Whiting guilty in federal gun case

BANGOR, Maine — A federal jury Wednesday deliberated for three hours before finding a Whiting man guilty of being a felon in possession of a firearm.

Mark McCurdy, 51, according to court documents, was found to have a rifle when Washington County sheriff’s deputies responded to a domestic violence complaint on March 27, 2006.

McCurdy was prevented from possessing guns because he had been convicted in state court of robbery in 1983.

He was indicted on the charge by a federal grand jury in November 2006 and pleaded guilty to it the next October. In an unusual procedural move, U.S. District Court Judge John Woodcock, who presided over McCurdy’s three-day trial, allowed him to withdraw his guilty plea after his entire criminal history was learned.

In May, the judge ruled that when McCurdy entered his guilty plea he believed that he would face a maximum of 10 years in federal prison. After the extent of McCurdy’s criminal history was learned, he faced a minimum of 15 years and a maximum sentence of life — the same sentence he faces now that a jury has found him guilty.

A sentencing date has not been set.

McCurdy remains free on $10,000 bail but is under house arrest unless he is working.

A friend of mine was there throughout this sorry episode. There wasn't any assault - there was an argument and this guys "girlfriend" - who is a convicted felon herself and is a notoriously mentally unstable and diagnosed n*t case - called the police and told them that McCurdy had a gun stored in his house, as a means of revenge because he told her he was breaking up with her because she was drunk all the time. She knew it was illegal for him to have a gun and out of spite from being spurned, she exercised her recourse.

The gun was never used in an assault or anything else. He was stupid to have the gun but he didn't do anything wrong. This so-called law is a s8ch-a$$ law developed by Southerners to keep blacks in the pen, when all else failed. Many times in the south a gun is planted by the bigot police and the black goes to jail. This is one sick law. If he'd scr*wed a five year old girl or boy, or shot and killed this girlfriend, he'd be facing a few months or a couple of years in jail under the Maine Injustice System.

Maine and the federal court system are a complete INJUSTICE. I was going to say they are a joke - but it isn't funny when someone faces a long time in jail for doing nothing that endangers or harms anyone else.

Be careful what you do when you're young and foolish. It always comes back to haunt you 25 years later ---or put you in jail forever.

I had to read this article 4 times to try to make sense of it all. He certainly was stupid to have the gun, more stupid to have that girlfriend .

It sucks to be him,weve all had unstable,chemically imbalanced women in our lives,they can ruin your life when you try to leave/dump them,all b@tches are crazy if they dont get what they want when they want it.

this guy broke into my grandfathers home, he is just one bad egg that needs to be put away.

augustagoverened: i'd tell your friend to stay away from mark mccurdy because not only is he abusive, but he is also a notorious drug addict and the friends he keeps are more than sketchy. i would fear for anyone in his presence, friend or foe. if i ever met him on the side of the road, i quite honestly would have to do my best to steer clear from plowing him over, putting the truck in reverse, and doing it again.

All very interesting posts. I think the law is foolish. Some states allow waivers for firearms possession by a felon if they've been clean for 5 years. If the firearm wasn't used in a crime then it shouldn't matter.

He is in fact from downeast. As far as him possessing the rifle, I'm sure he knew it was illegal. If you do the crime, you should do the the time. My

question is "did he in fact have a rifle in his possession"? If he did and he is a convicted felon, then he needs to do his time!

.Silverado, can you answer a question for me. dose possesion mean having a gun in the home or on their person? Does it mean that no one living in that home can own a gun if a convicted felon lives there to? Just wondering.

'pearyb' --- For the good [or the bad ] -- the 'absolute' element of the 2nd Amendment will be tested someday when someone with $ 'happens' to have a gun in the vicinity and is a white collar felon - . It seems to me that having a firearm in the area V. used in the commission of a crime is just another 'nail' the State can use at their digression;

Do you guys not realize that this article is about old Mark and all the comments being posted about all the bad things that were done are about little Mark??

Sounds like his girl friend and her relatives are running this guy down on this post. Nothing like kicking him when he's down and you're anonymous, huh? Anyway, it's a damned dumb law and it gets applied in an uneven discriminatory manner. Good guy? Bad Guy? DUMB LAW!!!!!

A person can do one horrid thing and spend the rest of his life doing good. The bad always comes back to haunt you. People will remember it, you can't live it down, the law will apply forever. These people need to leave the area where they committed the crime, stay away from crazy so-called girlfriends that will get revenge one way or another and they have to try to get the charges dropped after 25 years. I don't know if this man has had any further crimes since the 1983 robbery, but if he hasn't this doesn't seem right.

People who don't know what they are talking about really should keep their mouths shut. I have been with Mark McCurdy for going on 3 years and none of you know him like I do. The comment "you don't know someone until you live with them" is correct. He is by no means abusive,crazy or addicted to anything. Like I said you all do not know him. He has had nothing but love for me this whole time. I worked on his case with him hand in hand. He did get railroaded. I have written lettters to the editors of many newspapers so you may want to keep an eye on those. I will say that in my letters everything is correct. I also have proof not hearsay or gossip to back this up. Judge John Woodcock and AUSA Joel Casey allowed two men, Stephen Jon Cheney and ex-deputy John Rolfe to me caught lying under oath on the stand and decided to overlook it and let their testimonies to stand and proceeded with the trial. Stephen Cheney was also caught ON TAPE trying to get Mark to buy his testimony. In court they tried to say it was about Christmas presents? When you have Cheney asking if they had a deal and Mark replying The Truth Doesn't Change and You Can't play both sides of the fence.......does that sound like anything to do with Christmas or presents????NOT!!!!!!! Anyway, I just wanted to set a couple things straight. Mark is a wonderful man and I am lucky to have him.

He was railroaded???? Is he not a felon? Is he not forbiden from owning a firearm? Was he not in possession of a firearm? Wonderful man? NO

hes a felon who has broken the law agian and he's getting railroaded right where he belongs! amandajo needs a reality pill ! The facts speak for them self. I dont need to know him !

Women can have sex with minors and get 30 days, men can rape and get 10 years, repeat offenders can kill while behind the wheel and get a slap on the wrist...yet a man living his life, trying to keep his past his past can get convicted to 15 years for posessing a gun? Yes Mark did have a criminal record and yes Mark is a recovering addict, but 15 years? Has the state of Maine and Washington County not learned that if you throw a man with Marks background in jail they all to often come out bitter and frustrated, broke and not able to find work...our system creates better criminals and contributes to the rampant drug abuse. Men and women go into the system with addictions and a lot of the time other mental health diagnosis that compound thier problem, yet they get put on medications that only sedate them, and some come in with previous psych evaluations and get nothing. And where is the counseling? You mean I have to be in the system for a certain length of time before I can get some real help? I know the state is broke and we have to work with what we are given, but I wonder if the money spent at Washington County Jail on the new exercise equipment for the guards could have been spent on helping the inmates? Born and raised in Washington County I feel it is sure as hell not my problem the guards have weight problems, I would rather be helping the inmates not become frequent flyers so to speak. I fully agree with Hillary Rodham Clinton, it takes a village to raise the child.
