal documentation. Rather than a stay in jail, which is still questionable depending on how bad this offence is, deportation should be the only action. Or, don't jail her at all. But that ALL depends on the severity of the offence. No funds should ever be used for non-citizens until all actual citizens in need are taken care of, which hasn't been achieved obviously.

But she'll be a citizen soon, so I don't believe this illegal documentation is as severe as it may seem. The judge even admits his sentencing decision was only to ensure the health of the baby, if I remember an earlier article right.

If she was here illegallly, she would've also been charged with 8 USC Section 1321 "illegal entry" or maybe "overstay." Illegal entry is a federal misdemeanor. She is per se deportable UNLESS she comes up with a real good amnesty claim. She DID NOT IMMIGRATE ILLEGALLY. She probably didn't even immigrate. Want a guesstimate on the real scoop? She came in on a B1-B2 visa, which is still good, copped some fraudulent documents for future use somehow, somewhere, and was going to try an end run via the Amnesty rules - or simply disappear into the crowd before her visa expired. She came in as a non-immigrant legally. Betcha a million. A "removal hearing" pretty much means she'll be deported as a convicted felon IF she can't prove the elements for Amnesty. The "immigration court" is a trumped-up, executive branch kangaroo court where the prosector and "judge" (actually an immigration adjudicator) are both on the same side. There is NOBODY remotely related to the U.S. Federal Judicial branch of government involved with what they so wrongly term immigration "court."

See, I don't put on Rush's jackboots, the brown shirt and start saluting and goose-stepping like you, nor do I see the current administration as any kind of saving grace. Like what seem to be the majority, thank god, I try to figure things out and understand the safeguards in place.

Bangorean, I'm sure if you call all the right people, arrangements can be made for her to stay with you. You can feed her, clothe her, pay for her medical care and her babies when it is born. I'm sick of it. I lived in San Diego CA for 15 years. This was common. And no a mexican would not be deported quickly. Story after story of pregnant women waiting till they are about to give birth, trudge across the border give birth in a field and walla, free stuff for the rest of their lives courtesy of the US taxpayer. Some are lucky, they make it to the nearest emergency room.

She broke the law by possessing fraudulent documents. She was rightfully charged and apparently pleaded guilty. She SHOULD be deported. Some of you seem to get it. And they get WAY more benefits and perks than YOU do. You really want something to rail about, read, if you can, the bill currenlty before Congress. Potentially 103 million immigrants over the next 20 years. THIS time the "amnesty" part appears real. LAST time "amnesty" meant pay a $5,000 fine, leave the country and get at the end of the application line to get back in. Trouble was, Rush, O'Reilly and the rest of the liars convinced the whackos that it was real "amensty."

That reminds me--on top of all the other liabilities to the taxpayer for keeping this woman here--it is illegals like this woman cause Americans whose ID's they steal, all sorts of problems, not the least of which is screwing up their credit history so they can't get a car or home loan. And it can take a year of hard work to straighten out your credit rating after something like that.

Some get it, some don't. Everything was done under existing law and regulation. WHEN you are put in custody the Government is responsible for your welfare. That's the rules. I certainly wish she could be deported post haste. Because there are few "hard workers" in the government, things just stumble along for months and months. The ire and hatred should be directed at the government that can't seem to do what it is supposed to do. Not at people that are simply trying to escape hell. She has absolutely no control over it. She has to do what she is told. The "homeland insecurity" system is broken. It's loaded with do-nothing, "don't rock the boat" federal employees with all the benefits, vacation, comp time and waiting for a fat retirement who take 2 hour (not kidding, I was a fed, and we could leave at noon and come back at 2:00) lunches. These people just want something better than they had at home. A very, very small percentage are criminals, yet the haters here call her an "illegal alien." Nope. And on paying into the system: what's funny is the social security and medicare systems are actually somewhat dependent - get this - on false document filings. Actual illegals with false ss#'s pay millions and millions into the sytem annually and never receive any benefit from the payments, for obvious reason: THEY'RE ILLEGAL. Just a comment, not a position. SS can use all the free money it gets. None of this is right, and I agree with many of the posters (except for the spitting haters). Something's truly wrong. It's the Homeland Security Full Employment Act. That and the crippling inabilities caused by Agency "Rulemaking" that creates additional layers of unnecessary bureacracy.

This is not a liberal/conservative issue, believe it or not. The conservative ticket loves the immigration of the cheapest labor they can find, since they can't find U.S. citizens to do the lowest of the workload. Bush, and the "thinking" conservatives pushed the Immigration bill in 2007, but talk radio got ahold of it and fed the Amercian public with so many lies nobody knew what to do. "Illegal aliens" is a great political football. Just look at the posts here. It almost guarantees votes. Big Labor, generally supporting the left, wants NOTHING to do with immigration. I think you've got your wires crossed on who is behind what with your "Libs" babbling.
