LOS ANGELES — Some might call it a case of swift Oklahoma justice for at least one of two intruders — both reportedly high on prescription drugs — who tried to break into a young widow’s home on New Year’s Eve.

Sarah McKinley, 18, calmly used a shotgun to shoot and kill one of the men when he forced his way through the front door of her mobile home and past a sofa she had used to barricade it. Now, the second man is facing first-degree murder charges, and McKinley is being hailed as a hero for doing what she believed she had to do to protect herself and her 3-month-old son, Justin.

The two men were reportedly looking for drugs — most likely painkillers — that they believed might have been left behind by McKinley’s husband, who died of lung cancer on Christmas Day.

McKinley will not face charges in connection with the case, which is garnering headlines around the world, because there appears to be little confusion about the facts of the case. Much of her ordeal was captured in a recording of the 911 call in which she asked for help — and also asked for permission to shoot if necessary.

“There’s a guy at my door and I’m here by myself with my infant baby. Can I please get a dispatcher out here immediately?” McKinley asks in a voice that is both steady, but tinged with emotion. Grady County dispatcher Diane Graham asks McKinley whether her doors are locked. Her steely answer: “Yes. I’ve got two guns in my hand. Is it OK to shoot him if he comes in my door?”

“I can’t tell you that you can do that,” Graham answers, “but you do what you have to do to protect your baby.”

Justin Shane Martin, 24, of Blanchard, died clutching a knife in his gloved left hand, according to court records filed in Grady County district court. His alleged accomplice, Dustin Louis Stewart, 29, also of Blanchard, later turned himself in to police.

Stewart later confessed to police that he and Martin “devised a plan to burglarize the residence” because Martin knew that “a resident of the home had recently died of cancer” and he “suspected narcotics may be located inside the residence,” according to an affidavit. Stewart also told police that he and Martin took the drug hydrocodone about 30 minutes before the planned break-in, according to the court records.

Grady County prosecutors said McKinley acted in self-defense.

“Our initial review of the case doesn’t indicate she violated the law in any way,” Assistant District Attorney James Walters told NewsOK. “He should have thought about it before he went into someone’s home.”

McKinley told NewsOK that she tried to hold off as long as she could, waiting for police to arrive, while Martin kept pounding on the front door. At one point, she gave her son a bottle to keep him from crying too loud — and possibly alerting the intruders to her specific location.

“I didn’t want to give away my position in the house; I wanted to see him first,” she said of the intruders during an interview with NewsOK.

But about 21 minutes later, with no law enforcement officer in sight, Martin pushed his way in the door.

“I was standing in the bedroom doorway with a shotgun in my hand … when he did come in the door … I told 911 I was going to shoot and I did. And he just kind of fell over the couch.”

She said she feels bad — but has no regrets.

“I felt like what I did was the best decision for my son and I. Obviously when someone breaks into your house with a deadly weapon, they’re not here for anything good. But I am very sorry and it’s not something I ever wanted to do.”

      What are people after after when they break into someone else’s home? Most likely DRUGS, MONEY or GUNS.  These home invaders guessed that there were some drugs in the home because the man living there had recently died of cancer.

I fully agree with you.  There can be any number of reasons that thieves  (scumbags!) break into homes, or they may have no idea what they are after. but as far as I know, guns, drugs and money are at the top of the list.  Having a gun is but one of the many ways to be prepared … There are many ways to discourage thieves, or to avoid encouraging them in the first place. There’s a certain percentage of crazy people, and those who are forbidden by law to have guns. What protects the home when the people are out? Even though guns are used in self-defense, or to deter crime, as many as 2½ million times per year, you rarely hear tell of it in the press. Today’s case was so sensational that the story simply could not be spiked.     3. Why would you ASSume that the cops were at a “good card game”. There could have been a lot of criminal activity or another major situation going on at the time or it could have been a very rural area. I do find myself disappointed that after 21 minutes that an officer had not yet arrived, but you don’t know the situation. This is all the more reason that we as citizens should be prepared to defend ourselves as this brave young lady did.

    4. The Supreme Court has ruled a number of times that the police have no duty to protect any specific individual. That job is yours, and yours alone. Police have a mission to enforce the law in general. You can (and should) call 911, if threatened; but protecting yourself and your family has always been YOUR job, and it cannot be delegated. No matter how you personally feel about using deadly force, keep in mind that – if the home invaders get past you – they are going to be able to do what they like to your family, and your feelings won’t be a consideration. Go ahead and worry about how you could possibly deal with the knowledge that you have taken a life – but balance that with how you are going to feel if you falter under pressure and, god forbid, your mate or child gets killed.

A 21 minute response or more is not uncommon at all for any rural town without it’s own PD here in Maine especially with counties cutting back on their budgets all the time.  One deputy may cover 8 or more towns, and the transit time alone may be 30 minutes or more.  This also applies to ambulance services.   

    6. Guess you must live in a town with a full time police dept. that has nothing else to do.  That is not true everywhere.  The truth is “When seconds count, depend on yourself, the police show up when they get to it.”

      1. This girl lived about 3 miles from the center of town (pop. 8,000) at the dead end of a county road. Though the town has a full time police department and sheriff’s department coverage, it also was New Year’s Eve day at mid-afternoon when this took place. It’s quite likely both departments were working with smaller shifts in anticipation of a busy evening, thus the slow response time.

        It’s fortunate that she had firearms in the house and knew how to use them. Like you said, “when seconds count, depend on yourself.”

It is also possible that if the street and thus the residence didn’t have adequate directions to the location.  It is a sad fact that in some cases addresses aren’t always easy to find.  I know a lot of people are thinking well use a GPS, but those aren’t always accurate either.  They are only as good as their maps and satellite coverage.  I’ve seen GPS’s that don’t have streets ont hem that i was clearly driving down.  A friend of mine got sent down a dead end looking for a bridge to cross town.  Not always reliable.

        1. Nice list, However 9 out of the 11 are not going to respond to a call for help at your home. (It’s not their job)  The other 2 County & State, depending on who’s on duty, if they are available at the moment, the actual response time,  sometimes it can take several hours depending on the call.  I will continue to depend on Mr Colt, Mr Remington, Mr Winchester, & Mr Browning.  There are also some others in that good company who also make for good companions until law enforcement can arrive.

    For those who have no experience living in rural areas, I suggest you try it sometime. There aren’t exactly policemen on every corner. For that matter, the nearest “corner” might be miles and miles away. there are places in OK that are pretty darn rural.

  14. Poor girl, she’s been through enough heartache without those scumbags causing her this trauma. Even though she is getting popular support for what she did, how can she ever feel safe being alone at home.  Thank God she knew how to use those guns.
