LINCOLN, Maine — The town’s newest restaurant will open its doors Monday after holding a soft opening Saturday, its owners said.
The Coffee Pot Cafe features an array of sandwiches and other dishes and is located at 293 West Broadway, the former home of the Pit Road Concessions Diner, which closed in April.
Shawn Phillips, manager of the Why Not Stop? convenience store and Sunoco gas station next door, said it will be good to have another restaurant in town.
“It will give people in town more options,” Phillips said. “I don’t think we have a lot of choices in town. It will definitely bring people to this end of town … it’s another option and something different.”
The restaurant’s owners, who declined to comment Friday, also own a Coffee Pot Cafe in Bangor at 652 Broadway.
“I have done, over the past two or three months, my own research in terms of talking to people whether or not they have heard of the name the coffee pot and I was surprised at the number of people who did,” Phillips said. “It is almost a brand name like a McDonald’s or Burger King.”
The restaurant is the second new business to open in Lincoln recently. Mainely Log Home Furnishings opened at 64 West Broadway last month. It specializes in Amish furniture and dry goods. A Dysart’s convenience store also opened on West Broadway early last summer.
Last year, the Coffee Pot Cafe of Bangor made news when its owners sued The Legacy Sandwich Shop of 163 State St. of Bangor over the use of the words “deluxe” and “superdeluxe” to describes its sandwiches.
Lawyers for the owners of the two rival Bangor restaurants that make sandwiches similar to the beloved Coffee Pot — a third and well-known Bangor restaurant that closed in 2009 — on Oct. 1 filed a joint stipulation of dismissal in U.S. District Court in Bangor.
The case will be dismissed by U.S. District Judge D. Brock Hornby “with prejudice,” which means it can not be resubmitted in federal court or refiled in state court.

beware if you happen to make an Italian sandwich in Lincoln and happen to use an ingredient they use.. you could be in court! Can you imagine suing someone over the word Deluxe and super Deluxe? and having it trademarked? tells a lot about someone…
Poppycock. The term of art Italian Sandwich is in the common domain and not subject to protection under trademark law. On the other hand, protecting one’s intellectual business property is always a prudent decision. It’s a shame that the original owners of the Coffee Pot establishment in Bangor failed–for whatever reason–to do so and then on top of that refused to sell the business and profit from the success of their business and royalties for the future. What did they expect?
Kudos to the owners of the Coffee Pot Cafe for making a substantial investment in Bangor and now Lincoln, putting people to and back to work and continuting the legacy of a great sandwich.
I had the great pleasure of passing through Lincoln on Saturday and chanced upon the second Coffee Pot. The line was out the door and a lot of happy people holding fantastic looking sandwiches were walking out with big smiles on their faces. I can personally attest the sandwiches are absolutely authentic, made by many of the same people that worked at the original and taste absolutely delicions. It’s a great legacy and only the Coffee Pot Cafe delivers the real thing.
“Putting people back to work” LOL!!! Put a Coffee Pot Cafe in every town and that will fix unemployment all these great $8 an hour jobs…LOL!!!!

Legacy makes a great sandwich too.
I have been a Coffee Pot fan for forty years, and the Legacy sandwich is closer to the original, not to mention did not go against Skip’s wishes for the name. Frankly, I will never go back to the Coffee Pot Cafe, it is not just about the sandwich, it is about the attitude of the owners. The Coffee Pot Cafe was not protecting its intellectual property, they were whining saying they were they only ones allowed to use someone else’s, I can’t imagine why the judge threw it out of court! lol
The case was dismissed as “the good doctor” wouldn’t admit that he served his good sandwiches to out of state customers- so the case did not have merit to be in Federal court where Erickson’s lawyer had filed it because they say they don’t have “interstate commerce”. Maybe the out of staters need to stop going there if they are not valued enough. I eat at the Legacy Sandwich, where the food and the people are great! I’m glad that they are not being bullied or harrassed anymore! Kudos to Legacy. What goes around- comes around, sometimes it just takes some time. I also feel bad for Skip- having his name and logo stolen from him after 80 years and then Coffee Pot has the nerve to sue after they had stolen it!
check it out. they did trademark those names. did them no good, as the judge saw this was a complete joke and threw it out. (yes i have some inside info and have seen the trademark letter that was sent to Legacy from the lawyers of the Erickson’s) Skip Rist, the original owner built that business and was for him to decide weather or not to sell it off. He chose not to. (my guess is had he tried, he would have had to produce real P&L statements to a new owner, and i am betting that he was able to pocket more by just closing it)

I can’t find an italian sub anywere in maine they always ask ham or roast beef HUH. this is what is in a true sub -genoa salami, capicola, ham, mortadella,provelone cheese, oil and vegies i just make it myself at home
I thought it was just me!! Ask for an “italian” sub and you get a glazed-over look or, worse, “what kind of an italian sub?!” I was not aware there were other kinds of italian subs! Not that it matters much anyway…most of the places I’ve been to, it’s all about the bread (to them, not me!) and less about the fillin’s, like a 70% bread to 30% fillin’s ratio. So sad.:-D
And, the last thing you’d ever ask for in the original Coffee Pot was a “sub” — the owner would go ballistic on you! BTW, are all of these copycats doing the onion overload that was the hallmark of the original? *choke* Yup, heartburn!!
Are you owner of The Legacy Sandwich Shop or related to them? You seem to have an awful lot to say about the The Coffee Pot Cafe. By the way the The Legacy’s soups are way to salty.

I wonder how receptive Lincoln will be to the high price tag. When the Coffee Pot Cafe opened, I was quite surprised by the jump in their prices. I now happily frequent Legacy.

“No Comment” from a new business (at least location-wise)? Not a very professional way to greet the new community. And yet CPC will want the people of Lincoln to patronize their new shop? I don’t get it!
Eventually one or the other will tire of these subshop wars. The bright thing to do is to combine forces between the two ownerships. Then they’d have three locations, two in Bangor and one in Lincoln. Of course, maybe all this free press has just been part of their insane plan!

I would think that the owner declined to comment simply because he does not like the coverage the BDN has given his court battle. I wouldn’t take a life time supply of free sandwiches from the good Doctor. He’s not a nice person.
