BANGOR, Maine — A local man accused of shooting off a gun in the city on Patriot’s Day has been ordered to undergo a psychiatric evaluation to determine whether he’s competent to stand trial.
Stewart Gramlich, 29, of Bangor is charged with reckless conduct with a firearm.
He was arrested April 18 after Bangor police responded to a report of a naked man shooting off a gun on Adams Street. No injuries resulting from the gunfire were reported.
Superior Court Justice Ann Murray ordered the evaluation Thursday, a day after Gramlich was unable to talk with the lawyer-of-the-day or address the judge in his first appearance at the Penobscot Judicial Center by video conference from the Penobscot County Jail.
It took three jail corrections officers Wednesday to get Gramlich before Murray because of his mental state. Bent over and struggling to free himself from the officers who held him, Gramlich, his wrists handcuffed behind his back, was covered with a blanket because he refused to wear clothes.
He grunted and groaned but did not respond to the judge’s questions.
Jail personnel told the judge Wednesday that the mental health technician at the facility had determined Gramlich was in a severe schizophrenic state.
As of Tuesday, he remained in the custody of the Penobscot County Jail but was being housed at the Maine State Prison in Warren, according to jail personnel.
The results of the evaluation will be impounded, according to court documents. Information in the evaluation most likely would become public at a future hearing to determine Gramlich’s competency.
Gramlich has not yet been indicted by the Penobscot County grand jury.
If found competent after receiving treatment, and convicted, he faces up to five years in prison and a fine of up to $5,000.
If found not competent and not guilty by reason of insanity, he would be held at Riverview Psychiatric Center in Augusta until he was found not to be a danger to the community.
