Augusta man sues retailer over alleged ethnic slurs

BANGOR, MAINE — An Iranian-born U.S. citizen who is a Seventh-day Adventist has sued Sears in federal court, alleging that his direct supervisor at the store where he worked in Augusta referred to him as a “sand [n-word]” and “the terrorist” and called his religious views “crap.”

Kaveh Khansari Nejad, 28, of Augusta filed the complaint Tuesday in U.S. District Court. He is seeking a jury trial along with back pay, compensatory and punitive damages, attorney fees and an injunction ordering Sears to require affirmative training and take other steps to ensure other Maine employees are not discriminated against in the same way he was.

A trial date has not been set.

A spokeswoman for Sears said Wednesday that the firm does not comment on pending litigation.

“Sears has just got its head in the sand [about this incident],” Khansari’s attorney, David Webbert of Augusta, said Wednesday. “What is their excuse for not taking any action after this was reported? I can’t think of one.”

The Maine Human Rights Commission found in June that there were reasonable grounds to believe that Khansari had been discriminated against on the basis of religion, race, color, national origin and ancestry, according to the lawsuit. The commission issued a right-to-sue letter in August after its efforts to reach a settlement with the Chicago-based retailer were unsuccessful.

Khansari became a permanent resident of the U.S. in 1997 and a citizen on Oct. 10, 2008. He worked from September 2005 through January 2008 as an assistant store manager in the home improvement department of the Sears store in Augusta.

He also is a devout follower of the Seventh-day Adventist denomination, which requires he perform no work from sundown Friday to sundown Saturday. When he was interviewed and hired for his job, the then-store manager told him that the company would accommodate his religious beliefs, according to the lawsuit. Khansari worked every Sunday, according to the lawsuit.

Less than a month after he began working at the store, the manager who had hired him moved to a different location and Theresa Zardus became the new store manager and his direct supervisor. She allegedly unfairly denied him pay raises, promotions, access to training opportunities and allegedly forced him to perform duties that caused him to reinjure his back.

Khansari and other store employees complained about how Zardus treated him via a hot line designed for reporting suspected discrimination against employees, according to the lawsuit. The suit alleges that Sears did not take them seriously and did not properly investigate them.

Webbert speculated Wednesday that one of the things that might have contributed to the alleged discrimination against his client was the fact that he practiced a religious denomination not normally associated with his Middle Eastern origins.

I do not agree with the way he was treated but what I do agree with is that he should not expect to be able to have off certain days for religious reasons. Different jobs have different hours, being retail expected to work week-ends and nights. A 7x24 work schedule being all different shifts. It is not fair to the other workers that they would have to work the schedule all the time they he could not because of his religion. We all have reasons not

to work at certain times but if you take a job that may be in conflict with your personal life you should not EXPECT your peers to have to adjust there schedule for your home life. People that have these restrictions as far as home or religion should seek jobs that the hours give you the ability to do these things....

Most places that you work for you atleast have to be there 3 to 6 months to get benefits, is there a certain time frame on becoming a US Citizen and suing the company that that you work for? I bet there is someone who was born in this country that would love to have the job at sears. Sounds like the guy is looking for some money so he doesn't have to work, he'll probably cut and run back to Iran.

He along with everyone else has the right to be employed with out verbal or physical abuse and insult. Sears should have taken action to theese allegations. When he was hired he was given the time off he requested. most jobs i apply to they ask you if there are certain days that you want to request off. and if they can accomadate they do.He is an American citizen it shouldn't matter by which way he got here. most of us are here by our ancesters from other countries. Maybe he felt the need to take the step to establish citizenship because of how he was being treated in his job that he had help for many years. Regardless, no one had the right to speak to or continue to harass him. MurphyL why would he "cut and run back to Iran" after he took the time and effort to become a citizen. There are many businesses that accommodate religion and many I've worked with that follow their religion and days/holidays that pertain to it. The issue here is the fact that he has worked for a company that has allowed him to continue to be treated unfairly and be harassed. Other employees saw a problem with the way he was being treated as well and complained. So, again if you read the article, he wasn't the only one to have a problem with this or complain. The real problem here is it was allowed to continue.

And you believe everything this guy is saying is the truth. Although I am not a fan of 'SEARS', there are two sides to this story. This isn't the first time a disgruntled employee has cried discrimination.

People - Just because a lawsuit filed says something, does not mean it is what really happened!!! It cracks me up when people believe everything they see in writing. I could file a lawsuit againsts my neighbor saying they yell racial slurs to me everytime they see me, this does not mean it is true. You are acting like some of the uneducated extremists, believe what is read to them, because they cannot read or think for themselves. I think you need to let this play out in court to see what really went on.

I've seen the same type promise made and then broken in other retailers. The only way you can get a promise like that and expect to have it kept when the management team above you changes is to have that promise in writing in your personnel file. Even then, the store manager can say "reasonable" accomodation and expect you to work part of the day you expect off. The days of accomodation for religion or religious beliefs left us when the so-called "Blue" laws were repealed or relaxed to allow retailers to be open on Sunday.

Retail is not a place to work and expect accomodations for anything. Especially in today's economy. The retailers we all shop at are feeling the pinch just as bad as we are as individuals. They are all becoming less and less accomodating and more and more demanding of "returns on investment" from their employees. The news is full of the decline in retail due to the economy and the retailers are all being impacted. Even so, that does not excuse the names this store manager allegedly called her subordinate. Professionalism in managers should increase in these hard times, not decline along with the economy.

Movethen, you need to have a case before a lawyer will take it, then won't take it on if they don't think they can win it, it's not worth their time. This means there are witnesses and evidence. Obviously the lawyer and the plaintiff believes it's the truth.

Nice to know I live around a bunch of racists. The point here is that he was being discriminated against in the work place. If this was a woman who had a boss telling her that she had a nice ass and making sexual advances, then you would be all for her suing sears. If you can't believe him and you can't believe Sears, how about the other employees who witnessed it. Everyone has worked for an office manager who should not be an office manager. Some people should not be given power. And is doesn't take much to get that position. I hope he wins.

This guy was discriminated badly, and has every right to sue.

Sears should have investagated the claims and if found to be true should have fired the new manager. This article doesn't seem to say that they made him work from friday night through saturday night. Just every sunday. What did this guy want a 3 day weekend every week. As for as him getting verbaly abused NO employee should be treated that way. WOW I guess Maine is no longer a friendly state. Too many people think it is fine for an employer to treat their employees like garbage and call them names. What an evil world we have become. As far as the work schedule, they have six other days to schedule him. It shouldn't be that big a deal if he takes the Sabbath off. He was probably their most honest employee. While not condoning racial slurs, why is "crap" considered a slur? It was his opinion of a religion;much the same as someome's opinion might be of a certain political party platform but no one calls that a slur . I was watching television a few nights ago and the performer was referred to as a "cracker";that said, it also may be important to note that it was a comedy show. And recall the ads for the DVDs of the Dean Martin Comedy Roasts: Redd Foxx announced he was up on the stage with "some heavy weight honkies", refering to Jackie Gleason and Orsen Welles. Everybody laughed;nobody was offended. I'm sure that Mr.Nejad would not have been offended at that 'slur' on Gleason and Foxx either. I think we have to be very careful here. It seems that we are becoming much too defensive about some things that are spoken. Bad taste does not always mean unacceptable language. Every time a 'slur' is removed from usage, a once less-offensive word becomes the new slur. After a few generations we'll be down to talking like Dick and Jane in the kindergarden books.

Just out of curiosity, may I ask those of you who advocate going to Iraq as some sort of bizarre qualification for citizenship a question? Have you served? And if you are not too old or have some reason you cannot serve, why are you not volunteering? I am a woman and served my country in the Army for five years and I was willing to fight to preserve the fundamental human rights upon which this country was formed, the most vital of which are the right to freely practice one's religion, the right to fair and equal treatment regardless of one's race, gender, or national or ethnic origin, and the right to exist free of persecution from others. Perhaps you would prefer to live in a society where these rights are denied and selective groups of people are the targets of insults, hate and violence? Would that be OK with you so long as you were part of the group doing the persecuting? Of course, it wouldn't be America. The best way to serve your country is to serve its ideals and dedicate yourself to the preservation of those ideals in American society, and the best way to do that is to live your life in a manner that reflects those ideals. If you are not willing to do that, then perhaps you do not understand what this country is all about. A court will decide whether or not this gentleman has a viable complaint. That is how our system works. If his complaint is justified, then we, as Americans, can feel proud that a fellow citizen is able to seek justice in a system based upon the equality of all.

I have lived in a number of different sates and traveled extensively world-wide. The response from some of the writers here is not unusual. Unfortunately, some find it hard to believe that the refugee of today is the same as the refugee of your ancestors. Because unless you are one hundred percent Native American - you are a refugee. Our ancestors came here to escape religion, social, and economic persecution - the same reason's Mr. Khansari is here.

As Mrs. Khansari stated, this suit has been going on for years. The Maine Human Rights Commission and Mr. Khansari's lawyer have investigated and found the suit worthy. A judge has reviewed the evidence and found the case worthy. The Bangor Daily News reported the evidence, but does not litigate the outcome. And the readers and writers here cannot litigate the outcome either.

Regarding Mr. Khansari's work schedule - it is irrelevant. He work the shift he was given. The denial of merit pay raises and respect that is afforded all employees is a question for the court.

Prejudice is just another word for ignorance. Walk in Mr. Khansari's shoes before you judge him. As Americans we have rights - Mr. Khansari is an American. Once both sides of this event is told in court, another American will render a decision. Until then, we are but attendance in the gallery of a great American tradition - justice.

did the article say anything about the manager being fired for this.

i think sears could of accomodated him for his work schedule request being a big chain retail store that they are. i think it was the manager's job to try to accomodate his needs and if she would of made an effort and kept her mouth shut. he would be sueing!

Probably somebody should sue Sears every day, they have caused enough grief for a lot of people. This man was treated unfairly, Sears didn't comply with the law, they should be sued. Nowhere here does it state that the taxpayers have to pay for anything connected with this case, he is paying his lawyer. I hope he wins a bundle!

I also cannot believe the level of meanness in some of the comments posted regarding this article. I thought we were a better, kinder state than that. My only complaint about the article is that it should have mentioned when these problems occured and how long it has taken to get the case to this point. I think the writer of this article could have done a bit more 'background' to clarify those points. Perhaps that would have made for fewer negative comments. I sincerely hope this family will have a successful outcome and I want them to know not all of us in Maine are as ignorant as some of the posters seem to be.

None of us knows what pain and suffering this has caused your family. I'll bet 99% of those who have posted negative remarks would just have quit and left the supervisor to continue her racist views and comments. For Sears not to respond is criminal and they should be made to pay for it. None of us have walked in your husbands shoes and shouldn't judge his right to seek justice. Believe me, not all of us Mainers are so quick to judge negatively. May God bless you and your family. Good luck with the lawsuit. As a rule, I oppose lawsuits and feeding lawyers. Racial bigotry, religious and nationality discrimination should not be tolerated. Even for a moment. Even tounge in cheek comments. Ever. Period. If it takes a lawsuit to make the point, So be it.

Kudos to my beautiful granddaughter in standing up for her husband in this matter. I could not have said it better myself! Anyone one who knows this precious family, knows the outstanding character that this young man displays, even in the face of such blatant prejudice! This case is backed with allegations made by employees and filed with Sears before there was ever a suit. Not to mention that this never would have won at the Maine human rights commission 3 to 0 if there was any evidence otherwise. The facts are right there. First of all this is ALLEGED that the remarks were made... and I don' care about the background of the person sueing... It puts a bad taste in my mouth that we have become such a sue happy society. Me personally, I would have found other employment. Yes the slurrs are wrong, but why continue to put yourself through it? Some asses always are assess no matter what. truthpays, I have been through a similar situation and I wish you and your husband the best of luck. Here are some tips just in case luck is not on your side. Most likely you have an excellent lawyer but it doesn't hurt to do some research on your own. Providing as much information to him as possible can really help your case, plus watching bigots squirm on the witness stand is a singular pleasure. Remember, liars will always contradict their own stories. It's easy to remember an event that really happened, but much harder to remember the details of a lie. I'd like to apologize for the ignorant racists who've posted here. Reading their comments is really a waste of time, actually there aren't that many of them left but they are rather noisy. I'd like to think that someday our educational system will be effective enough so that everyone who graduates from high school will know the difference between right and wrong. Just know that the majority of Mainers do not share others racist views. Remember, many people hang onto their ignorance because they fear change and the unknown. I cant believe that there are so many people responding against the guy who had his rights violated. The words that were spoken to him are unacceptable in the work place or anywhere else for that matter. Anybody that uses words like that in respect to another, or anybody that thinks it's ok need not be in management positions. Sears should be embarrassed and the manager should be shamed into Dickenson-esque hiding.

No, it's not cultural perspective, it's cultural fact that there are certain groups who are discriminated against for their race, religion, gender, and sexual preference. But as I said before, those laws protect everyone, even white Christian males. And by the way, name-calling isn't illegal. As long as the other person can't prove they are somehow monetarily damaged by it (slander), you can call someone any name you want and you're protected by the First Amendment. But that doesn't mean that you won't be called on the carpet for it.

Do people even realize that Mr. Nejad will be considered a traitor in his home country because he became an American citizen? I am Native American, so are you. We were born here. If Obama is African-American that means he was born there. If he was born in America then he is just American like the rest of us mutts.
