Two bills compete to define marriage

AUGUSTA, Maine — A freshman Republican legislator is offering an alternative to the same-sex marriage bill a veteran Democratic senator is sponsoring.

The bill, submitted Thursday by Rep. Leslie Fossel, R-Alna, would extend to couples on Maine’s Domestic Partner Registry the same legal rights and benefits as married couples, according to a press release issued Friday by the House Republican Office.

A bill that would have called for a constitutional amendment to ban gay marriage was expected to be submitted by House Minority Leader Joshua Tardy R-Newport, The Associated Press reported earlier this week. But it had not been submitted by 4:30 p.m. Friday, according to the Legislature’s Revisor of Statutes Office.

Friday was the last day that bill titles could be submitted to the office, where the official language of legislation is developed. Bills submitted after Friday would be considered only if approved by the legislative leadership.

Efforts Friday night to reach Tardy were unsuccessful. His spokesman, Jay Finegan, said earlier in the day that Tardy would not comment on an amendment to ban gay marriage.

In the press release announcing Fossel’s legislation, he said that “currently, there are legal and technical differences that create disadvantages for many Maine families. My bill aims to remove these differences from Maine law.”

Fossel believes, according to the press release, that all couples, whether married or not, deserve equal treatment in the eyes of the law.

He also predicted that the same-sex marriage proposal introduced earlier this week by Sen. Dennis S. Damon, D-Trenton, would “engender an emotional debate in the Legislature and, if passed, would face a people’s veto initiative.”

“We don’t need a hot, divisive debate with siege guns,” Fossel said. “Democracy is all about finding a middle ground. This bill might not be perfect for everyone, but it is the only bill with a chance of succeeding without immediately triggering a referendum to repeal. I suggest we’re far better off with an equitable solution than with animosity and division.”

It was unclear Friday whether the bill, titled An Act to Expand Rights for Maine Families, would create civil unions or repeal the state’s Defense of Marriage Act, which defines marriage as between a man and a women.

At a press conference Tuesday in the State House, Damon announced that he was submitting legislation to repeal the Defense of Marriage Act. His proposed bill, which also has not been drafted, would include language to allow “two persons to marry.”

Supporters and opponents of same-sex marriage said Friday they would oppose Fossel’s bill. Members of the Maine Freedom to Marry Coalition, which appeared with Damon at his press conference, said it did not go far enough. Representatives of the Maine Marriage Alliance, a group that supports traditional marriage and op-poses same-sex marriage, said it went too far.

“Separate is not equal,” Shenna Bellows, executive director of the Maine Civil Liberties Union, that supports Damon’s bill, said Friday of Fossel’s proposal. “It’s important that we honor gay and lesbian couples with the dignity and respect that marriage brings as well as the legal rights and protections marriage offers.

“We are heartened that Rep. Fossel recognizes how important these benefits are,” she continued. “We hope, however, that he will want to work with us. History teaches us that creating separate institutions for minority groups is still discrimination.”

Mary L. Bonauto, civil rights project director for Gay and Lesbian Advocates and Defenders, also said Friday that Fossel’s bill was not a substitute for marriage but recognized that such an offering by Republicans was unexpected.

“It’s extremely encouraging that both sides of the aisle recognize that it is no longer acceptable to deny legal rights and protections to gay and lesbian families in Maine,” she said. “In the legal arena, the rights of domestic partners is extraordinarily limited and does not offer all the protections a spouse gets.”

A proponent of traditional marriage, the Rev. Bob Emrich of the Maine Marriage Alliance, said Friday that he did not expect his group would support Fossel’s bill and did not think it would dampen the debate around the issue. He also said he was disappointed that a marriage amendment will not be considered this session.

“If Rep. Fossel thinks this is not going to be contentious or divisive, he has not been paying attention,” said Emrich, of Palmyra. “He doesn’t understand what is going on in Maine.”

Emrich also thanked Tardy for giving serious consideration to sponsoring a bill calling for a constitutional amendment.

“We’re disappointed that we don’t have a bill in,” he said. “We would like to have that debate and would really like for the people of Maine to have a chance to vote on that. Instead of dealing with the heart of the issue, which is marriage, we’re nibbling at it around the edges.

Efforts to reach Marc Mutty, director of the Office of Public Policy for the Roman Catholic Diocese of Portland, for comment on Fossel’s bill were unsuccessful Friday. He has said in the past that the diocese would support extending some additional legal benefits to domestic partners. After Damon’s press conference, he said the diocese would oppose efforts to allow same-sex marriage and civil unions.

Michael Heath, head of the Maine Family Policy Council, formerly the Christian Civic League of Maine, said Friday that his group most likely would oppose Fossel’s bill but he wanted to see the language before making a definite decision.

He said Tuesday that his group would oppose Damon’s bill.

Gov. John Baldacci, through his spokesman, declined to comment on both bills until they have been drafted.

Under Maine’s Domestic Partner Registry, registered partners are accorded a legal status similar to that of a married person with respect to matters of probate, guardianships, protection from abuse and related matters. The registry is housed within the Office of Health Data and Program Management in the Bureau of Health of the Department of Health and Human Services.

Both Fossel’s and Damon’s bills will be referred to the Judiciary Committee.

Mainelyme, that's pretty harsh. I see your comments on BDN a lot on here and most of the time they are pretty intolerant. How do you expect people to listen if you don't? Both sides are talking....it's a start. Give credit where credit is due.

I'm guessing that if the legislature passes same sex marriage it will be crushed by a peoples' veto. If same sex marriage didn't survive in California, I doubt it will in Maine.

why not just bend the two "Bills" over and give them a shot at each other! haha

What difference does it make to you or to anyone who is allowed to be married? If you have a gay or lesbian couple living down the street from you and they are married, how will it effect your daily life? It wont? So why should it matter? Why should they not be allowed to have the same rights that everyone else has?

The day they can consumate the marrage and bear children naturally then let them gat married.

I can't bear a child so I guess my husband and I should have our marriage annulled....we still love each other and will just have to live in sin....the I'll loose the right to visit him if he's sick or have any say over his care....I won't have a right to his SS if he dies...so I'd loose the home that we have built together...and if I were to sell said home his kids would get the money.....does any of this sound fair?....it's not.....this about civil rights...and fact no one that lives together with out marriage had any of the these rights...be they gay or straight...the time has come to stop trying run other peoples lives...

There isn't even any reason to discuss anyone else's human rights. They should just be given.

A "people's veto" has no authority over a religious or constitutional issue. If it's determined to be unconstitutional for gays to be prevented from marrying, then they'll be able to marry. Sorry haters, the Constitution trumps you.

What your bible fails to mention is that the earth has an resources that do not just POOF appear like so said in the creation of earth, as told in the bible. Our planet is being over-populaced by the second and cannot provide the adequate resources for everyone and everything living on it's surface. So be it if there are couples who do not reproduce. In fact, they do better by adopting children that have no families, and providing them with love and support that the original mother/father/family did not want to or could not provide. None of your jargin about the bible or references thereof quoted mean anything to me. I used to actually go to church, follow the religion, until I started reading the bible thoroughly, and asking questions of those older than me. They could not give me any. I don't care to be with those people anymore, or follow a religion that finds it disgusting to be who you really are. I found that most of the "religious" people that I was friends with, turned out to be the most hateful, narrow minded, and judgmental people of all. You can pray for my soul, chant incantations, do whatever you want. I still believe that people, who are happy and not harming anyone else, should be able to live their lives undisturbed by your god's connotations on what is right and what is wrong. If they allow gay/ lesbian marriages, how can they fullfill God's commandment to be fruitfull and multiply? God intended to have one man and one woman for one life time. If He intended to bless same sex marriages, why would He create both male and female? Why not just create only male or only female? I'll tell you why. It has nothing to do with religion, except if the couple wants it to be so.

Let me ask you - where does one go to obtain a divorce? To a house of worship? Not, to a State court of law. If you were to follow the actual teaching that you cite, you would be working to outlaw divorce - do you want to do that? Because if you say, "No, I do not want to outlaw divorce," then you are picking and choosing what to follow out of the Bible - you are not being consistent.

If a male and female are the ideal combination and the only one that these experts on God's will want to be recognized as such, then why is it the first thing a woman has to do right after the marriage is start a fight with her mother in law in order to wrest the groom from his otherwise devoted and caring mother?

At least with same sex marriage a mother won't be losing a son or a daughter, she'll only be gaining an extra one.

It used to irk me that the senior center next door would hold open mike programs and the younger center workers would get up and sing rendition after rendition of, "Yes, Jesus Loves Me."

Then it came to me that these younger people were born and raised in a carefully religion manipulated ghetto and, as part of the mind control process that was the only song that they were ever taught to sing.

Thanks Rep Fossel for finally bring up a LOGICALl solution. This addresses the basic civil rights without calling it marriage thereby trampling on the tender toes of those feeble minded people who read the work of fiction that they call the bible. There will be some who will be disappointed that their union lacks the word "marriage"... big deal. And there will be some who will be disappointed and will unfortunately continue to spew the toxic trash that comes from the pews.

This will happen. If you haven't noticed, there's not one rational reason not to that's been put forth in any context yet. Same sex marriage has no victim, so there's no way you'll prove it should remain as it is without resorting to repulsive world views or religious pandering.

Serving a god other than yours is protected. Adultery is NOT a crime. Sodomy is NOT a crime. Lying (unless under oath) is NOT a crime. Yet they are all against the tenants of your religion.

Perley, given that the average homosexual lifespan is anywhere from 10-30 years shorter than a heterosexual, shouldn't you be intolerant of a lifestyle that robs its adherents of a substantial portion of their life?

Even in more "enlightened" gay-friendly countries, the lifespan is considerably shorter. Where this lifestyle is so harmful to human health, shouldn't we either 1) Tax it or 2) Introduce regulation to discourage it? Even smokers live longer. Look what we're doing to them...

Same sex marriage was a recent topic of discussion here in the bible belt of Alabama. As a recent transplant from Hancock county, I expected the worst as far as close minded comments and attitudes....however, I was pleasantly surprised. In Maine couples under the Dom Pat Registry are already afforded most of the same rights as marriage. BUT I think they should be afforded more, BUT NOT CALL IT MARRIAGE.. I am sorry a Marriage is between a single man and woman. Not same sex couple or a man and 2 women or a woman and 2 men etc....

There seems to be a lot of hatred around here. Regardless of your religion, rights should not be denied to anyone based on their sexual orientation. That is discrimination. It is our right is to have separation of church and state and be free from discrimination. This has nothing to do with your beliefs or whether you have a moral obligation to protect people. Its about equal human rights, respect, and tolerance. Unfortunately, people feel the need to make everyone believe what they do. I can ignore the preaching, but when it comes to legal rights, my childrens education, and making laws based on religion or other biblical "morals" I draw the line. In most of the churches I know theres a tax scam going on the more you contribute to the church or foundation, the more taxes you get back.

This one guy that won alot of money on a ticket, told the church that he would donate a his winnings to the church and where it is church he would not have to pay taxes on it, but they would have to give so much back to him and they could keep the rest, so he wouldnt have to pay taxes on the winnings.

Thats why they are all into their faith.

Ask anyone that is in certain churches about the tax thing, but they will deny it.
