PORTLAND, Maine — A lawyer representing a Portland man who strangled his girlfriend, decapitated her and set fire to her corpse argued before Maine’s highest court Tuesday that Chad Gurney should not have been convicted of the murder because evidence found on his computer, including a link to a grisly video, should not have been allowed in the case against him.
Gurney, 30, was sentenced to 60 years in prison in March by Cumberland County Superior Court Justice Roland Cole. The crime, committed against 18-year-old Zoe Sarnacki, took place in May 2009, four years after his Liberty University lacrosse team van crashed and two days before Gurney was slated to leave for Thailand as part of a reported spiritual quest.
“It’s clear Mr. Gurney was not normal in the way he viewed the world, but the issue the court struggled with was whether he understood that what he did was wrong,” Chief Justice Leigh Saufley said Tuesday during the hearing.
Attorney Sarah Churchill, representing Gurney, told the Maine Supreme Judicial Court on Tuesday that a concussion and other injuries from the 2005 crash required 20 surgeries and left the Portland man delusional. Churchill argued before the court that Cumberland County Superior Court Justice Roland Cole erred in February when he found Gurney guilty, in part because police search warrants should not have applied to Gurney’s smartphone, laptop and Facebook page — and evidence harvested from those places, most prominently a link to a beheading video, should not have been considered by the court.
While the court should not have considered the smartphone and laptop evidence, Churchill argued Tuesday, it should have given more weight to journal entries showing he suffered from psychosis and was insane when he committed the crime.
Assistant Attorney General Donald Macomber countered before the court that Gurney murdered Sarnacki in revenge for her reportedly sleeping with another man. He said the link to a video of a woman being beheaded, which was accompanied by language suggesting the mutilation depicted was done as punishment for cheating, suggests premeditation.
Macomber said no information from Facebook was used in the case against Gurney.
“The evidence was overwhelming that Chad Gurney knew what he was doing,” Macomber said. “He told police he knew what he was doing and he knew that it was wrong.”
Churchill told the Bangor Daily News after leaving the Portland courtroom Tuesday the court could issue its decision anytime from “a couple of weeks from now, to a couple months, to several months.”
“It’s really hard to tell” how the justices are leaning, Churchill said. “You can’t really read into what they ask about. We just have to wait to get the opinion.”
Kathy Kosnow, Sarnacki’s aunt, said after the hearing that Gurney’s appeal to the law court was not unexpected, but it hurts the victim’s family members to relive the crime.
“It takes your breath away to see it and hear it,” she said. “It brings it all back. … It’s important to me just to be here for Zoe. You don’t want to hear this stuff again, but it’s important to be here.”



Anyone who commits murder in my opinion is insane. Sane people don’t kill one another. That stated, they should never, never be free to do it again. This is one area we just can’t take a chance of them becoming insane again and taking another life.

We agree mostly. I believe in the death penalty and anyone that commits murder should never be released. I think most people try to cop out with an insane plea, when clearly they weren’t insane. However, that stated, normal children, raised in a loving home, don’t normally kill their parents. Children whom suffered severe abuse sometimes do kill their parent or parents. I do believe that environment does play a part in many crimes. There are people who do enter a truly insane state of mind, no one is home. Drugs can even cause that state of mind, like bath salts. This is not an excuse for behavior and they must stay behind bars, IMO, there is no rehabilitation, the risk is too high if it fails.

Saying that, how is it that the man that killed Robert Kennedy hasn’t been paroled, and yet the guy that does the Dog the Bounty Hunter gets paroled and gets his own TV show?
Our law system isn’t perfect, and until it is, we can’t just start killing people. How many times in the last 3 years have we heard of prisoner’s being exonerated due to DNA evidence? Let the guy think and remember what he did, let him live with it and rot with it. If we had the death penalty, we would end up doing what he may do anyway, commit suicide. By putting him to death would be doing him a favor, and I don’t think that he deserves any of those.
I support the death penalty in cases that are particularly heinous, like this one. That said, I think the death penalty in this country is a joke that makes rich men & women out of marginal attorneys. If someone is sentenced to death, they should automatically have their case reviewed by a panel of judges to ensure the verdict and sentence was fair and proper. The execution should then be carried out within weeks or months. This pattern of inmates sitting on death row for years and often decades while lawyers file appeal after appeal is ridiculous. We would have a mad dog put down, and frankly I don’t see the difference.

Our legal process is not perfect, once it is, I’m all in favor of the death penalty, the problem is, our legal process continues to learn, as we do, which is the intention of the founding father’s. I’m certain that the Founding Father’s did not envision us butchering each other with guns, and other weapons.

As for murderers, they deserve the death penalty if they murder without provocation by planning and executing or in the commission of a crime. Bring the death penalty back and reserve it for those whose guilt is proven by hard evidence. This man provided his own hard evidence. Is he sick? I just read where a judge allowed two women to go free after spending a few years in phych center for killing their children, that made me sick. Both children were killed by the hands of their mother. They struggled thru their deaths. He released them to a half-way house saying they were well now. I don’t believe that someone who can take the life out of their own child would ever be well.

What is good for the Army is great for our prisoners. I like that Sheriffs idea down in Texas. Army tents. Perfect. They even make those with wood stoves now. They could cut their own fire wood. (Using non-violent prisoners for this). Yes, there are many inmates in jail for fraud, stealing and OUI, they can work with tools. No, I wouldn’t give a murderer an ax and ask him to chop firewood! What does the military call those rehydrated packages of food they are forced to eat, perfect food for them. Cots for beds at best. No canteen to buy luxury items, no tv and no radio’s. Do a web search, you’ll find that prisoners have died from exposure in Arpayo’s tent jail, mostly illegal immigrants but that doesn’t matter. It gets over 140 degrees in those tents in the summer and they are not given enough water to stay healthy in that environment.

The sheriff is Sheriff Joe and he is in Maricopa County Arizona. If all of the great US of A would follow his footsteps, our country might be in a different state!! Just saying my thoughts!! Look at how low the cost is to feed and house his inmates.

That was the gist of his defense…that he was a law-abiding, decent person, a practicing Christian man who was fine until he was involved in a bad motor vehicle accident that caused a verifiable brain injury. It was argued that his brain was so messed up from the accident that he couldn’t understand the results of his actions. His defense is arguing for him to be committed to a mental health institution so he canbe treated…he’s not going to get mental health treatment in prison.

I am sick and tired of hearing about criminals rights! In a case like this he has absolutely no rights . Zoe Sarnacki and I knew each other growing up in the Portland area and this crime is repulsive given her kind demeanor. Gurney deserves the solitude of a prison cell for the rest of his days. Hopefully the courts allow justice to be done.

Authorities on Thursday arrested a retired DEA agent who allegedly sexually abused an underage, developmentally-delayed girl for almost five years in Nutley, N.J., reports the website NJ.com.
