ELLSWORTH, Maine — An Otis man just couldn’t take the hint after repeated run-ins with police about drinking in public Monday, police said, and is in jail without bail awaiting a court appearance Wednesday.

Ellsworth Police Officer Kelvin Mote first responded in the early afternoon to a call of a man walking down High Street — Ellsworth’s busiest throughway — drinking a bottle of Budweiser in plain view. He warned the man, Benjamin Foster, 30, of Otis, and sent him on his way.

A short time later, around 4:10 p.m., Mote said he caught up with Foster again on Oak Street. He was still drinking, Mote said, so the officer issued Foster a summons for drinking in public.

Police were called again around 6:30 p.m., this time by Collier’s Nursing Home on Birch Avenue.

“We got a call from Collier’s about a suspicious man hanging around out back, seeming drunk,” Mote said Tuesday. Employees said they had spotted Foster drinking outside the nursing home, and Foster found the man and an empty bottle.

Foster was arrested on a second charge of drinking in public and subsequently searched. Mote found a bag of marijuana on the suspect, who also was charged with possession of a usable amount of marijuana.

Foster is being held at Hancock County jail without bail until his first appearance in court Wednesday.

  1. “Employees said they had spotted Foster drinking outside the nursing home, and Foster found the man and an empty bottle.”

Foster didn’t find the man, Mote did.

  2. I sort of can’t blame the guy. I know that after I visit my dad at the nursing home where he’s a resident, I feel like drinking myself silly . . . to keep back the tears.

    1.  He was seen supposedly drunk before being seen at the nursing home, seems he just ended up there, I doubt he knew where he was.

    1. Seems like this guys name is in the Ellsworth American, monthly….I kind of feel bad for him, he seems so lost at such a young age……..I hope he can finally find some help for his problems….maybe the judge can help him with that this time, I’m a firm believer that booze addiction can’t be fixed in jail……..get him some help, so young to be so lost……

    1. Other than the fact he was trespassing, I agree. He probably won’t be allowed a jury trial for such a small offense.

      1.  Probably ran back there cause he figured it’d be the only place he could toss one back on the go without Ol’ Bill breathing down his throat. I rather enjoy a stroll and a couple brews.

If he’s looking at doing any amount of time he can have a jury trial.

  3. There’s a man having a drink out on the town and he has a “bag” of weed!?

Go go gadget crime fighters! Lets get him boys! Yeeehawww!

Good thing, we got him lads! I bet he was just about to go in there and rough up some poor old ladies.

Now, lets hold him without bail!

  4. HANG HIM!!! you can assault an elderly person, steel their drugs, or rob a drugstore, but don’t drink a beer in public, or have a “usable” amount of pot!!!! I would like to know in who’s opinion, was he seemingly drunk??

  5. Meanwhile in another part of Maine news we have a pedophile out till next year on $100 bail. Make sense to me. …..NOT
