The owner of the Bangor Mall paid the city nearly $39,000 after a judge’s February ruling.
Namdar Realty Group paid the mandatory $38,966 to Bangor, after the city had to fix a sewer leak the mall owner did not fix. The payment was made by a judge’s March 5 deadline, city spokesperson David Warren said.
A judge ruled in February that Namdar must pay $1.1 million for code violations ranging from a sewer leak to roof leaks. It came after the city filed two lawsuits in late 2024 against Bangor Mall Realty LLC, a subsidiary of Namdar.
As part of that order, Namdar had to reimburse Bangor for the nearly $39,000 spent in August 2024 to fix a broken sewer line at the mall in August 2024. A sinkhole opened around a 54-inch stormwater pipe, causing a break in a 10-inch sewer line and 18-inch stormwater pipe.
Namdar allowed the pipe to continue spilling untreated, pink, foamy sewage.
A contractor for the mall had a set up bypass — which captures the sewage and then deposits it back into the pipes after the break — but Namdar said it would not pay the contractor, according to court testimony.
The contractor removed his equipment and the sinkhole was “actively filling with sewage” when city officials arrived on site. Bangor stepped in and set up a bypass, made emergency repairs and cleaned up, costing the city $38,966.
Settlement discussions for the $1.1 million in fines are ongoing and confidential, Warren said. The two sides have until March 20 to reach an agreement, according to the court order.
