Six at LURC meeting given 9 p.m. curfew

BANGOR, Maine — Six protesters arrested last week during a Land Use Regulation Commission meeting concerning Plum Creek’s Moosehead Lake development plan are free on bail but say the conditions of their release are excessively harsh and irrelevant to the charges against them.

Ryan Clarke, 27, of Corinth; Jessica Dowling, 28, of Searsmont; James Freeman, 60, of Verona Island; Megan Gilmartin, 25, of Corinth; Christian Neils, 32, of Appleton; and Emily Posner, 28, of Montville each face disorderly conduct and criminal trespassing charges after refusing to leave the Bangor meeting.

Neils also was charged with resisting arrest and carrying a concealed knife.

Each member of the group who had to be carried out of the LURC meeting was released from jail later that day on $500 unsecured bail, which they would have to pay only if they didn’t show up for their Nov. 5 court date. What bothers them is they also were given a 9 p.m.-6 a.m. curfew and must submit to searches, and two were barred from possessing or using alcohol.

“We feel that these conditions are illegal and politically motivated,” Gilmartin said in a statement issued Saturday. “We took nonviolent civil disobedience action to draw attention to the problems with the process that was used to approve Plum Creek’s plan, and these bail conditions are being used to punish us for exercising our right to free speech.”

Penobscot County District Attorney Chris Almy said Sunday that the bail commissioner and the courts set bail conditions, and that arresting police agencies can ask for additional conditions for release.

The group of protesters has “requested to have the bail amended to delete the curfew and no-alcohol provision and we’re checking to see why that was requested,” he said. “At the bail hearing, we’ll be able to indicate whether we agree or disagree with that decision.”

The bail hearing could take place this week, Almy said.

If convicted of the disorderly conduct or criminal trespassing charges, those arrested face up to six months in jail and fines of up to $1,000. Neils also faces up to a year in prison and fines of up to $2,000 on each of his additional charges.

Freeman, Gilmartin and Posner have been arrested before for their involvement in other protests, according to information previously published by the Bangor Daily News.

The latest arrests happened on Wednesday as land use commissioners were preparing to vote on final plans for Plum Creek’s development in Greenville.

The protesters, associated with the environmental activist group Maine Earth First! rushed to the front of the room and locked arms with one another while denouncing LURC’s process as well as Plum Creek. They were arrested because they failed to leave when police asked them to disperse.

Sad to think that no one here seems to remember the days when peaceful protest was the way to get things changed. I am glad to see that they did something to show their feelings without being violent.

let these people come up with the funds to buy the land and they can then complain.

Plum Creek owns the land and has gone thru the system to get permission

Maybe what they should do is with draw their request and shut their property down

No hunting, fishing, hiking nothing then you can see what happens to the economy in hat area.

Happens all the time, police arrest people for Operating after suspension and tell the Bail Commisioners that they want conditions of no possetion of alcahol or drugs, subject to search and seizure 24-7. For the most part the bail commisioners go along with the officers request. Then if the officer is bored and he knows that the person on bail likes to drink at home he can go knock on the door and do a search and siezeure without a warrant. Arrest the individual on violation of conditions of release (usually good for 48hrs jail time). The individual will not be eligable for bail until they get in front of a judge for arraignment. Do this on a Friday of a holiday weekend and the individual won't see a judge until Tuesday.

It all depends on the bail commisioner.

Last I checked you have to sign a bail slip agreeing with the conditions, if you dont like the conditions then dont sign the slip. So you wont get right out but you will go in front of a judge who will decide on your bail and the judge usually does it by the book. The most important thing about bail conditions is if you dont get arrested then you wont have them...

Appeal the bail conditions. They are irrelevant, no matter what these people did. And it's obviously politically motivated. I'm not sure which way to go on the whole Plum Creek thing, but that's irrelevant in the analysis as well. Given some of the posts here, political motivation is pretty obvious.

I'd rather have Plum Creek own the land than these fools. If you can't act normal than why be treated normal? Acting like a fool at a meeting is an insult to you and everyone else there. They got what they deserved. Heck, throw them in prison.

If these people were teabaggers, would you guys feel different?

What if they were like the astroturfers that were bussed in like at health care town hall meetings?

JusticeLeague has it right....... The best way to avoid "politically motivated " bail conditions, is not get arrested. But for some dirtbagness is in the gene pool. Kinda like half the town of dextah......

I have the greatest respect for JImmy Freeman and the other protesters. It's too bad that we don't teach US history in school anymore. Any worthwhile change whether it be child labor laws, social security, women's right to vote, paid vacations, civil rights, minimum wage, etc., came about because people like Jimmy, et al, were willing to get arrested to make a point about injustice.

I understand why the judge wauld impose a curfew when dealing with people connected to EarthFirst. EarthFirst has been connected to vandalism, arson and violence in Maine and across the country. I think the FBI calls them "ecoterrorists".

What's all this talk of a long American history of civil disobedience? You are all aware that US history started BEFORE 1962, right? Most child labor law changes came about because of catastrophic industrial accidents which killed many women and children...that's bad publicity. Labor laws have changed over the years through blood shed...see the West Viginia Coal Wars.

Connecting a bunch of smelly 1960's era hippy want-to-be's to events which caused the deaths of many others is just wrong. If these "protesters" had been shot like dogs or burned alive I'd maybe buy into it. But as events have unfolded they appear to be willing to sacrifice only 4 hours in jail...so long as their bail conditions still allow them consume drugs and alcohol. I guess fighting "the man" doesn't involve any real sacrifice these days.

They should all be hit with federal conspicarcy and terrorism charges...then see how long it takes for them to turn on each other. We could make a reality TV show out of...think of the publicity that'd be generated. The show could be called "Drain on society, smelly, and gallactically ignorant"

Plum Creek should go develope some city and leave the forest to be forever wild. Only the rich will benefit from this proposed developement and we peasants shall clean their rooms and take their garbage? There are plenty of crummy jobs in developed areas we don't need a few handouts from Plum Creek. Their legacy will be forever preserved if they walk away from destroying the Emerson wildlife areas. As always there are the conservationists against the exploiters who claim it is all an ecconomic boom to the areas. Sure politics plays a role perhaps some choice lots are going to be slid under the moss to the people that help get this destruction started. Short sighted people see dollar signs. Plum Creek go develope some urban area and do something worthwhile for the rest of the level headed people. Never give the forest to the developers just ask Ken Burns. John Muir , Teddy Roosevelt.

The proposal that Plum Creek has put forth is very meaningful to alot of people and here goes the name calling again.

'If you don`t get what you want but if you try real hard you might get what you need'. We need to stop fighting with each other for that is how we are being controlled by Politicians and Big Corp. Lets turn our disrespect that we have for them by demonstrating what the vast majority of people think is right. By compromising when needed. Feeling good about ourselves even when we lose an issue. You can only feel good about yourself if you fight the battles (issues that concern us all) without hating. They have us right where they want us (Politicians and Big Corp.) Vote Change by us citizens working together for it.

There are also right and left leaning independents. It is all so hard to keep up with.

Every one in the room should have just stood up, pointed at them, and laughed. No cops, no arrests, no bail.............just laughing at the silliness which they specialize in!! :)

Interesting how "Civil Disobedience" apparently gives them the right to be criminal simply because they agree with the commissions position. Maybe I should go organized a "Civil Disobedience" protest at one of the three methadone clinics in Bangor, or the city welfare office or etc etc etc...

mtaylor-trust me at my neighbor's (one of the arrestees) "parties" there isn't alcohol. Party of about 30 seemingly unemployed sitting around in a circle around a fire for approximately 15 or so hours. I think it's all up in smoke, let's just hope the armpit hair doesn't catch afire LOL. There are other ways to change things besides making a spectacle of yourself every time you turn around.

There is certainly a long history in this country of civil disobedience! Let's start with the Boston Tea Party, continue with the coining of the phrase "civil disobedience" by Thoreau, and the rise of labor in the 1800's that led to things like the 8 hour work day and child labor laws. Calling protestors "terrorists" is just disgusting...since when did it become illegal to protest in this country?

I do think there is a story here.

The real issue in this article is about the bail conditions imposed.

And, if they seem unrelated to the alleged crime, what are the implications of this.

Don't believe everything a 60 year old hippie tells you.

If you decide to go get arrested for your cause based on what you have heard the "consequences" to be........... and then something different than what you expected happens to you once you actually do get arrested, don't go crying about it to everyone else.

Blame yourself.

Plum Creek should stop all developement in the Emerson Region and go into the cities to rehab. Build things because it is the right reason not because you have the ability to build or because you have the right to do something. Those protesters are doing us a service by standing up to the LURC and Plum Creek money machine. I know I don't want to get arrested but I sure wish those Plum Creek exploiters of the natural Maine woods to pack up and set their sights in a city help some poor people. Do something other than rapacious planning that destroys what little wild space is left. Many of you will disagree because you can. Once ithe wild areas are divided and it is gone there is no point in I told you so while some millionares drink coffe over their lawn deep in what was once the the Maine woods . All because they felt it is their right to cut, bulldose and pipe, road pave and wire. Of course the Plum Creekers will need Police, fire, telephones , Dunkin donuts and Starbucks. Don't forget EMT's and hospitals for those back injuries that acure while reaching for their copy of the Bangor Daily News in the driveway. Some of you have no idea what is going on here. This kind of progress is just Urban sprawl gentrified and priced just right so we,you, me, all of us pay big. Listen to your elders not your investment bankers. Don't be fooled by the promise of jobs and the ecconomic engine to power it all. Go away Plum Creek and it is time to change LURC hands on the pen. Governor Snow where are you Help! Freedom of speech ends when you violate someone elses freedom of speech by being stupid in open forum. When that happens you go to jail. You want to be obnxious with your opinions, take in outside. Act stupid get standard bail conditions. Oh, and non-violent protests... is that what the concelled weapon was for.

I am the mother of one of the arrested protestors. Frankly, I am appalled at the lack of intelligent comments regarding this episode. My daughter is not a eco-terrorist. Plum Creek is not afraid of her, but they do want to silence her. To clarify comments by paulbunyan, realist38 and studog; she has a college degree from a Maine college, is employed, pays taxes and bathes on a regular basis.

After watching the LURC meeting on you-tube it was apparent to me that the armed police were there in full force waiting to pounce. Their response to the non-violent protest was heavy-handed and over done.

Mainers do your research on Plum Creek. See what has happened in other parts of the country, Florida, Colorado, Montana, and Michigan. Very, very few permanent jobs will be created by this resort. The ones that are will be low paying housekeeping jobs which will go to temporary immigrants, in order to avoid paying the minimum wage. This situation has played itself out over and over again in other parts of the country.

Once this beautiful North Woods is developed it will never be returned to the pristine place it is today. This is only the beginning

On a personal level, as a parent, the comparasions of the protestors to the Manson gang are deeply disturbing. To compare what happened at the LURC meeting to the behavior of a gang that killed people, hung them from the rafters of their living room, cut the fetus from Sharon Tate's abdomen and then carved helter skelter on her body is misleading and meant to instill fear and terror in people.
