ALTON, Maine — An Alton man is facing criminal charges, including aggravated attempted murder, as a result of a domestic dispute involving a firearm at his home early Saturday, police said.
David O’Clair, 51, was arrested following a dispute with a female family member, according to Sgt. Roy Peary of the Penobscot County Sheriff’s Office.
O’Clair made his initial court appearance Monday at the Penobscot Judicial Center, where a judge ordered him held on $50,000 cash bail or $200,000 surety. O’Clair is incarcerated at the Penobscot County Jail.
Police were sent to O’Clair’s residence just before 3 a.m. Saturday after it was reported an assault had occurred, according to Peary.
O’Clair threatened his victim with a firearm and also assaulted her, the sergeant said. A firearm was discharged in the home, Peary said, but nobody was shot.
O’Clair was arrested and charged with aggravated attempted murder, aggravated reckless conduct and domestic violence criminal threatening, Peary said.

Now no bail and a stiff, long jail sentence? Please. Can we put an end to these assault/murder/domestic violence cases with the sentences they deserve, once and for all?

Yes we can and we are. There have been 3 Domestic Violence Homicide (DVH) deaths in Maine thus far in 2012 (Hampden, Waldoboro, Alton), way below the number in 2011. In 2011, we had 3 DVH’s (Amy, Coty and Monica) on June 13, 2011 alone. Please remember that suicide is never homicide and that DVH is only DVH if it is eather an intimate partner or a family member. A few people in Augusta cannot get that straight, though. Bail only needs to be provided in cases without public safety death risk under the US constitution. The great news is that Judges and bail commissioners in Maine are now smarter and the days of $60 to $2,000 DV Criminal Threatening bails are thankfully over. Jail without bail is both appropriate and Constitutional in cases such as this (criminal threatening with a deadly weapon) whether the knucklehead was intoxicated or not. Hats off to the Judge in this case for setting a $50,000 cash bail. That is the highest DV bail in the state’s history, and everybody needs to laugh at the inept and hapless defense attorney when he/she comes in and requests a bail reduction. This is a case of homicide in motion, and thankfully it was stopped. It needs to stay stopped.
