MEDWAY, Maine — A former town selectman facing trial for a fatal 2008 truck accident was being held in Penobscot County Jail in Bangor without bail Sunday after witnesses reported seeing him driving a road grader.

James Lee, 44, of Medway was charged Friday with violation of his bail conditions, East Millinocket police Officer Cameron McDunnah said Saturday. Lee is due in Superior Court in Bangor on Monday, Police Chief Garold “Twig” Cramp said.

Lee, who has a long history of driving violations, has not been allowed to drive since he was released on $50,000 bail after being charged with manslaughter and aggravated driving to endanger in connection with a Sept. 22, 2008, accident in which 28-year-old William Russell of Medway was killed and three others injured, in-cluding himself, Cramp said.

“His bail says he can’t operate anything, anything with a motor, anywhere, and that includes a piece of heavy equipment,” Cramp said Saturday.

Lee’s construction company was grading a dirt portion of Hathaway Road when witnesses reported seeing Lee operating the grader at about 3 p.m. Friday. One of them telephoned Donna Russell, William Russell’s mother, and reported what she saw, Russell and Cramp said.

“I told her, ‘Well, it doesn’t do any good to tell me if you don’t tell the cops,’” Russell said Saturday.

The woman told Russell that she had known all of the work crew since they were boys and recognized Lee driving the grader, Russell said. The woman drove by him twice. When their eyes met, Lee threw his arm over his face, Russell said.

When confronted by McDunnah, Lee denied driving the grader, Cramp said.

“They are saying that his boy Brian was the one that was driving,” Russell said of Lee. “Well, we will see.”

On Cramp’s instructions, McDunnah telephoned Penobscot County District Attorney R. Christopher Almy for instructions. Almy told him that the witness’s sworn statements provided enough probable cause for an arrest, Cramp said.

Lee will be held at the county jail until today, when he is due to appear in Superior Court in Bangor, Cramp said. A spokesman at the jail said Lee’s paperwork indicated that he would go to Millinocket District Court, but the spokesman said that might be incorrect.

Lee might already be in prison had Superior Court Justice Jeffrey Hjelm accepted a plea agreement regarding the fatal accident that was negotiated by Lee’s lawyer and prosecutors on Sept. 29.

Lee had agreed to plead guilty to the manslaughter and aggravated driving charges in exchange for a 12-year sentence with all but four years suspended. But Hjelm rejected the plea, stating that a 10-year sentence with all but six years suspended would be more appropriate.

According to the police accident report, the 2004 Chevy Silverado was traveling about 74 mph when it went off a curving rural road in Monroe that had a speed limit of 45 mph. Lee’s driving record says he had 36 traffic violations from 1986 to 2008, including 25 for speeding, which Hjelm cited as among his reasons for reject-ing the four-year prison sentence.

Russell died instantly when the truck slammed into two trees and rolled over. William York, now 38, of Medway, suffered a broken back in the accident, and Chad Brackett, now 31, also of Medway, suffered cuts to his right arm. Lee suffered a broken collarbone.

Because of his rejection of the plea agreement, Hjelm was obliged to allow Lee to withdraw his guilty plea, and Lee did, though he also could have accepted the six years, the prosecutor has said. The case is now due to go to trial next year.

If found guilty of the manslaughter and reckless driving charges, Lee could face up to 35 years in prison.

In Lee’s defense, 32 letters were written describing his character in glowing terms or citing his civic service as a business owner or 10-year member of the Board of Selectmen. The letters described him as a hardworking, caring man who grieved deeply about the accident.

Lee, who expressed deep remorse for the accident in court, has otherwise declined to comment since the accident occurred.

Russell hasn’t been so silent, having said previously that she believes, but has no proof, that Lee had flouted his bail conditions before.

“I have had three or four different people say that they seen him [driving], but nobody goes as far as to tell the cops,” Russell said.

Apparently, they need to keep him locked up if they want to keep him from driving. Keep him locked up for a very long time.

We can all pray he stays in jail until his trial. At least the streets will be a bit safer in Penobscot County.

Keaulanti it was no rumor. It was fact. The affidavid was sworn out. The arrest could not be stopped at that point or looked the other way or brushed under a pile of dirt as has happened so many many times in the past on top of the tickets he actually has recieved. You might wanna think about how far he drove that grater to get to the Hathaway Rd. Yep on the roads we all travel everyday. Endangering 100's of more people's lives. With a blantent disregard for human life. He got behind the wheel of another motorized vehicle. NOT in the middle of private property in the woods where he'd only hurt trees and God forbid use the Grater as a weapon to get him a moose or a deer. HE WAS ON A ROAD. With many many other vehicles since there was a party at the snow mobile club then!

If he cares sooooooooooooooooooooooooo much for his family as they all cried the blues at the last court date. Why would be have a blatent disregard for their well being and violate his bail? I understand his house is up for his bail? Can't you just see them a whining this time.... we won't have any place to live. YOU know what... every one of those employees that knew he was driving this week. and everyone of his family that knew he was driving this week... there ought to be a charge for them too. Complicity, Contributing to the deliquency of someone that just doesn't get it?, or maybe aiding and abetting a felon????????????

There really IS something wrong with this man. Who in their right mind and in his current situation, would dare to blatantly disregard his bail conditions? Let's hope the judge orders a "Psych Evaluation".

Two weeks. That is all it took for this butt-ugly guy to forget about the pain.

This guy needs a behavior lesson. Lock him up until trial.

Hey, Michael Vick who tortured dogs and ran "to the death dog fights" for years just got out on probation.. and now makes $millions in the NFL. He's a hero along with the more than several other rapists and killer felons that play for the NFL. And this guy get 36 years for driving a road grader? There is indeed two justice systems in this country.. one for the rich and famous.. and the other for common folk.

His bail conditions did not apply only to joyriding in Ferrari's, they prohibited him from driving ANY motorized vehicle and sworn statements from witnesses (not rumors!) say that he violated these conditions. So, as his bail conditions state, he goes to jail. He knew this before he drove the grader. Despite all his prior violations, knowing that his driving carelessness has killed another man, and so many of his friends coming forward to tell the court what a good guy he is and how he really DOES have respect for the law, he chooses to show us that they were all wrong about that and he STILL doesn't get that the law really does apply to him too. 12 years, all but 11 years suspended. Maybe then he'll finally "get it."

Coolfusion he is facing up to 35 years for killing one man and seriously injuring another. His choice to operate equipment when his bail conditions are very specific was again his choice. The problem is Mr Lee does not think the law applies to him or he didn't think the police would do their job. .

I also wanted to mention that they are saying his son was driving the grader. Wonder if the judge will buy that one or if the Lee's will just buy the judge. They are probably hoping they get Stitham, he's lied to protect friends and would probably allow the lie that the son was driving. There was a party going on down that road? How many other people saw him and looked the other way? They should all be interviewed to see if they saw Mr Lee driving that grader too.

Awsome a JOB well done to who ever turn his a........in. Now maybe all the PEOPLE that wrote in flavor of him being such a WONDERFUL MAN will think twice before they write somthing about him NOW...AMEN...

I don't know what the stipulations of his bail were, or whatever, but, all I know is, if I was facing prison time for killing someone in a motor vehicle accident, and I was only out of jail on bail, with a stipulation about not driving while on bail, I know I'd be darned sure I didn't get behind a wheel of cheese, never mind a road grader or a car, until after the trial.

As far as I'm concerned, if he really was so sorry, if he really felt the angst he said he did over his worker's death, if he really was taking responsibility for his actions, he would have stayed off the road grader if for no other reason that respect for that man's family. And even if he were a selfish, self-serving S.O.B., he'd not drive so much as a lawn tractor in his own interest of staying out of prison.

To me, it just shows he truly doesn't "get it", has no remorse whatsoever, and deserves to go to prison.

Guess he'll find out soon enough, the price he's going to pay...

Wow, this man obviously doesn't take the law very seriously. He has already caused the death of a young man and did not deserve to be out on bail in the first place. He thinks that he is above the law. He deserves to be in jail for a very long, long time.

I bet whatever jail sentence he would get just went up about 50%.

For those of you who read and see the unjust things that are going on in our legal system... don't you think it's time to fix this VERY broken system? Go to your city and town hall meetings. VOTE. Go to court hearings... Watch those in office and those who have authority, make them accountable!!!!! We're paying for them to do the right things, but no-one is watching over them.

LizaLou, I am minding my own business. The business of being safe on the roads, me and my family. And my neighbors. And you, and your family. When a habitual offender continues to flout the system and operate a motor vehicle, AFTER killing one and maiming another, AFTER being told that he CANNOT opertae ANY vehicle, AFTER 36-some odd other traffic violations. ME there were two pieces of motorized vehicles and two employees and they were both moving. There is no doubt and he will be answering to the judge that denied his plea bargain eventually.

Lizalou: It became our business when he pulled onto a public road. It became our business when he had an accident that invoked the need of the civil services which I, and my fellow citizens, pay for. It became our business when a fellow member of the community died, leaving behind a family in need. It became our business when he disobeyed the court order, and even if he wasn't one before, became, a criminal. It became our business when he put my life, and the lives of our family and friends in jeopardy. And it will continue to be our business, until he has paid his dues, and stops becoming a "guest" of the state on our nickel.

YES Mr Lee has violated his parol period. Yes Mr Lee has commited a crime which has involved the loss of another persons life. Wheres the confusion? Is this the first time Mr Lee has been seen driving on the road since his accident which led to all this?. NO. Thats a fact people! This is the first time he has been caught and arrested for parol violation. Did Mrs Lee know he was driving when he was on parol before this? I cant believe she did not. BUT how can anyone expect a mans wife or visa versa to have their spouse arressted for that! Consider then Mrs Lee's position and the emotional effect it is having on her and her children. Was Mr Lee attemptting to provide some form of income before his incarceration? We will never know. Its not an excuse just maybe his reason? Well he has been caught for parole violation. Time now to see what the judicial system does. Will they see that he DOES deserve to stay behind bars? I hope so as he is dangerous to the community period. However while you consider your post's remember Mrs Lee's emotional involvement . She and her children are victims of all this . Consider instead how can any DEFENSE attorney even consider this case as justifiable! And consider the Russel Family and there permanent Loss of a loved one. They deserve justice to the full extent of the law. There cannot be any excuses ,,,,,For example..... Mr Lee cannot read or possibly even write. Will that be the basis of the defense in order to allow him out on bail again? I should hope not. As the court system is responsible for making sure any person facing parole fully understands the meaning and content of their parole. Lets also remember how many previous vehicle operation violation's this man has had. AND why was he still permitted to continue to drive? Was there any other violations that mr Lee has not been convicted of in the past involving loss of life? YES! Like I said before, they can take that little piece of paper, but it doesn't stop them from driving. It happens every day all over our state. We need tougher driving laws!!! Having a drivers license is not a right, it's a privilege!!! When you've got more than a dozen offenses, then you are abusing your rights to drive.

This is an example of rural maine. Not much happening with law, or much happening with anyhting. A bored neghbor I presume, taking the big bad risk of a grader operator on a back dirt road out of civilization. Of course wrong is wrong, but when laws are for the benefit of people. these back road drama queens go a bit overboard. My own encounter with bizarre driving offenses occured in that locale, before adulthood. they went back 50 years to compare the retarded case of pushing a junk car less than 50 feet down a rural road to another driveway privately owned. Ambitious do gooder is also a law..it is in the blue books . this guys record is obviously showing life impaired with or without a license. It may get unjust punishment a a defense...if he is lucky. No license out that way? pack up and leave. death imminnent.

Bravo to the woman who did the right thing. It wasn't the easy thing to do. Who knows the ramifications this might have for her and her family. A lot of people are angry at her and blaming her for this arrest when the blame lays squarely on Jimmy's shoulders. Again BRAVO to you who said NO MORE to this habitual offender....hopefully more people will come forward.

and PropMgr it was only a matter of time before someone came on and tried to question the witnesses credibility. I do not think this woman has a history of making up stories. I don't think she is an 'enemy' nor was she vindictive. I think she like others around here are a little tired of the blatant disregard of the law. The attitude the law doesn't apply to him.

myopinion its a bail violation not a parole violation. He is a boss at Emery Lee and Sons. He doesn't need to be in a grater to get a paycheck. And as for his wife... she'd have to be a blind deaf and dumb not to know he was driving. And last time I checked at least 2 of those weren't true! I stand by my earlier statement... anyone found to have knowledge of this driving incident or any other in the last 2 weeks should be guilty of aiding and abetting! Oh and just so ya know... this person who came forward made the call signed the affidavid and got him thrown in jail where he belongs... is far from the ONLY person lookin' in the cabs of every Emery Lee truck in the last 2 weeks. Because I'll proudly proclaim not a one got passed me without being checked out!

And for all you bleeding heart whiners and or kin stop and think about this .. he didn't just drive it on the Hathaway Rd. He drove on all the streets necessary to get that equipment there! And had it not been for this law abiding citizen... he would have driven back to Emery Lee's. On those same streets... endangering my family my friends and the citizens of the tri-town area!

Congrats " anothernreighbor" you have displayed your intellect or lack there of ! Of course he MAY have driven that grader from and too the original departure area. Where was that? The Lee construction is in Millinocket and of course some equipment is located on RT 116. So where was it driven from? If from Millinocket he had to drive right by the east mill pd, where were all the local police? Also the Hathaway road is very often patroled by the east mill pd and is full of local traffic as well. So Mr Lee isnt showing much more smarts than the locals is he. Only ONE person saw him? I think not. Only one had the guts to call it in etc. Good for them. So in all this time YOU failed to see this man driveing over the road? HHHMMM. And thanks for the ever so important " ha ha ha " correction on the difference of his bail violation, whats the difference that bothered your small mind? A word? The fact is he is in violation. You have earned the gold star for " WHINER" . Ahhh aiding and abetting must be proven in the court systems correct? Or do you have another wisdomless filled remark for that?

Wow this gut is not to smart at all. And to those who say it was only a grader, HELLO, that's alot bigger then the pickup he was driving when he killed man. You don't think that machine couldn't do any damage?? His bail says no driving, then it means no driving anything on a public way!

The day didn't just "go bad" for no reason, it went bad for everyone (especially the deceased) because of one mans habitual disrespect for the law, his passengers, other drivers, and his lack of common sense. Incredbly, this man STILL seems to think the law really doesn't apply to him. I do thank God that every day is a good day, and it's my job to keep it a good day by not getting drunk and driving and killing some innocent person.

Medwayman, this was more than a bad day for some. I'm sure this man didn't do this intentionally and no doubt he is an honest, hard working citizen who made a mistake in judgement. Everyone makes mistakes but this obviously wasn't his first mistake and even as tragic as it was he obviously didn't learn from it. As tragic as that day was and for him to carry on, ignoring the law and going about his life like this is just another bump in the road is irresponsible and disrespectful. The very least he could do is respect the conditions that were given him until this is settled. If he has shown this much disregard for others and the law after all the grief his actions have caused then it's hard to look at him with a live and let live attitude. What does it take, if you don't accept responsibility for your actions after causing the death of an innocent person, to make you wake up and change your ways?

Some people just REFUSE to obey the law. Mr. Lee's track record proves that. If the latest violation can be substantiated, he needs to be held accountable. Housing him at PCJ in light of the circumstances is not unreasonable.

dogood maybe you should read the police reports from the night of the crash. Those grown men BEGGED him to stop. Trying to blame the victims is crazy. The blame for what happened that night is Jimmy Lee's and his alone.

Mr. Lee has no regard whatsoever for the laws of the state of Maine. He, his family, and friends refuse to see the implications this carries for the rest of society that must share the roads and for the most part do it within the bounds of the law. Mr. Lee, for whatever reasons feels he is above those laws and need not be accountable for them. These are choices he is making willingly and wantonly, if he has no regard for the law, then he must be punished accordingly. Nothing that has transpired in this entire case has been an accident.

Reading this article again and all the comments has me asking how a man who is 20 give or take a year with dark hair being confused for a man with sandy hair and 44? I don't see that happening. The son needs to ask himself if a perjury charge is worth it.

I just find it a little hard to believe that Jimmy was the one operating the grader on the Hathaway road but certainly not impossible. I can see if it was running the loader at his cement plant but not grading a road that the cops make frequent passes up and down that very road because it is a road that the high school kids tend to hang out on there little joyride. If there was a party going on at the snowmobile club then why would he have had the nerve to do this knowing that there would be high traffic in and out of this road. I'm sure this is something that they will look into but had no choice to make the arrest based upon what the witness claimed they saw. I'm not trying to protect the guy but it will have to be investigated furthermore unless they already did and we don't know about it yet. Why did this person call William's mom. Are they friends? 911 would have been on the top of my head to call first. Hopefully Jimmy has screwed the right head back on to his shoulders and that this is just not a signal that Jimmy just doesn't give a crap anymore. For some reason i think he does give a crap and if he's in his right mind he would have never did this knowing if he got caught he go back to jail. But you never know. I hope that the certain few are not just picking on him to add more to what happened.

One does not have to be a genius to see that he does not respect the law. Clearly, his over 30 prior violations is indicative of his thought process. As the saying goes: Past behavior is indicative of future behavior, and that is why many criminals end up in prison isn't it? I have no opinion on Jimmy's guilt or innocence. I am going to let a JURY of his PEERS determine that. We as citizens of the general public are, in a sense, his peers; however, we do not have the documentation, certified evidence, or procedures a jury will have the privilege of accessing. The one thing we have that a jury will hopefully not have...is the vested emotional ownership....the main reason for frequent requests for change of venue in our judicial system. Juries are selected from a group of disinterested peers. The jury selection process' primary purpose is to eliminate those jurists who may have emotional ties or some other form of bias.

Why was he operating, if he was in fact was operating, the grader? What if a vehicle full of teenagers rolled-over on the Hathaway Road, and he was on his way to use the machine to 'right' the vehicle, so the badly injured occupants could be removed and treated? What if a vehicle did roll-over, but because of his bail conditions he refused to render assistance? The man that refused to assist would be a man worthy of labeling as "Penobscot County's Public Enemy Number One."

We now know there was no vehicle rollover. However, I think MOST of us would agree there are legitimate mitigating circumstances/reasons for violating bail conditions or 'terms of release'...rendering assistance to those in need is certainly one. Each of us is going to draw that line in a different spot based on our upbringing, experience(s), beliefs, and profession. Was he working a 'town' job by the hour and he was the only one that had the experience to grade in this particular situation, thus saving the taxpayers a certain amount? With his, and his families, experience working on municipal fiscal issues, maybe he felt it was absolutely necessary for him to grade that certain area as cheaply as possible...problem water/ice area in the winter? If he saved a near bankrupt municipality a few thousand dollars, some, many perhaps, would say, "It was for the greater good." Even if it broke the law. If the law was cut and dry, black or white, we would not need juries (Or attorneys...Thank God. However, we would have to find another profession to chase ambulances) and our taxes would decrease due to the lack of jury expense(s).

I would recommend both sides of this 'debate' look up and develop an understanding of "Acts of Omission and Acts of Commission".

I'll go out on a limb and say he was probably grading that road because his nephew was having his wedding reception down there Saturday night and there were a lot of potholes in it.....but then again it could have just been a contracted job that coincided with his nephews wedding.....

As far as saving the taxpayers money...Jimmy clearly KNEW what his bail conditions were....He is not supposed to drive or operate equipment to keep the taxpayers of Maine and anyone else on the roads in Maine SAFE. Saving the taxpayers money, in my opinion is not a good enough reason to break your bail....saving a life yes.

Are you serious? The man already plead guilty to the charges. That settles the jury question for me. The only reason he is not in prison is because the judge refused to accept the prison time (I AGREE WITH THAT). There is no justification in my book that would allow this guy back on the streets in any vehicle. I too wonder why he was grading that piece of road. Is it true that his family was having a wedding down the road? I would hope that he is not let out on bail. Violating bail conditions should result in an automatic revocation of bail. I say keep him in jail, till all the facts come out on the case, but just his past driving record, and the fact that a person died while riding with him is enough to keep him in jail until the trial....

PEOPLE, this man has had umteen moving violations in the past. Did he think he should pay any attention to them or to the law? Guess not. Lizalou~ many posters here are retired and one is free to do whatever they choose with their "free-time". This is the USA where freedom is part of what we've all had to fight for. Enjoy it. I'm not certain how old you are, but perhaps if one of your parents, siblings, children... etc... were killed by a man who had this many prior violations and hadn't been properly reprimanded by the state in the past, you too, would understand the outrage of the citizens in the state for what he's now done. Now for your relatives Mz Lee... Emery forces men to drive trucks that wouldn't pass inspection on 100s of counts per truck. Emery doesn't pay his men to drive his unsafe trucks to Bangor till they get there. Then they get paid. ( Against all worker's rights laws ) After they work all day in the unsafe trucks. He calls and tells them to leave the trucks in Bangor and find their own way the heck home!

Within the back there are many nerves and nerve endings along with muscles, bones, tendons etc..., have you ever pulled the muscles in your neck or back? Lisa the situation sucks for everyone....but lashing out at the victims that were in that truck and their children is wrong...the family, not saying you or your children, has to stop blaming the victims for getting in that truck! The family has to accept, as Jimmy has, that he did this and they all have to deal with it! NOT an easy thing to do but the Yorks and Russells have every right to be angry, it's part of the grieving process! It's normal! To answer your question, when someone is told dozens of times to change his behavior or someone is going to get hurt, and he does not change his behavior and someone does get hurt, that's not really what I think of as an "accident.".

I agree that it's unfortunate his family has chosen to join in this online discussion, and especally because they don't seem to be focused on apologizing on behalf of Mr Lee to those his actions caused much heartache, but it is their free choice to be here and those who are hurting or are just disturbed by Mr Lee's serial disregard for the law shouldn't be asked to not express how they really feel.

Many times the police tried to tell Mr Lee, in the form of tickets and fines, that what he was doing was socially unacceptable to other members of his community, but he chose not to hear them. Maybe now, as he and his family hear the outraged voice of the community itself, he'll finally get it. Unfortunately, I don't see any signs of that happening yet though.

You know, you are right. I was wrong to ask all of you people to do the right thing after you learn his children are reading these comments. I was wrong to ask you to stop exercising your first amendment right. And I was truly wrong to believe that you would put aside your desire to see your comments be in the spotlight for the sake of some 'poor unfortunate children' being borne into a situation of which they have no control. I was wrong to believe that any of you would have the humanity and morals to stop writing after learning the children are reading. STOP IT! ALL OF YOU! We've all been through hell, just leave it alone. There have been some disgusting things said about ALL of the families involved and it is appalling to me. What is WRONG with you people???? These people are human beings. When I explain this situation to my kids, I just say, "don't say anything bad about that man, because even if you are mad at him, God still loves him" Am I the only one trying to teach my kids NOT to hate, instead of adding fuel to the fire? KNOCK IT OFF! Everyone has a right to be angry. Jimmy IS responsible for this accident and his actions after the accident, but stop teaching these kids hate, and how to get revenge.
