ROCKLAND, Maine — A Warren man has filed a lawsuit against a Rockland bar, claiming he suffered serious injuries when a bouncer and some other patrons threw him out the door.
The lawsuit on behalf of Terence Ryan was filed Feb. 14 in Knox County Superior Court in Rockland against Myrtle Street Tavern, Inc. of Rockland.
Ryan claims in the lawsuit that he was standing at the crowded bar at the Myrtle Street Tavern on Feb. 26, 2010, and talking to a friend when an employee of the business, he said likely a bouncer, came up and grabbed Ryan from behind. Ryan claims he grabbed his attacker in self defense but then let go when he saw who it was.
The lawsuit, filed by attorney William Griset Jr. of Lynnfield, Mass., further claims that the bouncer and five or six other men who were playing pool at the time grabbed Ryan and threw him over the doorstep and into the parking lot.
Ryan claims to have suffered a fractured ankle and other serious, painful and permanent injuries. He said he continues to incur medical expenses and has suffered pain, mental anguish and emotional distress.
He claims negligence and assault and battery against the business.
Rockland police said that Ryan filed a complaint three days after the incident back in 2010 but that no charges resulted from the department’s investigation.
A telephone message was left Thursday with the Myrtle Street Tavern, seeking comment on the lawsuit.

Why would a bouncer throw out someone who’s just sitting at a bar talking to a friend? Something doesn’t sound right about this story. I’d like to hear the bouncer’s side. I’ll bet it’s completely different from Mr. Ryan’s version.
Emotional distress? How about emotional embarrassment at getting your arse kicked.

let’s hold judgment until we know the facts…. the BDN is notoriously horrible at reporting the whole story when someone is arrested or when anything happens, really.

Note the Lawyer is from Mass. Apparently no Maine lawyer would take it. And where is this “free” money? You think that because a suit is filed that someone starts writing checks? Hardly.
usually this happens and the lawyer try to get enough attention on it and have them settle out of court. Then he takes 60% of the settlement as a fee.
Some patrons do not abide rude behavior and some bouncers will not tolerate it. The only negligence was in not busting this guy up more.
Some of the bouncers in this state start way more fights than they break up so I kind of believe this guy. I’ve seen bouncers beat the crap out of guys who could barely stand up. Most bouncers enjoy fighting thats why they bounce.

Well seeing that bars cannot serve people who are drunk. If he was drunk its the bars fault lol I think the guy has a case if he was injured same way you would falling on a wet floor at Mcdonalds. i met a few bouncers that were way to forceful never tried to reason first. I touch anyone in a way they do not want to be touched is assault . I guess they law exempts bouncers Was he asked to leave first?
You seem to be unaware that there ARE exceptions to your definition of assault. Many of them and they include the protection of property, other persons and termination of a trespass.

The first and only time I ever went into the Myrtle St. Tavern, I witnessed a husband & wife (or maybe girlfriend & boyfriend) armwrestling – literally – in the booth by the door.
Its a rough place… Worse could’ve happened!

lol, Myrtle Street…not surprising. If you wanna fight in Rockland, that’s the bar to go to. Place has some pretty good history too. Best little wh*re house in Rockland, don’t know if it is now, but it’s where the sailors and fisherman would get their daily catch eons ago.

this guy is no fraud/criminal…and BY LAW a bouncer is never to place their hands on a patron…let alone allow several other patrons to help eject the person. any bouncer with skills knows how to defuse the situation (whatever it may be) not make it worse. so many men take these jobs for the perceived power…I would guess that legally this establishment is in plenty of trouble. and if he was drunk…well, who served him?

I tended bar for nearly 25 years (and even in THAT bar many years ago…) in every certification class I took (mandatory for insurance) there was a whole section on diffusing (drunken) patron situations You are not allowed by law to touch anyone…your only recourse, if words fail, are dialing 9.1.1
…sorry didn’t answer the question! look under laws pertaining to the certification of employees serving alcohol.
