BANGOR, Maine — A fired U.S. Customs and Border Protection officer has sued the Department of Homeland Security in federal court, alleging that her former male supervisor created a hostile work environment by repeatedly demeaning the role of women outside the home, discussing his conservative Christian views and treating her differently from her male co-workers.
Rebecca Albert Carnot, 33, of Rangeley claimed she was illegally fired in January 2011 after working in the Coburn Gore border crossing station for two years.
A Maine native, she is seeking reinstatement, compensatory damages, lost wages and benefits and legal expenses. Carnot claimed in the lawsuit that her former supervisor said that a woman should not be involved in any capacity in law enforcement and had a duty to obey her husband in accordance with the Bible.
He repeatedly invited Carnot to attend his Protestant church, even though he knew she was a Catholic, the complaint alleged. He also advised Carnot to court but not date because dating involved having sexual intercourse and courting did not, the lawsuit said.
After officers in the Coburn Gore station took part in a marijuana seizure, the supervisor allegedly gave gift card bonuses to all the officers involved except Carnot. She initiated the investigation that led to the drug seizure, according to the complaint.
Carnot was fired while on a preapproved medical leave. The supervisor left a termination packet on her doorstep in violation of her privacy, the complaint alleged.
Carnot’s attorney, Jeffrey Neil Young of Topsham, filed the complaint Thursday against Janet Napolitano, secretary of the U.S. Department of Homeland Security, which includes Customs and Border Protection, in U.S. District Court in Bangor.
The suit was filed after Carnot received a right-to-sue letter from the Equal Employment Opportunity Commission.
The U.S. attorney’s office in Maine has not yet received a summons in the case, according to Evan Roth, head of the civil division, located in Portland. It is the practice of the U.S. Justice Department not to comment on cases until they have been concluded.
In the complaint, Young alleged that Carnot was discriminated against on the basis of sex, retaliated against for filing a complaint about the discrimination, and subjected to a hostile working environment based on sex and religion.
Carnot no longer works in law enforcement, Young said Tuesday.



I would have thought she could have filed a complaint while working to chronicle this abuse of power? Did she not bring this up to anyone while she was working? I find that odd, if someone where I worked continued to pester me about religion, or my sex life I’d have said something long before being fired.

I agree w/taking responsibility for someone actions, but the same goes for the supervisor (if the religion/dating thing is true!) those types of conversations should not be happening in a work place. I suspect that you, like I, are a male. However, you are out of touch with the reality of what many people are subjected to in the workplace, but do not make formal complaints because they need the job and fear losing it. There is nothing more to lose after they have either been forced from their job or fired, so that is why they are more likely to go public afterward.
Despite whistleblower laws, many people still lose their jobs, so other employees are deterred from exposing workplace wrongs. Despite workplace anti-harrassment and anti-discrimination laws, those illegal behaviors continue to exist and victims who complain are often treated even worse and/or lose their jobs, so they remain silent.
Your comment that, “The problem with today’s society, is that no one wants to take responsibility for their own actions!”, in reference to Ms. Carnot’s complaint is comparable to the attitude of blaming a rape victim for being assaulted.
Here is a description of an ongoing situation that illustrates my prior remarks:
A female relative has worked for several years in a predominantly male workplace. Her
performance evaluations have consistently been excellent and most of her male co-workers and supervisors treat her well. However, there are male employees and a direct supervisor who make her life miserable with everything from sexual comments and innuendos to approving work-related requests for male employees but denying the same to her. My examples are a mere smattering of what she endures. She clearly is a victim of a hostile, discriminatory work environment.
I have encouraged her to make formal complaints and after a recent incident, some male co-workers offered to confirm what they witnessed if she did formally complain. She has rejected my suggestion and the offer by some of her co-workers. Why… because the “old-boy-network” that exists would not end the harrassment, it would likely escalate and her employment would be at risk.
You might ask why she doesn’t quit her job. My response is that she is the victim, why should she be pushed out? There is also another reality of life – it is called earning a living and paying your bills. She lives in an area where jobs of any kind are scarce and employment that has a decent pay scale and health insurance is even rarer.
Perhaps you should educate yourself. Your comments are the result of ignorance, bias, or denial.

Best of luck to your relative as I have been there and the “good-ole-boy” is absolute truth. Thankfully when my complaints went unheard I did resign but I had employment lined-up but as you stated so well….bills to pay, family to support and a job market where 500 people are applying for a single job. You are absolutely right she is a victim and also if you have made complaints at work and need a reference those complaints follow you and hinder your employment ability which is sad. Why can’t everyone just worry about their own job and not worry about others. I’ll tell FEAR that she is a better employee than those harassing and instead of them striving to be better they strive to try to break her. Sad isn’t it?

However, the recent policies and laws enacted by conservative legislators tell a different story. Women’s healthcare is threatened in many states, in Kansas, domestic violence was decriminalized, laws providing equal pay for women have been REPEALED by conservatives, a republican senator in the south compared women being required to carry stillborn babies to his farm animals delivering stillborn calves. I am happy to posts all these links, lest anyone think I am making things up. Please, don’t provide rhetoric you cannot back up. If you care so much about women and their position in society – you should be protecting them, not repealing or enacting laws that limit their rights and treat them as second class citizens.

It may not be legal in the state she is in.
Some states allow taping if only one person knows about it but others do not allow a private citizen to tape another without their permission.

I was reading it on my phone, and apparently the last 10 lines didn’t load. And so, it would seem she has a case.
To me the headline should read “religious,” not “conservative views. To me it is misleading.

But most religious people are conservative in nature but the harrassment was not just on religious grounds. There was harrassment on women in the workforce and dating techniques as well as her chosen religion so the headline was accurate in my opinion.

The Taliban was ruling Afghanistan at the time while supporting Al Qaeda-the US invaded. They were not in Iraq.

From 96/97 while uner the Taliban and sharia law muslim girls could not attend schools or go out in public uncovered. In 2002 girls were back in schools and women could go uncovered. Yes there have been attacks on the schools against the girls and teachers but by who? The Taliban in hiding-not the official government policy.
Freeing women had absolutely nothing to do with the decision to go to war in Afganistan.
Actually, there was a big a campaign at the start of the war by women right’s group to do just that to make sure that the depressed Afghan women were freed. I am not saying it was the primary or initial reason but many of our solders died when the war expanded to include just that. Much of the discussions with rebuilding Afghanistan had to do with women’s rights. It needed to be done and it was.

I was around when that issue came up. I don’t recall specific interest in this and am not going to waste the time looking it up for you. It was part of a broad movement to get emotions up over the war. If you read the post from LISA below you’ll see she refers to “Concerned Liberals” wanting to help the women although her understanding of it is a little misguided.

It doesn’t take too much to google women’s rights and see that the country is heading in a different direction (albeit with great diffculty) than what the Taliban did to it. It will take time and resources.

Nobody was interested until 9/11, and that was only to convince reticent Americans to back the war. I remember, because I was appalled by how easily we were manipulated.

I consider myself a fiscal conservative but a social liberal…guess I’m one of the few middle of the road people left in the Republican Party (if you believe all you read here). I pay my fair share of taxes. I don’t make huge money (way less than the President’s $250K line in the fiscal sand), I pay my bills, I served my country, I paid for my own college education and I live in my means. I am paying for my son’s college education without government assistance. I donate to charitable organizations…both time and money and I give back to my community.

I work w/all types where I work, Catholic, Muslim, LGBT folks, Baptist and none of them would ever say to me “You should court, not date, it involves sex if you date.” That’s out of line. If you haven’t been there, take a ride to Coburn Gore and try to see how hard it would be to live under these conditions in that confining space.
As a former Fed I can tell you that once the EEOC has issued a right-to-sue letter, it’s all over but for the check to be signed and the body count to be started. The case for that was made in US vs. Chambers when the Interior Dept., right after 9-11, tried to claim the current U.S. Park Police Chief had both failed to meet the Annual Performance Review’s standard’s for her position by claiming it was documented on her AP Review and for talking to the media about a subject she was, by Presidential Executive Order, required to discuss upon threat of adverse action (EOP Ltr of Instruction, dtd 14 May 1999). Chambers lawyer’s in PEER filed with the EEOC the required right-to-sue application and followed it thru the entire process. As a part of that process, when Chambers filed for a copy of the supposedly negative Review in question, Interior went to incredible lengths to hide it while still claiming it supported their own allegations. When the District Court, which had been following this case very closely, finally ran out of patience with Interior, finally ordered Interior to produce it upon threat of both a formal Contempt Citation, and some very real and unpleasent jail time for a number of named official’s, the AP Review suddenly appeared and cleared both Chambers, supported her retaliation counter-charge’s and, in an example of not ‘ticking off the dog next door’, had her entire Agency’s Management chain either fired for cause, retired, and in the case of The Secretary of the Interior, resigned before the White House could issue the formal ‘good-bye’ statement. To this day Gail Norton hasn’t been seen anywhere near DC. Chambers got both her job back, over 5 years back pay paid, her benefit’s restored and is now, again, serving as the U.S. Park Police Chief in DC.
Carnot, it appears, has provided all of her facts documented and in order (and that’s one of the function’s of EEOC, to see if that’s the case) and made her case to the EEOC in very short order. That the Supervisor didn’t have the gut’s to give her the termination packet face to face is clear evidence that he was determined NOT to give her any opportunity to rebut or reply to whatever charges lead up to this. That alone is evidence of a Failure to Manage charge. It’s also a lousy example of supervising since you can’t supervise if you don’t talk to your people face to face. The religious issue is even more disturbing, moreso when you consider the size of the Station, it’s location and the tendency of the LE community’s ‘go along to get along’ attitude in general. Someone is gonna hang on this one. I suspect that even now the NE BP’s HR folk’s are deciding who. Folk’s the longer this drags on, the worse it’s gonna get. And with the EEOC ruling so fast, that alone should tell someone that dragging this out is only gonna make it worse.

I am not sure what the case you mentioned has in common with this one since it hasn’t gotten that far yet. I will agree that more often than not a settlement is probably the ultimate outcome. However, as a middle type manager of a large company I see these cases at times. Many get so blown out of proportion and convoluted by the time it gets to this point. More troubling is that there is a legal process to follow once there is a complaint. That process should have had this manager out of the loop and his superior dealing with it. I also find that the person making the complaint did not follow procedures in a timely manner but is after the fact and in my opinion for monetary gain. I am not saying this happened here but it sounds like procedures were not followed on both sides.
With respect Sir, the procedural issue is one of the the key issues that EEOC looks at in these type case’s. That Carnot’s Supervising Agent deliberately served her, off the clock and at home, with the termination packet in order to specifcally avoid her and prevent any type of possible resolution to this whole mess is, and I’ve seen it more than once, THE key reason that EEOC issued the Right to Sue letter. Also, this deliberate abuse of procedure, and literally an outright Refusal to Manage, were no doubt major major factor’s behind the letter’s issuance. It also tells me that CBP’s Field Operations Command Staff and their HR folk’s are hiding in their office’s and not getting out to see what’s actually going on in the field. That this entire situation got to this level tells me that someone in the BP’s Regional Office has not been doing there job and instead concentrating on generating stat’s for the current budget cycle’s request for fund’s. You can’t supervise, much less manage, if you don’t get out and actually see what’s going on beyond written report’s, especially in public safety agency’s.
Being a 1st line Super’, or even Immediate Manager, brings with it the responsibility of looking out for your people even when it’s not going to be popular with the Senior Management’s policy’s or position’s when you have to correct despite the loyalty to the Chain of Command concept being upheld. That this whole thing got to where it is now tells me that there have been MAJOR error’s in judgement and failure’s to investigate and correct at more than just the Agent level. If this ever gets to court, Carnot is gonna take the entire BP to the woodshed, from the Chief Agent down, and give it a huge collective 4th point of contact whooping, not to mention a huge settlement. Seen it before in the DoD. One does not forget a $ 8.2 MILLION DOLLAR OUT OF COURT SETTLEMENT for violating an employee’s civil right’s under the Title 3 provision’s.
I basically agree with what your saying. I think the whole group has to be a bunch of morons in this day and age not to know how to handle this correctly. The one wild card I don’t know is what the actual reason for termination. I can’t believe this whole mess just stayed at the immediate supervisor’s level.

That and the eventual scalp that’s going to be hanging outside the Chief Patrol Agent’s office door in DC. Nothing makes the point better than a body on display. All I can say is you are completely correct on all of your comments. Thank you for setting records straight and clarifying for those who doubt Carnot. The proof is in the paperwork which will be shown to all soon. Everything has been documented. That’s why the Notice of Right to Sue was granted.
I can assure you there are two sides to this story and you are getting only one side. There are some posters on here trying to make this a left vs right, or liberal vs conservative scenario. These posters are so shallow their comments are worthless. The real facts may never be known unless this woman’s former supervisor and fellow collegues are also interviewed by the news so the full story is told.

Unfortunately those with things to hide don’t talk to the media. This story will unfold in the court where the truth should be told. Remember Ms. Carnot may be helping you or your daughters, etc., by bringing this to the public’s awareness. I am also sure that the Department of Homeland Security will stay mute and demand he stay mute also because if this supervisor made public statements and can not control himself it would not be good for their defense. I worked in media for many years and both sides are given equal time but if one side chooses to stay mute well the other does not have to be mute also. I have an opinion that men in the work place who can’t get along with females are maybe afraid of a woman’s work ethic is stronger than their male counterparts as women have to prove themselves because of the attitude like his. After all most women multitask well because of work and family. I am not saying one sex is better than the other because in my opinion there are good and bad employees no matter what there gender. Also, his comments about sex went way over the top and absolutely none of his business. It amazes me that people believe their intimate life is private but becomes public for others when they disagree with a lifestyle, It is really sad that people can not go to school or work and not be harassed or bullied for things that are nobody’s business.

That won’t happen-an office in a different state from the one I was working in had a well publicized harassment case.Immediately the HR guidelines were “updated” with a prohibition not to talk to anyone local or otherwise.They claimed it applied to all co. business but the timing was VERY suspect.

Based only on what information is provided here (possibly not the safest assumption, but it’s all we’ve got to go on), it sounds as if the problem here wasn’t so much conservatism as toolery – a human failing that knows no ideological boundaries.
I’m a Republican and I hate the border patrol. Always find some way to mess with you crossing, even when your passport is stamped with multiple entries from many different countries with no issues ever. She called veterans “terrorists” , as a Vietnam Veteran I can tell you that I was terrorized when I returned to the country I fought for (most hippies like Rush Limbaugh turned right wing after the draft was over). I’m glad she was fired, I hope her boss gets fired as well. I would like to see the lot get fired. If they do such a good job, why are they harrassing law abiding citizens, and we are flooded with “Undocumented Immigrants?”

I think you are confusing the Border Patrol with the Customs and Immigration officers. The Border Patrol works the areas between the ports of entry such as the woods, deserts, etc. The people who check your passports or other documents, search your trunk or whatever are the immigration/customs people who you encouter at the ports of entry when returning from abroad. They can be a real pain in the butt. Some are overly officious and a little badge crazy.

It seems like depending on who is reading and interpreting it in the minds what they think it says. This article said he tried to push her to his conservative views regarding religion, marraige and women in the work place. No where does this article call him the political “conservative” which you are all arguing about. His treatment of her is not political but his “Personal ideology” to which he is entitled. However, when you take that to work and try to impress it on an employee you cross the line. There are those who agree with his ideology however that number has decreased dramatically in today’s world. To begin with even married women usually have to work in today’s economy just to give the children a decent life. I am sure many wish they could just stay home and clean, cook and spend all their time with the kids rather than daycare, missed plays and sports and just the fatigue of a 100 work week between job and still all at home that needs to be done. His opinion was just that “his” and should have stayed at home. There is no place in the work place for this attitude and I hope he loses his job and maybe someone in the public (who he can not sue back) takes him out and berates him in public so maybe he will learn. Also is it amazing how her name is in the public to be discussed here and his name is a big secret. Well when she sues his name will come out and we will see if someone turns the tide. Highly doubtful his opinion will ever change but she can hope. This lady was discriminated on both her sex and religion which if I remember is illegal not just immoral. Stop arguing people and be thankful no one is harassing you or your wife/husband to the point you have to leave your security of employment and try to feed the kids (if she is married I am not sure if she has kids) or pay her own way in life. How many women/men choose to beg for entitlements rather than earning the family money legally and morally. I have compassion as I was forced my a male boss to almost insanity with his hostility and disrespect towards women and chose to leave a well paying job but my sanity, pride(were worth more than any money) even though the fact was that I pay my own way in life as I am single. There is not one person in this world who is worth trying to destroy someone’s spirit and drive. A year ago I was in a social issues and problems class and I had been assigned to work with a border patrol agent ( I was not thrilled) anyway, he made it very clear that women were a burden when he was working in the army..also that he was not trying to harass people crossing marijuana, but rather harder drugs such as meth and Oxycontin. Our project was on Dont ask dont tell…. and do I even need to tell you his beliefs on this! He was not a supporter that is for sure. I was soooo glad when this class was over, as I had to work with him for 3 long months :(

Despite comments to the contrary, this matter has nothing to do with conservatism per se. It seems to be a case of another misogynist hiding behind the rubric of the Old Testament, a rich source for rationalizing that sort of behavior. In his case, maybe the scriptures are the source of it, maybe not, but there it is nonetheless.
I would take any edict from the Bible with a grain of salt. It was written by men, not by God. Too many people–mostly men–throughout the past 2000 years, have used the Bible to justify any number of horrors and crimes against humanity, perpetrated in the name of their God.
As for the situation Ms. Carnot was forced to endure when she was just trying to do her job, it amazes me that her unnamed boss still has his position after so many violations of federal and state mandates–while she was fired because of his twisted, archaic bias.

I think I am reading a story that reports a small-minded male supervisor with certain beliefs acted in an unprofessional, unacceptable way to a self reported Catholic woman. This woman is now taking legal action where the court system and lawyers will do what they do with facts presented from both sides to reach a decision. One fact the employee included was the supervisor’s invitation to attend a Protestant church service.
Darn it, though….I keep missing the part where “conservatives” as a whole population endorsed, supported and condoned the supervisors efforts to return this woman to the home where she belongs. I am probably not as up to date as the people posting here, but traditionally aren’t the Catholics more tied to evil anti-woman antics than the Protestants?

I think we should all reserve any judgements until we here “both” sides of the dispute. I’m a conservative, I have both conservative and liberal friends and I don’t know anyone, conservative or liberal, who feels like this supposed conservative does. The description of this man almost seems like the classic portrait of conservatives that the left tries to paint of us. We cannot take her word as the gospel truth until we hear his story. We are still innocent until proven guilty, are we not?
