ROCKLAND, Maine — A 43-year-old Rockland man can be freed once he raises $500 cash for bail after being arrested over the weekend for an assault against a man who was in bed with the accused’s former girlfriend.
David H. Atwood was arrested on charges of burglary, aggravated criminal trespass and assault. The incidents reportedly occurred March 31 at his former girlfriend’s apartment in Rockport.
The arrests did not occur immediately because when Atwood fled the residence, he tripped in a tree stump hole and severely injured his knee. The injury required surgery and Atwood remains in considerable pain, his attorney Eric Morse said Monday during Atwood’s initial appearance in Rockland District Court.
Assistant District Attorney Chris Fernald asked for bail to be set at $5,000 cash, citing the seriousness of entering a residence and committing an assault against a victim who was sleeping. He also cited previous criminal convictions against Atwood, including a drug offense.
Morse, however, said Atwood had gone to his former girlfriend’s home on numerous occasions and had gone there to speak to her after seeing her that evening with another man and found the man in bed in her bedroom. When the man got up quickly, Atwood punched him once, according to Morse.
Morse said that the high bail was unreasonable since Atwood has been out on bail since the incidents and has not done anything inappropriate.
Atwood reportedly was picked up by police when he was spotted not wearing a seat belt as a passenger in a vehicle. Morse said Atwood could not wear a seat belt because of the position he had to sit in after his injury. The attorney also said Atwood needs to be released on bail because he needs to continue physical therapy and is not allowed to have crutches at the jail.
Sparaco agreed to the defense request on bail.

Honestly, with this kind of justification, is it any wonder why people seem to get away with this stuff all the time now?
This guy goes to his FORMER girlfriend’s house, enters it, and apparently, feels perfectly justified in going into her bedroom. Just because he’s gone there on ‘numerous occasions,’ he has some sort of right to march right in and go to her bedroom because he saw her with another guy the night before?
She’ll be blamed for not locking her door no doubt instead of his being blamed for stalking her.
I wonder how the story would read if it was a murder/suicide situation? My guess is that it would be vastly different.
