BANGOR, Maine — The male victim of a brutal sexual assault and burning that happened while he was passed out drunk one month ago is still hospitalized.

“[He] remains in critical condition,” an Eastern Maine Medical Center spokeswoman said Monday.

The 43-year-old victim told police he got drunk at a party on Nov. 28 and woke up the next day with burns on his back, an injury to his abdomen, a broken ankle and internal injuries, including a perforated bowel, and was not sure how they happened.

During the investigation, police interviewed Laura M. Smith, 27, who formerly lived at 24 First St. where the party took place. Smith told police that she sexually assaulted the man “as a joke” while he was passed out and then burned him with microwave-heated water.

She was charged in early December with elevated aggravated assault and gross sexual assault, and Judge Ann Murray set her bail at $50,000.

Smith remained in Penobscot County Jail on Monday night.

The male victim called for help at 8:40 a.m. Nov. 29 and was taken to EMMC. He later had emergency surgery to repair his torn bowel, which had “caused his body to become infected,” according to the police affidavit written by Bangor police Detective Brent Beaulieu.

The man has been in critical condition at the hospital since then.

While he is identified in the report, the Bangor Daily News does not typically disclose the names of crime victims.

An eyewitness who attended the First Street drinking party called police the next day saying he was “still disturbed by what he witnessed,” the affidavit states. He told police that the victim was naked and lying on the floor, almost unconscious, when he arrived and that he watched as Smith sodomized the man with a wooden dowel.

“Laura laughed about it,” the witness reported to police.

The eyewitness also told police he saw Smith repeatedly heat up water in the microwave and “then poured the water on [the victim’s] back,” the court document states.

Smith, who turned herself in to police on Dec. 8, said she poured the microwave-heated water on the victim and sexually assaulted him.

“She said that she did this as a joke,” the affidavit states.

The victim’s ankle was broken when Smith and the man who hosted the party attempted to drag him up to his apartment and “he fell down the stairs,” she stated in the affidavit.

If convicted of the felony elevated aggravated assault charge, Smith would face up to 30 years in prison and a fine of up to $50,000. The gross sexual assault charge carries a penalty of up to 10 years and a fine of $20,000.

When police searched Smith’s apartment, they found a note apparently written by her that stated, “I did sumthing to sum one as a joke and it got out of hand,” court documents state. “What I did could end me up in jail.”

This is quite possibly one of the most disturbing stories I have ever read. It boggles my mind how somebody could rape and torture another human being and call it a joke.

This would be a good lesson to teenagers and college kids to not get rip-roaring drunk to the point of passing out.

That someone could do such things to another human being is disturbing. That it was a woman is even worse. Whatever happened to the Nurturing instinct that women are suppose to have? Has she been evaluated for a mental illness?

A perforated bowel out to land her with an attempted murder charge! Very serious and dangerous condition! Sick, sick woman -what about the friend that helped her try to get him up the stairs? I'm glad this person came forward to report the incident, but could nothing be done at the time to stop the abuse?

Why didn't the witness report this when it happened? Seems they would be an accessory to a crime??

The Nile River runs though different parts of Africa. The White Nile runs through Sudan. The Blue Nile runs through Ethiopia. They both Flow into the Nile of Egypt. The kind of denial that runs through this country is even grander. JD2008 needs public records. The pictures of the piles of nacked men being pointed at by a female American Guard ought to get some people to suspect something may have been going on.

This person is obviously mentally incompetent and the victim is most likely incompetent as well. We will pay for his hospitalization and treatment as well as her court costs and future treatment. One wonders if it would be more costly if they were institutionalized and not allowed to be in the situation they were in. Just a thought. This would not have happened 40 years ago as both of these people would have been managed by our mental health system at the time.

This is the most obscure and deranged brutal assault I've ever heard of a woman doing to a man in this state. Generally this is not something that you see women do to men, but rather a men doing to another woman, child or even another man. Not that it's even normal when a man does it, but it's just not something that women generally do. There IS something very seriously wrong with her!! I'm glad she's not been able to make bail!!

What boggles my mind is the fact that he was so drunk, he didn't even feel the scalding hot water she poured on his body. As someone else mentioned, she should never be able to have any children! It's too bad we couldn't sterilize folks like her.

I also found it odd that the man who witnessed this crime, didn't immediately call for help for the male victim. What is wrong with these people?!!

Hope its life in prison, but we all know she will probably get some poor me I am insane plea agreement and go to a mental hospital for a few months then be out free, while this poor guy has a lifetime of physical and mental problems to deal with! If I remember correctly and earlier report stated that she is mildly retarded, which means an IQ below 70. Personally, I have questions about the man whose apartment this took place at and who tried to "help" carry him up the stairs. Earlier articles also stated that he kicked the victim. The woman had absolutely no criminal history at all. What about the guy who kicked the victim? What is his history and why has he not been charged? When all is said and done I won't be surprised if it comes out that that guy coached her to do those things. It wouldn't be too difficult to talk a mildy retarded drunk person to do something they wouldn't otherwise do. Someone does not just wake up one day and commit such a heinous crime as this as their FIRST offense. The crime was very sadistic and anyone who would think it was "funny" would HAVE to have some kind of history...probably torturing animals, maybe setting fires, assaults, stealing or some kind of sexually deviant behavior. It just does not add up. The witness isn't being completely honest, either, IMO, because if they were that disturbed by what they saw they would have immediately called the police. Almost seems like a bit of covering their own butt after the fact. There's got to be A LOT more to this story than has been reported.

.What part of this terrible attack strikes any of us, except Laura M. Smith, as a joke? No one gets to put their hands on another person to attack and cause this much damage to a human being. The victim in this article did not seem to be posing a threat to anyone and, now, he is fighting for his life. As I read this article,I get a sense that this victim is far from "out of the woods". Hopefully "probation" will not be the punishment meted out in this case.

BDN uses the phrase in the article “If convicted of the felony,” to help describe the gender of the accused. Had the gender-roles been reversed it would have simply read, ‘When convicted of the felony.’ My God people, when are we going to stop making excuses for the real criminals?

It was just a joke! The guy has been in critical condition for over a month. This woman just needs to disappear, "forever". Stick this twisted freak in a dark cell and forget about her, and when she finally dies of old age looney as a bat we can all laugh and say hey what a funny joke! Maybe not as funny as sticking a wooden rod up someones backside then throughing boiling water on them, but it was pretty good.

I had a relative in the same hospital room with him and his family was very nice, his father was a Baptist minister. How well do you know him? I obviously believe without a doubt that the woman is whacko, who else could do this to a human being. Let's hope she doesn't have kids, but you know she probably does.

Bangor would do well to run a bulldozer up First Street, much as they did on Curve Street. Why is code enforcement so tolerant of the local slum lords around here?

I am terribly sorry for this guy . What a sick individual she is ! How in the heck could someone do that to someone else and say it was a joke. She is very ignorant and I hope she gets the worst !!!! She deserves serious jail time for this and someone should do the same thing to her, she deserves every bit of it !!!! But I'm sure she will get off the hook by saying she is mental !!! What exactly constitutes "Critical condition"? Can it be that this man is still very unstable and apt to die at any time? His injuries, at any rate, are appalling and this woman needs to be segregated from the general social population, whatever her mental capabilities.

What this woman did was terrible...there is no arguing that at all. The problem with this case is that there were at least two other people present while she did this. One of them at least took part in the physical assault and there is not a single mention of him being arrested or charged. The other witnessed the sexual assault and did not even attempt to stop it or even call the police to help the victim. Earlier reports stated the woman is mildly mentally retarded. If this is the case then she clearly would not have the same capacity to make rational judgements, especially with alcohol thrown in the mix. I am going to hold off on saying that this woman should be locked up and the key thrown away until I know what part in this the others played. Did anyone tell her to do this? Did the man who kicked the victim also do this before the other witness was present? Did the other people laugh and encourage her or tell her to stop? Why didn't anyone call the police to put an end to this? What is the criminal background of the other two people who were there? Why did this "disturbed" witness wait until the next day to call the police...around the same time that the victim realized he was seriously injured? My gut instinct tells me that at least one, perhaps both of the other people there played a much bigger role in this crime than is being reported. For anyone to do something SO horrible to another person, something so sadistic in front of other people then those people could not have been acting disgusted and horrified at the time. It's much more likely that they were egging her on and are trying to cover their own backs at her expense.

How drunk does someone have to be to have boiling water thrown on their back and not wake up. That's boarder line coma! This all happened at a party? Does that mean that there was more than one witness, did a group of people just stand around laughing while this happened? Maybe they should all go to jail?

Also, if anybody knows Bangor, you know that First Street is not a place you want to go to attend a party, and that booze isn't the only drug being used.

My point is that most people aren't even mentioning the fact that there were other people there who didn't even call the police, let alone try to stop her and an earlier article reported that one of them even kicked the victim repeatedly. The first story written about this incident was like Centaurmyst described. This "woman" was assaulting the victim with another man while another man witnessed what happened. The witness likely did not say anything at the time because he was afraid the same would be done to him. Either way, it would be nice to know that the other sick person is also in jail and didn't make bail.

OMG. This just makes me feel sick that someone could do this to another human being. I hope she goes to jail for the full extent of the law.

I also hope that the person that participated in it by kicking the man while he was down, and the person that witnessed it and didnt call the police have an equal charge of some sort. It is not ok to sit by and watch another be harmed and not do anything to stop it-at least leave, then call the police !!

You always hear about woman getting raped, but rarely do you hear about men. Sad thing is most men dont report it. This guy obviously had to. What a crazy woman for doing something like that to someone! I couldnt imagine even in my drunkest state. ITS SICK and she deserves 30 years!

If you search the woman's name you will find earlier articles on this assault. It was reported that the woman said "We did this to try to wake him up...it was a joke.", etc. Notice how the initial articles quote her statements as saying "WE did this." and not "I did this." Not for a New York second do I think she acted alone. I think the other person who hosted the party with her who conveniently "can't remember" due to being too drunk took an active role in what happened to the victim. Why he is not arrested too is beyond me.

they deleted my comment but i do really have concerns and would be interested in having a local loose discussion group about what's happening around us, why and what we can do (in reality) to stop it. first street is bad, slum lords and our "service city" resouces/"reputation" greatly contribute.. not to mention, what a terrible location to a have a teen shelter.. seen teens assaulting people coming from those houses

I have a brother, now in his forties who is mildly retarded. When he was a kid, because he was borderline, we fought to keep him from being labelled as retarded so he would not be an object of ridicule etc. In so doing, we did him a great disservice. We got him the very best education that was possible for him and at the time, he seemed only somewhat slower than the average kid. It is not the same once he became an adult. His development obviously only reaches to that of a 15-16 year old. I would like to say he would never do anything like this, but add alcohol, especially in significant amounts, and all bets are off. He will be a drunk 12-13 year old with impulsive behavior.

I am definitely NOT condoning this woman's behavior, but I can't pretend I don't see how it may have come about. It would have been interesting to know just how intoxicated she was at that moment and the level of intoxication of the witnesses and the mental capabilities of the witnesses. I am guessing, that sadly, they may have acted to the best of their abilities when they tried to take the victim upstairs.

As to the location, looseleaf, I would guess that these slum-like buildings you refer to are not in a high rent district. Bulldoze them and you will add to the homeless problem Bangor already has. I KNOW from first hand experience that these people are not CEO's of Fortune 500 companies!! People with these kind of mental challenges, if they can work, work at menial low paying jobs, and many don't have the ability to even fill out the forms for welfare assistance.

I guarantee a percentage of them will end up on the streets. If you force these slum-landlords to bring their buildings up to code and they do it, the costs will passed on in higher rents, which the current tenants probably cannot pay. And it the same model as removing the buildings, these people will become homeless.

I admit I do not have a solution to this problem, probably not one of us does, but it will need to be a collective effort of people who can understand the social dynamics at play here and will take the time to find the services that so many of these people will need to relocate.

As to the location of the teen shelter, yes, it's a miserable location for one, but most of those are dependent on limited resources. . .didn't our governor just call for a reduction in these kind of services??

when i question any official about how bangor can be one of the safest places to raise a family, get reconition for that in national headlines, having the problems we have, they say that that doesn't include first, second, ect. streets. it's pretty crazy, as crazy i'm sure as the council's "new vision" of the city. i'm not saying we need less services, i have spent hours on the phone tying to find people, whole families, places to stay, sometimes in the cold of night.

even an officer said we are maxed out. let's just hope this new year brings lots of compassion and ways for us to figure out how to really take care of each other. a community is only as strong as its people, and that takes everybody in it together.
