Woman, 31, gets 30 days in child sex abuse case

MACHIAS — A former teacher at a Lubec elementary school was sentenced Friday in Washington County Superior Court to 30 days in jail for having a sexual relationship with a 13-year-old boy.

Tina Mason, 31, of East Machias cried and sniffled in the courtroom as she pleaded no contest to charges of assault, sexual abuse of a minor and unlawful sexual touching. The victim, who is now 15 years old, showed no emotion while he sat on the other side of the courtroom with his family.

Mason sought to avoid serving time behind bars, but Justice Kevin Cuddy agreed with the prosecution’s recommended sentence of 30 days in jail for Mason, who is married and has two young children.

“There is nothing I can say that will make this situation any better,” Mason tearfully told the judge. “Please think of my own children. Who will protect them if I’m not there?”

Mason’s husband, mother-in-law and sister-in-law sat in the courtroom opposite the victim and his family as Mason spoke.

According to Paul Cavanaugh, assistant district attorney for Washington County, the victim did not attend Lubec Consolidated School where Mason taught. Mason, her husband and their two boys, ages 6 and 10 years old, were friends with the victim’s family, who also live in East Machias. The victim’s family knew the Masons socially because his two younger siblings are the approximate ages as Mason’s sons, Cavanaugh said.

The victim’s mother addressed the court, criticizing her former friend for taking her son’s innocence.

The Bangor Daily News typically does not identify the victims of sex crimes.

“You have taken something from my son that no one should ever take,” the mother said. “You have no remorse. Shame on you. You are getting off easy.”

After the proceeding, the victim’s mother said her son and family are ready to try to put the incident behind them.

“I’m happy it’s over,” she said of the legal wrangling over Mason’s fate. “We want to move on.”

After the sentencing, Mason’s family left through a rear door of the courtroom as Mason was taken to jail to begin serving her sentence. Mason’s attorney, Sandra Collier of Ellsworth, declined to comment on the case.

According to Cavanaugh, the illicit relationship between Mason and the boy began sometime in June or July of 2007 and ended a few months later in September 2007.

After the court proceeding, Cavanaugh said Mason resigned her teaching position at the Lubec school last December after the incident came to light. Lubec school officials had concerns about a possible inappropriate relationship between Mason and one of her students, which proved to be unfounded, but contacted police when their investigation revealed the relationship between Mason and the East Machias boy, he said.

With the conviction, Mason will have to give up her teaching certification permanently and will be a registered sex offender for 10 years, Cavanaugh said. He said the initial allegations in the case were that Mason had intercourse with the boy, but that the misdemeanor crimes to which she pleaded no contest on Friday amount to lesser sexual contact.

In addition to the 30 days in jail, Mason received two consecutive suspended sentences of 11 months in jail, each with one year of probation. If Mason violates the terms of her probation after her release, she could end up serving 22 months of additional jail time. She also was ordered to pay a $400 fine.

Cavanaugh said he was “satisfied” that Cuddy agreed with the state’s recommended sentence of 30 days. He said there was no physical evidence in the case, and that if the case had gone to trial it likely would have taken a couple more years before it would have been resolved.

“Hopefully, this can move both [of the families] forward,” the prosecutor said.

Cuddy indicated during the sentencing, however, that regardless of how Mason and the victim go on to live their separate lives, they each will never fully be rid of what happened.

“The reality is these events are never going away,” the judge said.

How sick!! This is also a slap on the hand!! OMG she has kids this age herself and would probably want anyone fried who did this to her own. I can't believe they didn't give her more time in jail plus mandatory counseling.

It is obvious from the length of the sentence and the amount of the fine which gender committed this crime. No other information about gender is required in the article as judges and society truly will not punish females for their crimes, no matter how heinous they may be.

When she asked the judge to "think of her own children" He should have, and added 10 more years to her sentence. If she would do it to a friends kid what is stopping her from doing it to her own. These stories make me sick.

Okay, I am confused! A 31 year old woman has some form of sex with a 13 year old and gets 30 days. This isn't even a case of a teenager near the age of consent yet a merchant sells a gun to a legal buyer knowing that he probably is going to give it to someone else and he gets a year? I completely agree that the other people that actually sold guns to Canadians illegally should serve time but the merchant can't control what happens to a gun after it leaves his store. He should have refused the sale when he heard what was intended and he should have reported the unusual sales like the Machias merchant did but that should be a loss of license and no more gun sales from his store not personal jail time! This woman that had sex with a 13 year old took something from a developing human being that will change his life forever. What effect that will have on him won't be known for years it could be very bad with severe impact or it could be fairly minor but it WILL change his life forever! Registration as a sex offender for 10 years? What happened to the rest of her life like men? There have been cases of two teenagers having consentual sex and the guy (who wasn't 18 yet) ends up with the sex offender tag for the rest of his life. Why wouldn't a woman who is 31 get the same punishment? Crime and Punishment is getting to be a joke and in the case of sexual issues very sexist! This woman may not realize it but her own children are victims just as much as the boy she abused. 30 days and a 10 year sex offender status is a joke!

So disturbing that she only got 30 days in jail! People are jailed longer than that for drug offenses, even when the only victim was themselves! I think if it were a male teacher and a female student, he would received more jail time! SICK!

JeffDubay is totally correct. It is blatant sexism. We have so much latent sexism in this country is is amazing! Some might call this counter-sexism or sexism against men (double standard). Just the other day there was quite a debate on this site regarding the pregnant woman whom was assaulted. Just from the responses on their you hear the sexist ideals that people hold. To Catch a Predator etc have demonized so many men etc. Long before that though we have been a very sexist nation. Yes we have many things that put down and demean women, but take a look next time you are watching tv or hanging out with a family. The sexism is rampant and accepted. In 20- 30 years we will look back and say "what were we thinking?". This is no shocker. The double standards the female sexist paradigm is unreal. Everything from holding the door to assault to punishments. A female can drink and drive and be responsible for an OUI but that same female can jump in to be in that state and the man is accountable. Maine is even worse than most places. It is like a double sexism, a lot of people in this state do think men are better but at the same time do lots of things against men, like this moronic judge!

What is odd is that so many women want more "rights" and more "equality". I think they would be shocked to learn that they would have to lose there current "rights" just to become equal.

Could the difference in punishments be that in the case of the adult male and the underage girl, the perception is that some degree of force or coercion would likely be involved, whereas in the situation with the adult woman and the underage boy, there is a likelihood of the absence of force or coercion, in fact, being somewhat realistic about the male psyche, though 13 is maybe borderline, the boy could possibly be saying "More, more, more!!"

Shame on men for not calling the police when they are assaulted, molested or otherwise. The under reporting or absence of reporting or coming forward of/with men's stories needs to happen to not only wake up the public but to reverse the standard and put more women/offenders in jail. People often call me a sexist just for the things I have echoed in these last few paragraphs. That is how sad it is now, even you even acknowledge the inequalities that effect men then many think you are a sexist!! How sad it is. And many men don't agree until it happens to them or someone they know. Wake up people.

The justice system here in Washington County is crooked. If you get a appointed lawyer by the court look out you'll be screwed. They DA will tell the cops to lie just to get a conviction. There is predigest in the system. They set you up to take a fall here. My question is why don't they clean up the justice system around here, cause that is where is starts. It depends on who you are and how your last name is spelled. I have been in the courtroom and I have seen it and heard it. And shame on this judge. This women should have counceling and shouldn't be allowed to be around her own son. Who knows like what someone else said, What won't make it to it to her son. Beleive me I will be looking on the sex offenders list and see who she is. It should have been rape. It makes me sick to see how unfair the justice system is. I agree this type of thing should be punished to the full extent. But, read the article, her no contest plea was to lesser charges than what she actually did. The prosecuter asked for 30 days, the judge has guidlines he has to stay within. Why are we so quick to jump on the judge, why did the state only ask for 30. Probably because the was part of the plea deal with her. Read the article, proof would have been difficult and it would have taken a couple of years. How is the Judge at fault here ???? I have noticed many people read these articles and want to behead everyone involved without either really reading the article thoroughly, or thinking the article is telling evererything in the the case, NOT. If someone pleads guilty to manslaughter, you cannot give them the sentence of Murder! I am not talking about this case, but some cases people that are innocent plead out, if you cannot think of the reasons for this, please don't ask. It is so easy to be judge and jury when you don't have to abide by the rules of the law.

It's plain to see by the comments posted here that you are all concerned about what you have read. I would be true if it were true. But it's not. I'm disgusted with this newspaper for printing an article that is so one sided. None of you know this woman or the situation. The so called "victims" of this so called "sex abuse" case are deeply troubled. You would know that if you knew them. This is not the first and will certainly not be the last time that something like this happens and they are invovled in it. I know the woman who was accussed. I've known her all my life. She is an amazing woman with a kind heart. Her kind heart got her in a big mess. It's sad how that happens to the good people in this world while the truly guilty are still running free. I pray that the truth about all this will come out soon. That her good name will be restored and that you will all realize the not everything that you read in newspapers is true.

actually I know her as well, and it is true. I know for a fact it is, so rainne maybe you need to get all your facts straight? She was a horrible teacher who had kids spy for the principal so she wouldn't get caught not doing shit, she flirted with students, and talked to jr. high kids like she was one of them instead of their teacher, anyone with a myspace a couple of years ago would know this, she bought alcohol and cigerettes for students, and pretty much did inappropriate things all the time

I don't care who knows this woman or even if she is a good person (actions speak louder than words). She molested this boy and violated an important boundary: 13 year old kids should be able to go to school and learn without having to wonder whether or not their creepy teacher is sexually attracted to them. When I was 13 years old, I would have loved some lovin' from my hot 30-something teacher. I bet that boy had a smile on his face during and long after the encounter -- until the assorted handwringers and Ned Flanders types convinced him that something terribly dirty had taken place, and that only the police and the court could cleanse him. David889327, I haven't weighed in because I'm in agreement with everyone here for the most part. All I can add is that she must have had a darn good attorney.

I may just be one voice in the crowd of many, but as Governor of Maine I would send convicted child sex offenders to jail for life and/or have them put to death just like people who murder people. Doing disgusting things to a child takes away their innocence and its wrong. Sickos should be put away for ever.

bthanson - What I said was the judge may have been bound by rules put in place. You cannot give a person more jail time than what his boundaries allow. If you remember, the punishment must fit the crime. The crime is what she plead to, not what anyone presumes she did or did not do. Again, she made a deal with the prosecution, just maybe, if not all agreed to the deal, she would not have made it. Read the article, the prosecution says there is NO physical evidence, and a trial would have been a couple of years away, and then there is the possibility she could have been found not guilty.

Why all the armchair quarterbacks? Just speculation here, what if the prosecution and defense knew there were some history in this childs family that would have been brought out and would not have been received well by the jury? NO PHYSICAL EVIDENCE, the prosecution may know this case could have ended up in a Not Guilty verdict, the school teachers family did not want to spend all there money on lawyers, there are many reasons in this country for plea deals.

A judge has to hand a sentence out on what the defendant was found guilty of, or to what she plead to. Yes they look at mitigating circumstances, maybe there were some here that helped her out. Why don't you ask the judge.

I just love how some come out here and just blast their gossip; here's a question, if this woman was always flirting with the kids in her classes, why did none of you step up and go to the school and file a complaint? Why did none of you confront her? Or go to the authorities? Oh wait, is that because there is no truth to your so called gossip. Or that you did not really witness any of this first hand? Wait, maybe she scared you - was that it? All that is written in these comments are not "facts" - they are just ideal minds with nothing better to do. Now I am no condoning anything - I just realize that I do not know any of the facts in the case and neither do any of you. Unless some of you that really think you know the facts can answer, why did you not do something before it went this far?

PGOME1 maybe you should go to the second article and read . Sounds like other children are talking but never came forward. Maybe after the DHS court in Calais and the victim had to endure 45 minutes of explisive testomony that was enough for him and his family. She was guilty at that one and lost custody of her children but continued living with them and her husband. I am sure there is many emoitions going in the community on this subject. So you condon her and the likes of her, but you should take a few minutes and reflex if this was your child how would you be feeling. I cringe to think my child goes to Elm Street and she has had free range at school even after losing her kids to the State of Maine. So as she has done best snub authority.

What irriates me is the adults in this community who NOW come forward to make accusations of past situations - if there is so many other stories and situations of this happening, why was some thing not done before. Was there any complaints filed on this teacher @ her school on this "supposed" behavior? If not, why. I am not talking about the kids - I am talking about all the adults that are now say "I knew it, I knew it" . Yes, gossip happens - I get it - and to every story, there usually is a reason for it - so again, I ask, if a lot of adults questioned this - did they just not question it to the right people or was they ignored?

In the vast majority of male child abuse cases I read about, the man is registered on the sex offender list, loses any professional chance of ever having a self-respectable job again, and goes to jail until his beard reaches his beer gut.

Although on the other hand, there was another article I read today about a women that had to move out of her compartment complex on Thanksgiving because of oral sex she had with one of the other residents 12 years ago (when she was 17/he was 17). So I guess this street goes both ways, the woman in this article probably slept with the judge =\
