MACHIAS, Maine — Washington County Sheriff Donnie Smith has opted to part ways with the the Maine Sheriffs’ Association shortly after his public criticism of Penobscot County Sheriff Glenn Ross over the handling of the investigation of the Rev. Robert Carlson.
Smith said Tuesday he’s baffled by the fallout created by his comments, which came after Ross confirmed that he informed Carlson, a long-time friend, that he was the subject of a criminal investigation.
The Bangor minister took his own life within hours of his two telephone conversations with Ross. Smith contends Ross’ conversations with Carlson breached law enforcement ethics and undermined a Maine State Police investigation into allegations of sexual child abuse.
Last week, Smith called for Ross to step down or to be removed as president of the Maine Sheriffs’ Association, with Smith threatening to resign from membership if that didn’t happen.
It didn’t. Instead, the association agreed last week to appoint a three-member board of inquiry to look into Ross’ conduct in the matter.
Smith said Tuesday he’s walking away from the group after being told that he, as well as Ross, is being investigated by the board of inquiry, which is headed by Hancock County Sheriff Bill Clark.
In an email sent Tuesday to the executive director of the Maine Sheriffs’ Association, Smith said: “Today I learned from my county delegation that Sheriff Clark was in Augusta investigating me, at least in part, because I publicly questioned Ross’ actions. I find this concerning as last week Sheriff Clark informed me that he was looking into the allegations that Sheriff Ross hindered a child abuse investigation.
“I was elected after I promised transparency and honesty with the public. Why is the Maine Sheriffs’ Association more concerned with protecting its own than exposing inappropriate conduct that may have silenced potential victims? Effective immediately, I will resign my membership with the Maine Sheriffs’ Association.”
The board of inquiry’s investigation, when announced last week, was expected to take a week. Clark said Wednesday morning that he planned to submit his investigative report before noon and that the association was likely to summarize its findings for the public through a press release.
“They are going to want to do something, I suspect today,” Clark said. “I think by noontime, hopefully, they’ll make a decision.”
Kennebec County Sheriff Randall Liberty, who is the sheriff association’s second in command, said Wednesday afternoon that the executive board reviewed the investigation’s findings and decided to submit them to the group’s attorney before they become public.
“That [information] will be available tomorrow afternoon,” he said, declining to say whether the findings listed any recommendations.
Asked if his inquiry included an investigation of Smith, Clark said this Wednesday morning: “That’s something I can’t deny or confirm at this point.”

I like constitutional Sheriffs
They’re ALL a bunch of crooks.
These sheriff’s, past and present, all have one thing in common… they cannot keep their mouths shut.
The more I think about it the more I think Canada has it right. One police force that could eliminate all these pi–ing contests between law enforcement agencies.
As for Sheriffs depts. I believe that they are charged with maintaining a jail and serving warrants by Maine law.
I can always tell which weekends the State Police are on duty instead of the County Sheriff around our area, there are actually cars being pulled over for speeding.

The RCMP is a national Police force…. Ontario Quebec, Newfoundland and Labrador also have a provincial (State) police force, and many Cities and Town throughout Canada have a local police Dept. as well. Also in Canada Military Police have the same powers as local Police in enforcing Federal Laws. New Brunswick , Nova Scotia, and others have a Sheriff Service as well.
New Brunswick for the most part is covered by the RCMP with the exception of Saint John, and maybe Fredricton and Moncton. Very little fighting among departments. A lot less duplication of services.
This is from the Maine constitution. Maybe Sheriff Smith should make a complaint to the Governor.
Section 10. Tenure of sheriffs. Sheriffs shall be elected by
the people of their respective counties, by a plurality of the
votes given in on the Tuesday following the first Monday of
November, and shall hold their offices for 4 years from the first
day of January next after their election, unless sooner removed
as hereinafter provided.
Removal of sheriffs from office and replacement. Whenever the
Governor upon complaint, due notice and hearing shall find that
a sheriff is not faithfully or efficiently performing any duty
imposed upon the sheriff by law, the Governor may remove such
sheriff from office and appoint another sheriff to serve for the
remainder of the term for which such removed sheriff was
elected. All vacancies in the office of sheriff, other than
those caused by removal in the manner aforesaid shall be filled
in the same manner as is provided in the case of judges and
registers of probate.
Something makes me think Gov LePage would tell the idiot to go pound sand that the State Police is handling the investigation and he needs to get his nose out of it.

Ross’ explanation is questionable at best – no big ridiculous epiphany there….Ross covered for his pedophile friend…Ross had 2 separate phone calls to Carlson…what one phone call saying ‘your under investigation for molesting children …and….er….I’m concerned about you coming to the jail’ wasn’t enough?? It took two separate phones calls for Ross to explain to Carlson about not coming to the jail?? I think not…

Donnie, I know you are concerned. and I understand that. But shouldn’t you allow us folks over in Penobscot County to wash our own dirty laundry, then, depending on the results of the State Police investigation and whatever we do ourselves in Penobscot Cty, then you can howl if necessary? I think the good folks of Penobscot want this situation dealt with swiftly and firmly.
That would be fine except for one thing… Ross is the president of the Maine State Sheriffs Association. Sheriff Smith, as a member, took exception to what Ross (was reported in the paper several times) did, and as a member stated his concern. This is NOT a Pebonscot issue, it’s a State of Maine issue. It’s not the investigation of Carlton that is the point, it’s the point that Ross may have crossed the line, and Smith simply stated that if he stays as president, I have to go. At least Smith lived up to his words…

I don’t think he was out of line calling for an investigation of Ross, he should have just toned down his threats of quitting the association. A simple “I would like a full investigation of the Ross’s actions as their is an obvious perception that he hindered an investigation” would have sufficed. When you do what’s right, the media always wants to ‘take you down’. Ross is not a man of character if he let Carlson in on the investigation. Fortunately, Carlson has checked out and moved into the hotel California, saving us taxpayers a lot of money. I don’t think Smith or Ross are truthfully stand up guys! We all knew that already didn’t we? What Glen Ross did is wrong, unethical,and possibly illegal. He gave details to Reverend Carlson that lead to his imminent suicide. Now if you or I did that we would be in jail for obstruction of justice, harboring an investigation, etc. So why are the rules different for Sheriffs at the top of the department, or any other law enforcement figure?

The “higher ups” have a tendancy of covering things up and Donnie knows this. He is not looking for attention. If you knew him, you wouldn’t get that impression at all. Why is it that some Sheriffs prefer to see themselves as political pundits? The notion of being pulled over by opinionated politicians should not give anyone comfort.
I agree that there needs to be some sort of investigation into Glenn Ross, no doubt , but this makes me wonder what Donnie Smith has REALLY done to require and investigation! I can’t believe they would investigate Smith for just making comments on a statement another Sheriff made.
It has seemed for a while that he has tried to cast shadows on other departments in order to keep his operations from being the focus. He has been slamming MDEA, Penobscot County Sheriff’s Dept, Pleasant Point…now he is slinging mud at the Sheriff’s Association and Sheriff Bill Clark.

Sheriff Smith is taking the proper steps in the service of truth and justice. The response from MSA is typical of an unaccountable organization responding to a legitimate whistleblower who is both knowledgeable and ethical. Standards should be applied to public officials in the same way that laws are enforced by a regulated community. How else does a whistleblower gain protection other than publicly revealing misdeeds? What would have happened if Sheriff Smith had not taken the initiative to ensure accountability.
The FBI needs to step in at this point.
Why? this is a State matter not a Federal one?

Exactly what does it mean when someone quits the Maine Sheriff’s Association? Is this like a closed shop labor union where one has to be a member of the association to be sheriff?
If not, his “quitting” is more ceremonial than anything else and doesn’t really amount to a hill of beans. If that’s the case he’s still sheriff, still performing his duties, and still getting paid. The only difference is that he doesn’t have to pay dues to the association.

In all truth. None of this should have appeared in the public newspaper beginning with the notification of Mr. Carlson by Sheriff Ross. That one act has led to a complete and utter confusion of all involved with unsubstantiated accusations and rebuttals having filled the newspaper with fodder for malicious gossip. Had the investigation of Mr. Carlson been kept quiet and confidential as should have been perhaps no deaths would have occurred and justice would have been served. The trial and conviction of the late Mr. Carlson is abhorrent regardless of anything else. iIf the Sheriff of Washington County desires to end his participation in the Maine Sheriffs Association for any reason that is his right. If he wishes to make that resignation public for whatever reason that is also his right.

A Hancock County Sheriffs Deputy was driving his car in a non-emergency or response situation and crashed it. The cruiser, valued at 25000 dollars was completely destroyed. The deputy admitted that he had been traveling at roughly 91 miles and hour when he crashed the car. Review of his dashboard recorder showed that he had reached speeds as high as 105 miles per hour before the crash. Sheriff Clark believed that a penalty of 1 day suspension and no new car for this deputy was severe enough.
Maybe I will be suprised by the outcome of this board of inquiry. However with Clark as the leader of this inquiry I doubt I will be.
Don’t forget the state trooper who just pleaded guilty to oui and gets to keep his job. Know all troopers know they won’t be fired if caught oui which means more drunks on the road.
I have a different opinion on that issue. The trooper was detained, arrested and booked by troopers. The trooper that was drunk admitted it and said he had done wrong and would accept whatever came to him. He went from being a Sergeant to a Trooper which significantly reduced his pay and pension. He went from being the MSP representative at the Police Academy to a desk officer. In my opinion you do have to temper justice with mercy and realize that people make very bad mistakes and yet they can be given a chance at redemption.
If Sherriff Clark has given the deputy two weeks off, taken him off patrol and made him work in the jail and put him at the bottom of the promotion list then I would have supported him in that. One day without pay and no new car is a joke as a punishment.
It just goes to show how corrupt our law enforcement is on so many different levels! And these are the people that we are supposed to trust with protecting and keeping us all safe from all sorts of things? Maine’s biggest issues are with people of power such as this! This person didn’t just give someone a heads up about a minor violation! Think of what that priest did to that poor child and how that child and their families have to deal with the rest of their lives and never have the chance to suffer in prison and have to face a lifelong hell like this child and family will have to. Its not fair for them at all. Hope this sheriff guy is proud of himself.

Anyone with half a modicum of common sense knows what Sherrif Ross did was a serious breach of ethics so I find it ridiculous that there has to be a “committee” appointed to see what is as plain as the noses on their faces. To have known about these alligations years ago. Someone should of looked into Carlson , checked his sources, like he is any other normal citizen, we wouldn’t be having this discussion today. Smith and Richardson are both media hounds,and the BDN, after calling Richardson, is being used by both ,Richardson is taking credit for having brought Carlson into the jail minstry in one interview and” he did some wonderful things” then in another interveiew ,he says” he told him to move on” ,when the facts state (public info)that Carlson was there before Richardson was ever hired as” deputy in his early twenties” ,when Richardson was installed as sheriff,because of Otis Labree’s recommendation, he twice promoted Carlson, he is as responsible as Carlson for this taint on the county.Richardson has a history of vendetta seeking ,see the State MLRB decision aginst him vs Ross,this continues to this day.
I think Smith’s heart is in the right place, but, his choice of public words may have been a bit much. If anything, Maine has learned a lesson from this. If you see something or hear something amiss, speak out, investigate, take photos, photocopy, something, anything to protect the children around us. Don’t wait 20/30 years to take action, it’s too late. Just my two cents.
Reading all of this makes me hope than none of you ever serve on a jury where I have been accused of anything. Donnie is a media hound who seems to not care if its for positive or negative reasons as long as he gets his face time on the news and in the papers. I am sure the investigation will show that poor judgement was used, but as far as breaking the law, I don’t think anyone here has the expertise to come to that conclusion until the investigation is done. This happened in Penobscot and Waldo counties, and Donnie should concentrate more on what goes on in his own county and let the powers that be do their job.
I’m sure Sheriff Smith has the ability to read and comprehend Maine State Statutes regarding hindering apprehension and prosectution. Not quite sure I can say the same for Deputy AG Stokes.

I have read it many times and am aware of how it is written. Unless you have a recording of the conversation between the two then you cannot reach the conclusion you seem hell-bent on. The calls could have been to try to talk him into turning himself in. Innocent until proven guilty works for both sides here.
In this particular case you don’t need a recording of a telephone call when you already have the statements of Sheriff Ross. Based on those alone he has clearly violated the statutes.
Apparently you’re not able to comprehend the statute, because none of the conditions applied in the Carlson case.

This story reminds me of the time we brought Fred Whitehurst PhD ,JD to speak at Harvard Law School and Bates College. Fred the Fed , as he liked to be called worked at the FBI Lab for over 15 years where he was the resident explosives residue expert.
He told the audience how his FBI Supervisors tried to get him to lie about his analysis of the 1993 1st World Trade Center bombing
He was also the lead chemist who analyzed Timothy McVeigh’s clothes for traces of ammonium nitrate
after Tim was arrested. When Fred did not find any ammonium nitrate another FBI chemist was assigned to replace Whitehurst and went on to find traces of ammonium nitrate.(we now know the Oklahoma City bombing was a FBI Op)
Dr Whitehurst decided to go public with his knowledge about how bad the FBI Lab was run.
His FBI supervisors tried to have him committed to a psychiatric hospital!
The rest is history as they say, eh?

I am with Sheriff Smith too. Have been since i first started following this story that more and more looks like wide spread corruption. Contrasted to what looked like an isolated incident at first.
Ross is just using the excuse of protecting prisoners from a child molester to let his life-long friend know the jig was up. Did Ross know about the years of Carlson’s actions and help to cover it up? Gotta wonder. Now Smith, no stranger to speaking out of school, as it were, is being investigated? For what? Exposing the truth about the Sheriff’s Association covering for one of it “good” members? You gotta love Donnie’s “toss the skunk in the middle of the room to see who smells bad the first” approach! You’ll get my vote again.

I see alot wrong here all around. I think it berst that questions get asked, and answered when it comes to law enforcement being transparent, because it should be. When a Sheriff gives the heads up to a friend about an investigation, questions should be asked why that was done. When another Sheriff asks some of those questions, and supposedly is told he is being investigated as well, questions should be asked why on that too. The main reason people distrust law enforcement is the suspsion that they are not acting in the manner their oath obligates them to.

Sheriff Smith is being investigated for what? STATING THE TRUTH!!! Way to take the spot light off Ross!! Shame on the Maine Sheriff’s Association if they condone this behavior!!!
Okay, seriously people, we get it, what Ross did was not wrong, and Donnie Smith expressed that, and the organization agreed enough to open an investigation, but Donnie Smith needs to stop with the threats and publicity, he could have done this in a more private manner and let the investigation speak for itself, so yes, he should be investigated, not because he made the issue public, but because he is slandering Ross, it is not his decision, the investigation decides it.

I have know Donny for a very long time. I would expect no less from him. He is a man of integrity. As it turned out good riddance to Carlson. However, Ross could have tipped off a low life sexual predator who could have used this insider information to avoid or lessen his prosecution by hiding evidence. Ross was in a position to know this very well but yet he tipped off Carlson. Why?????
I think smith should just keep his nose out of things that where he dosent belong he has way too many issues here in washington county to deal with he is just jelous that he didnt break the news did everyone forget that he was going to find all the stolen guns from the evidence locker what happened to that lets just sweep everything under the rug thats what he likes
He tried to find out about the guns, but that investigation was taken away from him…..then never brought up again. He TRIED to get answers, but someone stopped him……and that is a cover-up, not by Donnie, but by whoever took over!
