PORTLAND, Maine — Police say a Portland man accused of shooting a woman with a pellet rifle over the weekend had access to heavier firepower in his apartment building.

Police who used tear gas to end the weekend standoff say there were two assault rifles, a handgun and a hunting rifle in a common area of the building’s basement.

Brian Kelley did not enter pleas in his initial court appearance Monday on charges of elevated aggravated assault, aggravated assault and reckless conduct with a dangerous weapon.

Court documents indicate the pellet fired from Kelley’s second-floor apartment lodged in the victim’s chest. Kelley told police the victim was trespassing and deserved what happened. His lawyer told The Portland Press Herald that he questioned some aspects of the police report.

  1. Had access to heavy firepower, chose his own pellet gun, not the so called “common weaponry”, it’s an absolute wonder the cops didn’t blow him away. Total cop overkill. Darn right there’s questionable aspects of the police report! Raise the blue curtain please.

    1. For the love Pete, he could have killed that woman. How is that questionable? He needs to spend time thinking about that. Jail for him.
