Officer says he was fired over residency law


LINCOLN, Maine — Town officials fired police Officer Chad Chubbuck earlier this week because he would not comply with a town residency requirement that mandated he live within 15 miles of town lines, he said late Thursday.

“We left on peaceful terms,” Chubbuck said in a telephone message. “They have the policy and basically I violated it. ... That’s the whole story.”

Town Manager Lisa Goodwin again declined to comment on the matter Friday, citing personnel concerns.

Chubbuck moved from town to Milford because his wife got a new job in Bangor. The move, he said, was more convenient for her and her work travel requirements.

“Milford provided us with a place that was halfway in between, timewise. I was disappointed to leave Lincoln but look forward to future opportunities,” Chubbuck said.

The termination did not come without extensive communication on both sides.

Chubbuck had disputed with the Town Council the town’s residency requirements, appearing before the council during at least one council meeting. He had applied for a waiver, which other officers had received previously, and was rejected.

The council also chose not to amend the policy, citing the need for officers to live in or close to town in case of an emergency.

Chubbuck earned several commendations during his time on the job. He was making a routine check at FASTCO Corp. off West Broadway on April 24, 2008, when he saw two men loading scrap metal into a maroon van.

After investigating, Chubbuck charged the two men with theft and violation of the conditions of release. Chubbuck and one of the business’s owners, Scott Smith, estimated the two men were in the middle of stealing $300 worth of metal.

Smith and his brother Alan, a co-owner of the business, praised Chubbuck and Lincoln police for their efforts. The 21-year-old company, which helps power plants design, build, repair and install the equipment they depend on, had been burglarized about a half-dozen times over the previous six months, Scott Smith said.

Chubbuck also helped locate a missing 6-year-old girl in May 2008 and was the lead investigator in the probe of a local couple who had passed bad checks in at least seven Penobscot County towns in March 2009.

Chubbuck is searching for a new job, and Goodwin has said she hopes to begin looking for his replacement within a few weeks. Chubbuck’s slot on the police roster will be filled by current and reserve officers working overtime, she said.

Lincoln also has launched a second search for a new police chief to replace William Flagg, a Milford resident who resigned Aug. 25 to take a full-time but temporary position with the Penobscot County Sheriff’s Department, his former department, as a patrol officer. He has said he hopes eventually to secure a teaching position in law enforcement.

Lincoln’s first chief search drew only six candidates, Goodwin said.

A former state police officer, Fire Chief Phil Dawson is filling in for Flagg.

Millinocket's got a position for him.

No waiver? and being such a good cop? sounds like they let a asset of the force go, and buy the sounds of it his family came frist and for that he gets the at-a- boy! the guy has vaules in the right places, and good luck on finding a new department to work for.to hell with sinken lincoln

id say there is quite an influence in town,,,,,great gig if you can get it,,,,,,,anyone wonder about phil dawson holding 3 positions,,,,fire cheif of howland and lincoln and also fill in chief of police,,,,talk about conflict of interest...

What's that smell up in Lincoln? Something stinks and I don't think it's the Mill. Maybe it's time for a big shake-up in management - get rid of the Manager and Fire Chief and get good quality people.

But wait, let's get rid of the manager and put Phil in as acting Town Manager. He's already acting as Police Chief, kinda acts like a fire chief. Maybe he's just acting. Trick or teat Lincoln, it's your choice.

If he is as good of an employee the article states, then Lincoln officials are DUMB. If there is another side of the story, will we ever hear it??

Just one ? Let's see Ingersol's jobs open. And I doubt it's gonna take long before a couple more can't keep the town quiet anymore! But seriously IF wifey is working in Bangor - Millinocket's sorta the wrong direction. I'm sure most of the law abiding citizens of Millinocket would LOVE to have the 2 officers they lost to Lincoln and Bangor back. And more than willing to swap them for a few still here!!

From reading the comments here from presuming Lincoln residents... gotta wonder if they cleared a slot on their PD to hire Millinocket's latest discarded one? All I can say is " GOOD LUCK LINCOLN " you'll need it!

Yea in a town that sends its only ambulance what 4 or 5 towns away on a regular basis? Sure hate to need an ambulance in Lincoln when its in Wynn. or Howland etc etc etc! Sorta like Millinocket's taking a call clear up at Chamberlin and who cares about the taxpayers of Millinocket that need an ambulance in the mean time!

And the chief that just resigned lived in Milford, too, huh?

Its the law all over Maine that public servants have to live with in 8 miles of the dept they work. If they are going to enforce it, then theres another guy who lives in Brewer with his ex wife and he works in Lincoln as well. Hes not listed on the web site anymore so maybe they canned him too.

What's the matter Mr lab_owner09 does Dawson intimidate you? Because from reading your senseless rantings one would get that feeling. Maybe you need a new hobby, you make no sense at all. Some of you people have no idea what the real truth is about Chubbuck leaving. May be you should look into the reason for him leaving and give the facts to Sambidis so that he can write a whole story instead of half of one. Wow, someone doesn't follow the rules and its everyone elses fault. Doesn't the police have a union or something? I don't think between the two of you that you could get a mall security job.

mominbrewer- Its not mandatory statewide to live within 8 miles if you are public safety. The Police union in Lincoln has it in their contract that they will live within 15 road miles of the public safety building. The Fire Dept does not, but it is also in the town charter so all the firefighters comply as well. Chubbuck was a good cop and i hope he moves on to bigger and better things as everyone who leaves lincoln does.

Sounds like he was good at his job.....Doesn't make sense that Lincoln would let someone who is doing their job go...... I drove by the other night and golly gee I saw 4 cars parked in the Lincoln parking lot across from Mardens....whatever happend to changing that????

lc1077 - When it comes to the way decisions are made in Lincoln, not very much actually makes sense. In terms of reigning in the problems that are allowed to go unabated in that Main. St. parking lot - nothing has been done. Oh yeah, they MIGHT get the video security cameras on line someday soon after wasting more than a full year doing virtually nothing about getting the service to make the cameras operational. In a town where they've had a revolving door of personnel in the Police Chief's position (due mainly to the fact that there's a small group of influencial current and past Town Council members, and business leaders who won't let the police do their job) the Town Manager was recently quoted as saying "I don't know why we got so few apllicants for the Police Chief position". Get a clue Ms. Goodwin!

Need a better example of how things are run in Lincoln. The two young men who admitted that they were involved in the actions that led to the truck driver (Mr. Isdell) losing his life in that parking lot more than two months ago are still walking the streets free of ANY charges in Mr. Isdell's death. Though they freely admitted to theft of Mr. Isdell's cell phone and a carton of cigarettes, and of having a physical altercation with Mr. Isdell that immediately preceeded his heart attack and death - not a single charge has been filed? The interim chief claims that he's doing a thorough investigation. BS - he's had plenty of time, assisted initially by the State Police, to file charges in that incident. Charges of theft and assault could be filed strictly on their own admissions! At what about the very real possibility of manslaughter (depraved indifference) charges? Apparently he's too busy cashing municipal pay checks as the Fire Chief in two towns plus acting Police Chief. How ridiculous is it that that man's family suffered their loved one's death and yet months later not a single charge has been filed. Quite frankly, if I were them, by now I'd have given up, thinking that the corrupt Town of Lincoln just doesn't care enough to take action because the man that died was from another state.

Come on Lincoln Town Council, Town Manager, and Police Dept. - do what's right for the deceased man's family. Get off your arses and demand that action be immediately forthcoming. If it had been someone in your family that had died and months later no charges had been filed despite the fact that the two men admitted to being criminally involved - you'd have found a hanging tree by now! Doing absolutely nothing brings disgrace upon the entire town and there are many fine citizens in Lincoln who deserve much better than that.

That's some purty fancy talking Mr Northwood_Maine. You're trying awfully hard to sell your version of dung. Too bad that the only ones that would buy it are same shortsighted ill advised living room CSI non-experts such as yourself. Did you ever stop to think that the people responsible for investigating this incident may actually know what they're doing or maybe they were smart enough to consult with others and come up with a plan to do a thorough investigation. Maybe you'd rather they just do it your way drop a couple of charges you read about in the newspaper and possibly not learning the whole story. Get a grip on yourself before you fall off your throne. Maybe you need to get better facts than what the reporter wrote about. Maybe there is depraved indifference, how in your self imposed authority and all of your knowledge would you prove your case? Maybe the police have a clue and you don't. Maybe, maybe, maybe.

You are probably too busy to consider all of that, its easier to attack the police and any other official you think are plain stupid such as yourself. Come out of the woods and grab a touch of reality. I'm no expert but I would try to get a stronger case that wasn't hooked to a carton of cigs and cell phone.

The town has their rules! He approached the town and gave his request and the town reviewed his request and unfortunately denied it. Mr. Chubbuck went against the rules and he knew the outcome. It doesn't matter if they allowed it in the past, every request was different. It sucks, but it's time to move on. Best wishes to you Mr. Chubbuck. If you were as good as the article stated then you should have no problems finding work.
