Man pleads guilty to violence; victim ejected from court


MACHIAS, Maine — Donald Newell of Princeton pleaded guilty Friday to domestic violence, a Class B burglary, and violations of both a protection order and his conditions of release, but it was his ex-girlfriend’s behavior that really caught the attention of Justice E. Allen Hunter.

After venting her fear, anger and frustration, the woman refused to be quiet. She repeatedly interrupted both the judge and Newell’s attorney during proceedings in Washington County Superior Court.

Hunter warned the woman several times that her behavior was disrupting the proceedings and that her language was inappropriate for a courtroom, but finally had a bailiff escort her from the hearing.

She continued to shout as she left the room and was brought down the stairs to the first floor.

Newell, whose age was not available, pleaded guilty to all four counts for events that took place at about 2:45 a.m. June 22, 2009. First District Attorney Paul Cavanaugh said Newell broke into the victim’s home in Princeton, broke a window and tore a door off its hinges.

The victim ran to a nearby gas station and called police. Cavanaugh said Newell’s conduct violated a protection order and bail conditions placed on him after an incident in May 2009.

In a rambling statement to the judge, punctuated by profanity and at times shouted, the victim said Newell broke six windows during the May incident. “He was cut severely and there was blood throughout the house,” she said. She said she had taken care of Newell for two years but that they had never lived together.

Newell has been in custody since the incident in June.

He was sentenced to two years in jail, with all but six months suspended, and two years probation, all for the domestic violence charge, and six months each on the violation charges, to be served concurrently with the longer sentence.

He also was ordered to pay $1,000 restitution for damage to one window and a door. There was confusion about an estimate provided to the court for $2,800 to fix the damage.

Newell’s attorney, Jeffrey Davidson of East Machias, said the estimate had been provided by a contractor who was having a romantic relationship with the victim.

Appropriate and anticipated reaction on the part of the victim. Pure hate. We deal a lot in overseas pre and post-trial hearings. Know what they do? Now I realize this is not mentioning Maine...but just bear with me for a second:

In Asia, and some European countries, there is first a "confrontational interview" made through the courtesy of the local police department with the chief investigator being the head guy. All sides enter a room, where screams, shouts, kicks, slaps, punches are the order of the day (victims controlled to a point by the police). Then, if a non-solution is arrived at, at the end of the "interview", the person who is the violator is sent home - released from jail, and it is up to the victim to bring charges. No jail time for the perpetrator is made or that person placed in jail again until after the trial has ended and sentencing/punishment have been issued. Not really good if a violent person attempts to get back to the victim again.

Damage to one window and a door amounted to $1000; then the report stated seven (7) windows were damaged...total of $2800? Confused? Maybe something else was damaged as a result of flying/breaking glass which required repairs, too!

lol I can assure you as I live in Germany the Spike's comment above is very inaccurate. In fact, there is intentionally very little contact between the victim and the offendor in any proceedings. German courts are extremely formal and outburst from anyone is not tolerated at any level.

SantiniSapagoandSpike. I can see where it would cost $2800.00 to replace a door and window. First the vic is a woman, that cost double over men for the same type of repair to some carpenters. Next if the window and door is not a stock size and they never seem to be, it's a special order, cost more. Most carpenters charge you the cost of the window or door to install it but if theres other work like taking off the siding, sanding, staining, painting, thats more.

When you have to remove the trim inside and out you damage the trim and the wall and siding all needs replacing of which you'll likely find no one makes anymore,including paint, wall paper or paneling, trim, windows and siding now your house looks like patched together crap. Doors are worse because chances are the flooring will be damaged or the door is thinner and will need to be patched, good luck finding flooring to match what you have. Chances are this guy damaged the frame work too when he ripped the door off. So if you need to replace a window and door, thats at the very least $600.00 and $600.00 to install and then theres everything else that gets damaged replacing them. Whose wants to clean up someones blood all of their house lord knows what disease they carry and this guy barely gets a slap for breaking a restraining order. She's been victimized three times I don't blame her for being angry.

Would anyone here care to read the comments made on the SATURDAY Bangor Daily on this incident? The woman is a big problem in the Town of Princeton, with her paranoia. SHE should be medicated a lot better than what she is!!! Take a moment and read the Saturday posting please!!!

Next time, be armed and ready, shoot the SOB, then pay for the clean up yourself. Problem solved, one time repair costs and no more threat.

Scintillate 7:56 AM~ I wholeheartedly agree wit h you on the cost. She is the victim and regardless of her history, no-one deserves what this man did to her. All he had to do was, walk away and never return. Plain and simple.

I understand that his woman is off her rocker, but no-one has a right to damage another individuals property.

Angry - think she was angry- Wow- Some people need to learn to say their piece and then SHUT UP _ She is lucky the judge did not hold her in contempt of court and throw her in jail .

You would be "Amazed" at what the people in the town of princeton think she deserves, you can only push someone so far.

i agree that noone deserves to have ther property damage or to be hit but shes one to follow you down the street throwing stuff at you if you try to walk away from her! Shes nuts-o!

Perhaps the woman was angry because, once again, the system didn't work! Assualt, domestic or otherwise, is taken altogether too lightly. People are pysically hurt and live in constant fear that their attacker will be back when they get out of jail, if they even went to jail, after a mere 6 months! 6 months is nothing! Repeat offenders ought to spend 6 years in jail without parole. Then perhaps they would think twice before going on a rampage or permantently damaging someones body. Rape someone and you get 15 years. Knock all their teeth out, break an arm or leg, damage a kidney or give someone a concussion and you might not even go to jail. Rape or physical abuse of any kind should not be tolerated. I can here the lads now, "oh boys will be boys."

Knowing and seeing what this woman can do, there is a good chance that she did a lot of the damage herself just to have something to pin on him. He is a very mild mannered guy. She is well known for doing things like that. Ask any of her neighbors. So all you men out there beware when you see a nicelooking older woman with a mini skirt and high boots hitchhiking. She can easily land you in jail for something.

if she is so scared of her attackers then why did i see her the other day going into the apartment of the guy that shot at her last week!!! Listen to sassy1 she hit the nail on the head!!

This woman sounds as crazy as one my fiance dated briefly... 3 yrs later she's still harassing him! But since its a woman harassing a man nothing is done... luckily he hasn't cracked like this man (not to say he's right for what he did) but I could see it happening.

This woman was obviously upset having to confront the man who broke into her house and tried to assault her. An advocate should have been with her but I think that having the victim of an assault and the abuser together in the same courtroom is never a good idea. And look at his sentence, six month in jail for doing so much damage!! Justice in Maine for domestic abuse victims is a joke!!

Hi ElectraGlide - I just love your postings - too bad you don't spend some time in Princeton, it is a neat little town - but like Sassy1 said - don't pick up any hitch-hikers LOL And don't leave your "hog" with the motor running - you might be missing it when you return!! It has happened before in many places!!! Apparently she has been accused (not proven guilty though) of stealing cars??? WOW!!! I did not know about that until someone mentioned it in one of the postings on Saturday's item. You can see these by going to the Downeast News on BDN.

The woman has a mental problem that this neighborhood has to deal with - it has nothing to do with the person who broke into her house - she encouraged it as far as I was told - she basically lived with him (or at least in the same house as he lived in) on the Indian Reservation for some time and made a nuisance of herself there, they tried to get rid of her - she did do a lot of interfering with his family while (supposedly) trying to be a "caregiver" like Harleychick said she used to do when she was younger!! This man does have a problem, but HIS family is dealing with it and he is getting some help, however he did have no right to break into her place and damage it. I would like to suggest that someone get her out of there before he gets out of jail so she can be protected from him??? Move her to Bangor???

Like I said on the other page, this woman definitely needs to have her mental issues attended to.

I've also lived around this area for a long time and would sometimes pick her up hitchiking if I didnt have any kids with me.

Hopefully she doesnt get hurt or hurt someone else.

Donald Newell is just as sick as the woman. Back when I was 13 years old riding in the back of a car with him in Indian Township he touched me innapropriately and then of course lied about it. He is an abusive alcoholic (witnessed many times) and I was praying he would get more time than 6 months. The justice system in this state is so screwed up!!

Sassy1--Ain't love grand. Passionate moves which, for some, totally overides common sense. Thanks for the trap warnings but the best thing to do is rent the whole show and walk away. Its better in Vegas.
