ELLSWORTH, Maine — Both sides Thursday requested more time to put together their cases before a Deer Isle woman goes to court on a charge of manslaughter in the Sept. 15 death of her boyfriend in Blue Hill.
Kimberly Phelan, 29, allegedly ran over and killed her boyfriend, Andrew Ray, during an early morning argument in Blue Hill after a night of drinking and drug use, according to the Hancock County Sheriff’s Office.
Ray, 31, also of Deer Isle, was pronounced dead at 6:15 a.m. at Blue Hill Memorial Hospital.
According to an affidavit by Detective Alan Brown, Phelan had nearly twice the legal limit of alcohol in her system and had smoked marijuana before the incident that ended Ray’s life.
Phelan’s attorney, Stephen Juskewitch, on Thursday told Justice Ann Murray that after several meetings with his client and with District Attorney Carletta Bassano, more time was needed before the case could proceed.
Noting the seriousness of the charge, he and Bassano both requested to reconvene in court in two months.
“It’s taken us some time to work through all of it,” Juskewtich said.
Phelan was released on $25,000 surety on Nov. 30. Among the conditions of her bail was that she live with her father. Juskewitch on Thursday asked the condition be changed to allow Phelan to live with her mother, which Murray allowed.
Manslaughter is a Class A crime punishable by up to 30 years in prison and a fine of $50,000. Phelan remains free on bail.
