KENNEBUNK, Maine — The Kennebunk Police Department will not release the names of people charged with being clients of an alleged Kennebunk prostitution operation until the state high court decides on an appeal.

Lt. Anthony Bean Burpee said no names were being released Friday, as originally planned, because of the pending appeal.

Attorney Stephen Schwartz of Portland, who represents two of the alleged johns in the case, unsuccessfully sought Thursday evening to get a preliminary injunction in Biddeford District Court to prevent the release of the names of people issued summons. Judge Andre Janelle denied the request Thursday evening.

Judge Janelle also denied on Friday a request by Schwartz for an injunction until the Maine Supreme Judicial Court makes a ruling.

Despite that ruling, Bean Burpee said Friday afternoon that the Police Department would not be releasing the names until the appeal has been acted on by the high court. Bean Burpee said the appeal to the state high court was filed in Biddeford District Court and will be sent to the Maine Supreme Judicial Court in Portland. A Supreme Judicial Court official said late Friday afternoon that no appeal had yet been received.

The names of the two people being represented by Schwartz are named John Doe 1 and John Doe 2.

“Plaintiffs will suffer irreparable harm if their names are released to the media by the police,” Schwartz stated in the appeal filed Friday in Biddeford.

The Portland attorney said the issues that the Judicial Court should consider are whether the release of the names violate the Maine Criminal History Records Act. The appeal also asks the court to decide if the “mere mention of names of those charged create a ‘public spectacle,’ prejudice the jury venire, and subject those named to severe, irreparable harm?”

The appeal also asks whether the names of alleged victims of the crime of invasion of privacy should have their names released to the press.

Charged thus far in connection with the alleged operation of a prostitution business out of Kennebunk are 29-year-old Alexis Wright of Wells and Mark Strong Sr., 57, of Thomaston.

Wright, who operated a Zumba dance studio in Kennebunk, was indicted on 106 criminal charges. Those include failure to pay taxes in 2009, 2010 and 2011. Other offenses include engaging in prostitution, promotion of prostitution, violation of privacy with an inside device, conspiracy, unsworn falsification, evasion of income tax and felony theft.

Police maintain that she videotaped clients without their knowledge. Those videos have been seized by police.

Wright entered pleas of not guilty at a hearing Tuesday in Cumberland County Superior Court.

Strong was indicted last week on 59 criminal charges.

He also entered pleas of not guilty.

Those include 12 counts of promotion of prostitution, two counts of conspiracy and 45 counts of invasion of privacy with an inside device. The latter charges refer to the clients of the business being videotaped without their knowledge or consent. All the charges, except the two conspiracy counts, are Class D offenses which carry a maximum jail sentence of a year in jail. The conspiracy counts are Class E crimes which carry a maximum penalty of six months in jail.

No date has been set for a hearing before the Judicial Court.

  2. The police do not have the right to hold the names of criminals and release others.. That is the DA’s job and they got ordered to release them.

    2.  As long as there is an appeal pending before the Supreme Court, they Police cannot release the list.  If they were to do so, and the Court ordered the names sealed, the ruling would be moot, and the Police would be facing lawsuits.  Not to mention the same people on here crying foul for not releasing the information, would undoubtedly be on these blogs crucifying them for doing so.

        1.  The PPH reported that the district court denied the applicant’s motion for a stay (of its judgment denying the injunction) pending appeal.  If there’s no stay order from the SJC (and if an appeal hasn’t been filed, there’s probably no stay order), the only thing standing in the way of disclosure is the prosecutor’s discretion.

      2. The story says the supreme court hasn’t received the appeal yet, so yes the police are over stepping there bounds, Also the court ordered the list unsealed and released..

By releasing and reporting the names of the “Zumba Johns” is going to sell lots and lots of newspapers, because people want to know this information and the press has a duty to provide it, because they are the eyes, ears and voice of, we, the people. Read the Constitution.

          If the police, themselves, are on that list, and I suspect they are, then the public, through a free and open press, needs to know it immediately and respond, for their own protection, accordingly by seeking their immediate removal and police replacements, of course.

          In the meantime, I am going to be driving without a license until my appeal from the District Court, where they found me guilty for reckless driving, has been reviewed in Superior Court. Only then, using Kennebunk Police logic, will I accept the initial, District Court’s ruling to take away my license….??? According to Kennebunk Police, I’d be right….. Right?

          And, that is exactly what the police, here, are saying? …. Obvious, Judge pickers the lot of ’em.

    1. It seems that every time someone  commits a terrible crime authorities quickly add the full middle name. Lee Harvey Oswald, Jared Lee Loughner, John Wilkes Booth, Mark David Chapman,or James Earl Ray etc. Obviously the police want to quickly take the innocent off the hook from unwarranted suspicion. It will be interesting to if that happens in this case. If you are David Johnson for example-there’s more than likely several  of you in Southern Maine.- But, honey that ain’t me!

  11. wonder if the videos will be admissible? if not the list will mean nothing. charges will only be brought up against strong and wright for taxes and invasion of privacy.the johns will walk. i could make up a list of any names i want but without a paper trail (credit card transactions,checks etc.,) it means nothing.

  13. This is all a great big misunderstanding. These 100 or so folks thought they were going to a restaurant.  Zumba is so close to Zuppa-an Italian word for SOUP or CHOWDER. Most of these customers at the Italian eatery stayed about half an hour-more than enough time to have a heart warming experience. All Mainers love a good soup or Chowda!

The guys who have requested an injunction must expect that prosecutors won’t actually follow through and prosecute their cases, because this procedure and appeal to the SJC is otherwise just a delaying tactic.  The names of men actually charged in the district court are bound to come out once their cases are scheduled for arraignment and trial.

    In fact, what’s to prevent a news reporter, or any other person, from going to the Clerk’s office at the Biddeford District Court Monday morning and examining the docket and other filings for the names of people charged with engaging a prostitute?

        Really, there’s just no contest when you think about the competing interests and throw them on the balance:  First Amendment freedom of the press v. a criminal defendant’s interest in not being embarrassed.

Those who can afford to satisfy their sexual desires with many ladies (Some call the by other names), are very well off, and hold high positions, so do not really expect to see those names any time soon, or at least until after a few names are removed. Our damn legal system is totally corrupt.
    If our forefathers were still around they would have serious problems, but our current crop of sheep, along with the ‘politically correct society’ just do not care. Many fought and died for the freedoms we are giving up willingly.

When the Police and DA’s office know a politicans(rule maker) or judge is on the list then that position can and will be compromised. I have always believed that prostitution should be legal but it isn’t.  The press has no problem releasing the name of the alleged prostitute and the ‘white haired bearded dude’.   What’s good for the goose is good for the gander.   Everybody else who commits a crime has their pictures splattered all over the paper and news.   I am concerned most with the fallout the families will have to endure; they will need support and compassion!

  48. Mr Strong was, allegedly, astute enough to not only rent the space for this enterprise, but to arrange to (secretly) video tape the sexual encounters, producing a product that is highly marketable, and profitable, on the XXX video market these days.

  49. The Judge has declared the law and the police in Kennebunk, Maine are BREAKING IT.

    I think it is kind of neat that the Police can pick and choose what laws to obey. I suppose that means when I get my license suspended by a District Court that I can still keep driving until my appeal to the Superior Court is determined? NUTS!

    These guys are just, plain stupid, or taking orders from some pretty powerful, extrajudical forces behind the scenes. Fire ’em.  Fire ’em all.But, let’s see, who could those forces be? Hmmmmmmmm …. Kennebunk, Maine….HmmmCould it be!  No way…….. Wanna bet G.W. and his dad areon on that list? Anyone?Read the Franklin Credit Union of Omaha stories and how the old man liked to host Boy’s Town abductees at the White House for sex parties.

    I am looking forward to carefully parusing that list over in detail …. I  mean, name searching, bios, etc…… Yeah …..

    No, can’t let anyone know about that, can they. Most of the police are probably patrons. Wouldn’t surprise anyone based on this obvious attempt to cover it up until …. after the election, perhaps?

  50. The full release will be a economic stimulas  for Maine.. People will be comming from all over to report on this.

  51. So, the judge saw the list of names.. There must be someone “pretty important” on that list for them to be withheld…IMO any spouse of those involved should have the right to know immediately in order they could be tested for diseases they might have contacted from their lying cheating dirt-bag husband.

  52. it should be released under freedom of info but with a policticail year at hand that will not happen its evem if a list shows up not all the names will be on it it’s tanted maybe the fbi should look into this one

  53. I for one would like to see the names on that list.  But that would be for my own entertainment, I suppose one could say.  That said, I think the names should NOT be released. I would like to know if there are elected officials, judges, cops etc. but there are going to be too many innocent victims, i.e. wives and kids of these johns. These guys made a serious mistake and if the names could be released without hurting others, I would be all for it.

    My late husband made some mistakes and his name was printed in our local paper and parents wouldn’t let their kids play with mine etc. so I know, personally, how this can hurt the most innocent of victims. So to protect those who need the most protection, I can forego knowing the names. Who is with me?

  54. Why should the names be withheld?? They need to be released NO matter who they are!!!  If you don’t want your name associated and published for all to see then keep your nose clean…..just saying.

This isn’t Sesame Street and all that rattling about should/shouldn’t  is just so much hot air.     Wouldn’t at all surprise me if that Dear Johns list somehow gets lost or destroyed before it gets into the courtroom.  The court and PD and DA are all part of the city, as are some folks on that hit list, and everybody is gonna think long and hard (oops!  LOL) about destroying the lives and reputations of the people involved.

  56. They release the name and photograph of someone who shoplifts a roll of Toilet Paper.But a list of people involved in prostitution?ha!
