AUGUSTA, Maine — The former human resources director at Sunbury Medical Associates of Bangor claimed the organization’s CEO told her to hire only “young women with big boobs,” according to a complaint filed with the Maine Human Rights Commission.

Barbara Mann was fired by Sunbury Medical Associates, she claimed, for complaining about age and sex discrimination in the organization. A Maine Human Rights Commission investigator recommends commissioners find her claim has reasonable grounds when the panel meets Dec. 17.

Sunbury denies the claim, reporting that Mann was fired because of “lack of fit” and “negative interactions with employees.”

According to investigator Barbara Lelli’s report, Mann was hired as director of human resources in June 2003 and fired in September 2011.

Shortly after starting the job, the CEO, who is not named in the report, “told her that Sunbury had a ‘warm and fuzzy’ HR department and that [he] wanted to change that approach,” the report states, so the department was no longer a place for employees to “vent.”

Around June 2010, the CEO told Mann that “from now on, she should just hire ‘young women with big boobs,’” the report states. Before that, the CEO had made other comments about “big boobs” and “commended her on past female hires because he thought they were ‘cute and had big boobs.’”

The CEO, according to Mann, made other comments and engaged in behavior related to women that Mann found offensive, such as betting with his personal assistant how big her breasts would get when she was pregnant.

The CEO told the investigator he never used any term like “big boobs.”

In May 2011, the CEO told Mann he was hiring a woman who was a waitress to be assistant HR director. She was not the first waitress he hired, Mann reported.

When the new assistant was introduced to staff, she was “wearing a low-cut sweater which exposed her cleavage,” the report states. The CEO later called Mann into his office and told her he didn’t like the look on her face during the introductions. Mann replied that the assistant should “be required to wear appropriate business attire.”

She also told the CEO, according to the report, that two other women employees wore more revealing clothes when they felt they were out of favor with him, and that Mann had observed the CEO looking at their breasts “and that this situation made her uncomfortable.”

A few days later, Sunbury hired an attorney to investigate Mann’s comments. She refused to answer the attorney’s questions, believing the attorney could not be impartial. Mann also told the investigator she did not request an investigation, but rather only told the CEO about her concerns “because she wanted him to stop his behavior.”

Sunbury’s president threatened Mann with discipline if she did not cooperate with the attorney’s inquiry. The attorney issued a report on his investigation on June 13, 2011, concluding there was no basis to Mann’s claims. Mann was terminated by the CEO three months later.

The rights panel investigator’s report included statements from current and former Sunbury employees who made harsh statements about Mann, including that she was “mean” and “sarcastic.”

Lelli concluded that there was “at least an even chance” that Mann was fired for complaining about the CEO’s behavior, which is the standard the rights commission uses for finding reasonable grounds.

  1. I had an interview once with Ms. Mann for a position at one of the Sunbury facilities. I left the interview feeling very disgusted and discouraged. She was extremely rude and sarcastic during the interview. She insulted me regarding what I wore to the interview, indicating that it might be fine for some other office that employed poor people, but that a Sunbury office required significantly more expensive attire. When I left the interview, I was almost in tears, I couldn’t believe how ignorant she was.

    3. Wendy, I had nearly the same experience with Ms. Mann. She told me (wearing a high collar polo shirt with a knee length skirt) that my attire was not work appropriate. She stated ‘some men may like it, but their wives will not.’ It showed nothing and was not tight… I was dressed up for the interview and my mother had helped me pick out the outfit. I wasnt wearing what I thought I would be wearing to work in, I was trying to look professional!! I was so shocked by what she said I couldn’t even think of anything to say back…just sat there with my mouth open. I couldn’t believe some who worked in HR would make such awful comments. I have no idea about the CEO but she is just as guilty of being inappropriate. I was hired for another location…but only worked there for a short time. Luckily I never had to deal with her after that!

  2. Somehow this allegation seems too over the top to real. Making a statement such as that would be overtly obvious sexual discrimination and begging for a complaint.

    1. As someone who was sexually harrassed by this man I 100% believe this allegation. In the time I was his account manager he went through a number of administrative assistants for the same reason. He has a lot of power and a lot of people behind him. How he’s gotten away with so much for so long I am not sure. I wish I had spoken louder when it happened to me.

      2. As a previous employee of this place I can say with all certianty that both of these two are creeps. I witnessed the CEO on many occasions do similar things. He used to have staff meetings with the office managers of 3 of the clinics (all pretty girls). Over time they left and new less attractive people filled the positions….shocker no need for meetings at thistles anymore! Ms. Mann was nothing short of rude and boorish as well. If you have the resources look into sunburny versus… Can’t list all the cases….many people have sued and had similar issues but as part of settlement can’t say anything. Ther have been claims previously that have gone to court. CEO is a bully and uses poor tactics and has been to court more than once. All you people …and there are many past employees need to speak up! Call this person in Augusta. Once again good work sunbury! Only half of your original Doctors work ther now, you have closed the doors on at least 4 clinics….keep up the good work….pathetic.

If you truly had a complaint you would not have waited this long until someone with the same b.s. comes on in the newspaper with a tale that’s as old as a ‘hill of beans’.

        1. I wasn’t fired actually. I never worked for Sunbury, but rather was an account manager for a vendor they worked with. I was 20 at the time and was completely intimidated. If you’ve never been sexually harassed you have no place passing judgment on when a person feels it’s appropriate to speak out about it. I don’t know Ms. Mann and can’t speak for her character, but I can tell you that now that I am older and have a daughter of my own I realize the right thing to do is to make what happened known. I’ll be writing a letter to the board this week. I’m not asking for anything out of it, other than they know what kind of man is leading their organization.

          2. I was not fired …I quit..was begged to stay and offered more money. I am not incompetent. To be specific I left when I was told my patients HAD to go to sunbury physical therapy no where else allowed because we had to get the money…who cares where the patient wants to go…..I have been subpoenaed to testify vs CEO at least 3 times now in similar complaints from the office where I used to work. Simple solution for capt smith…go sign up as a pt in the 1st brewer office..oops it’s closed…..ok go to Orono…ooops closed….hampden…winter port…health works….closed! I also had to give a comment phone reference for the HR director prior to ms Mann. Ms Mann gave a poor evaluation despite the fact she never worked with the precious women……ms Mann is as pathetic as the rest I agree …but she is correct….

        1. I actually did call the Maine Human Rights Commission as soon as I read the article and was told the investigation was closed so they can’t add any statements. I plan on writing to the board this week to let them know about the incident. They can then decide whether they want to continue to have him as their CEO.

  3. Even if the CEO did act in this manner if she doesn’t have any proof it isn’t going to matter. My guess is there is a little truth to both sides. She probably was offended by his comments and as a high 6 figure CEO he probably doesn’t care. I know I don’t care.

  5. This is the second time in a couple of weeks I’ve seen an article involving allegations that someone running a business in greater Bangor said something almost preposterously offensive to someone else for no readily evident reason. Is it something in the water?

          1. Smart businesses buy insurance for such recklessness. I am sure Sunbury has an insurance policy that will pick up all legal fees and slap the CEO that hires that insurance co on the wrist. That slap will come over a steak and a beer at one of Bangors finest eateries while they joke about the whole thing. Sad but true.

  7. Taking the he-said, she-said aside, this woman is clearly hostile towards waitresses. Going from being a server, which is a difficult job in its own right, to a HR position does not seem that odd to me. I’m not saying that the particular people involved in this drama were fit for their positions, but to make such a statement will only cast doubt upon her case and make her appear elitist. Many waitresses have college degrees (and just as many that don’t are more than capable employees).

    What about working in HR requires any special skills besides common sense? They are both service jobs. One services patrons, another services a company’s hiring needs. Neither is above the other.

    1. Lol! Wait on people much? In this day and age, a competent HR person, much less a director, needs significant education and training to develop the organization’s human resource (no different than any other type of resource) and protect the organization from exactly this type of risk.

  8. my girlfriend use to work there. i never heard a good thing about sunbury from anyone. so glad she got out of that place nobody should have to put up with that crap in the work place. ceo hugged her right in from of me one day didn’t think much of it then but makes sense now . hope there is a lawsuit would love to jump on that cash cow . im sure a bunch of woman have stories to tell.

    1. Ever notice how the sign in front of a Sunbury medical facility ALWAYS says “accepting new patients”? There is a reason for that. My spouse started going there a couple of years ago. She went to 4 appointments over the first 6 months and even though she was charged for an initial “get acquainted” doctor visit she never once saw a doctor in all that time! She left after the 4th visit and found a much better healthcare provider associated with the Waldo County association. Sunbury also discriminates against people who have a need for pain management and refuses to accept new customers who are being treated for long term pain issues. In our opinion they are a terrible medical care provider and should be driven out of business. I know, this would appear to have nothing to do with the CEO discriminating in his hiring practices but I believe these situations demonstrate an inherently bad character flaw that should not be present in any facility which provides healthcare to the public.

      1. MANY places do not take on new patients for pain management and send them to pain management clinics. That isn’t unusual.

        1. It may not be unusual but it is wrong. In my mind you either provide healthcare or you do not. Yes, there are specialists available and that is great. However when a company has a global ban on certain conditions, that’s profit driven and has nothing to do (not) providing healthcare.

The turnaround of support staff in Sunbury’s offices (although, admittedly I’ve only been to 2 of their offices) is astounding and says something in and of itself, as usually a job in a medical office is something people want to hold onto until old age. Not there, apparently. The poor employees always just LOOK browbeaten. I’ve seen some wonderful providers leave that group too, while others are bound by their contract. Very sad situation.

  11. When I was interviewed in September of 2011 by Barbara Mann she was a really nice lady, pleasant an all! She hired me and shortly after wondered why she no longer worked there. Next thing i knew there was a new hr lady..young and pretty…she wasnt there for very long until she put in her two week notice. (wondered why she left) Next we knew they put another younger lady who had just had a baby recently at that time in charge of HR. Slowly i started noticing how quickly that office was going downhill..they were firing like crazy. in the year alone that i worked for Sunbury they went through 16 people!!! I was number 16!!! that was only in ONE office of the many locations they have. I’m happy to say i’m no longer a part of the company there! Because they fired me as well…made lies and tried to fight to not pay me the unemployment i deserved. David once made a comment to me an another ex-employee “it’s all about the money” No!!! Its ALL ABOUT THE PATIENTS is how it should be. I’ll just add i noticed that one of Davids close employees he favored at this office would always be wearing a thong that when she bent over it’d stick right out! THATS NASTY! and inapropriate none the less! I’ll say this its unfair to the patients who go to this office to be treated and lied to like this let alone embarrassed that they go to a Medical Facility that has a CEO who is a pervert!!! I’m not afraid that my name is shown as a post here. Because this company has been nothing but hell since i’ve worked there and was fired 3days before my one year! They did not want to pay me my bonus nor my raise..and i busted butt when i worked there. I miss all of my patients there!!!!!!

      1. I totally agree. My husband and I were long time patients at the Corinth office. Over the years things were getting worse. The staff their are rude and act like you are bothering them when you call for a question. They have policies there that make no sense. When we both left it was such a relief. You shouldn’t get stressed out just calling your primary care physician’s office.

        1. I was a patient at the Corinth office. In 2006 I was hospitalized for severe stress and was put on some heavy medication. I was told to follow up with my primary. A few days later I was having severe side effects and called my PCP and was told, by the nurse, that he would not help with those meds. I was left without a doc. I am now off all medications and have a new, wonderful caring doctor in another town.

        Sunbury has had providers and employees jumping ship for quite a few months now, and it’s not just because of some boneheaded CEO with a breast fixation. It’s a sinking ship for many reasons, but I guess it’s just easier to blame the women who ‘stunk’ at their job.

    2. Ginger,it’s a fact that these types of organization’s eventually self-destruct thru arrogance and lawsuit’s. What Sunbury’s Board of Director’s had better start really worrying about is the very likey criminal investigation and indictment’s coming down the road that’s going to have both their lawyer’s and whoever their insurance carrier is running for Canada in under Olympic time. The fact that this one office went thru 16 women in less than a year, and all of them being let go just short of their year and bonus, and the one’s still there having to subject themselves to the ‘thong thing’, is going to eventually have one of these ‘thong girl’s’ finally get fed up and make a formal complaint of sexual harassment and assault against Sunbury. The minute that that complaint is made the real circus is going to begin. A corporation being charged with a sexual assault is automatically cause for the company to be subjected to a massive sweeping investigation by the AG’s Office (if they have the ‘stone’s’) regarding what happened and the busines environment that lead up to this. You can bet that Sunbury’s Board of Director’s is going to throw, not toss, the current President and Barb Mann under the closest bus they can find. And this doens’t even begin to cover the ripple effect it’s going to have on Sunbury’s other areas of business. Maine Human Rights Commission gets into this and starts looking under rock’s and desk’s and you can bet the farm that Sunbury’s lawyer’s and their insurance carrier is going to be right behind. Barb Mann, by NOT DOING HER JOB, is going to have Sunbury hanging on the closest flagpole the Court’s can find. And this doesn’t include all of the other civil suit’ that are going to come out of this. Who says Maine isin’t a fun place to be ?

      1. If the courts were speedy and evidence was more tangible perhaps. This company with a CEO at the top that may have acted inappropriate has nothing to fear. If all allegations are true the CEO will get nothing more than a reprimand from the board and I doubt that.

Civil court judgement’s regarding sexual harassment, not to mention the Court’s realization that corporate responsibility for the health and welfare of the corporation’s employee’s, are now a matter to be both taken seriously and financially, are a major reason why so many Corporate insurer’s are REQUIRING their client’s to undergo some form of sexual harassment training. Public or not, Sunbury is gonna get bent over the financial sofa and reamed on this one the minute that ANY FORM OF HARASSMENT OR EMPLOYMENT DISCRMINATION IS FOUND. What’s so bad is that this whole mess was completely avoidable if Sunbury’s Corporate HR folk’s and their Board of Director’s had acted responsibly when the employment stat’s were looked at, objectively, and the trend’s seen and some DUE DILLIGENCE applied and some basic question’s asked. Those questions not asked are gonna be the most expensive question’s not asked. And the settlement is gonna be felt by Sunbury for year’s. I, for one, would not like to be at the next Annual Stockholder’s Meeting and be responsible to answer the inevitable “Why did this happen and who’s responsible ? ” question

The sad part of this story, you have “excellent” heath care providers working for Sunbury that do care about patients and show respect for their patients and to be tainted with this reputation, lets hope it doesn’t hurt their business.. This CEO is not a doctor he is a business man. It’s the docs that brought in the money.
            This outfit is NOT terrible, you think you’re going to get better care go to Penobscot Community Health Center- but good luck they don’t kill you in the process.

        1. As I have stated….my family is familiar with Sunbury. Family of 5 receives care at Sunbury. We have seen many healthcare disciplines …….some women and some men. As I look back , many shapes and sizes. It appears Barbara Mann is disgruntled. We receive excellent quality care in warm friendly caring environment.
          We are disappointed in the closing of clinics and perhaps could have been handled in a different manner. But with today’s economy we do understand the changes that need to be made and we all need to a little sacrificing.

    2. Where does it say the complainant wants money? Yes, she probably would like compensation for being out of work. But if she’s telling the truth, of course she should get something.
      Some complainants simply want their job back and the perpetrator disciplined.
      And some complainants simply want something on the record vindicating their claims.
      And still others want to ensure what happened to them doesn’t happen to somebody else.

  13. Ms Mann was never “warm and fuzzy” but she was 100% on with this one, and I pray she has firm documentation to make her case. Every part of this story is true, and any one who spoke up was threatened or fired, trust me, you can’t make this stuff up. Fact is stranger than fiction! I saw it all first hand, or heard it from first hand witnesses. It’s been a long time coming. I am thankful that this day has finally arrived!

  14. The turnover at Sunbury has been huge for a long time. They always used to have ads in the jobs section of the paper. All the time. Something was/is very wrong there.

  15. As a former Sunbury employee I believe this information is 100% correct. Personally, I had found Barbara Mann almost intolerable as she was a puppet for the CEO in question for a good many years turning a blind eye and allowing this treatment of women to go on within the organization, however, what was worse was than her was the CEO himself, who constantly made offensive, degrading comments. Shortly before I resigned the CEO called a meeting with all the members of our department (professionals- all with Masters level or higher clinical degrees who provided direct patient care, and all of whom except one also happened to be female) and proceeded to tell us that our pay was being drastically cut, but, that we should be thankful since our jobs were flexible and allowed us to work around our children and daycare and calling in sick all the time. Nothing could have been farther from the truth – some of the women didn’t even have children, and those who did, like myself – had outstanding attendance records…my children didn’t even go to daycare and I’d only missed one day of work in two years. He was sexist and always made me extremely uncomfortable and disrespected and his comments were the primary reason I resigned.

        1. What good would it do? Passed off? I hardly think so in this day of looking x-eyed at a person opens the door for sexual harrassment suits. It opens the possibility of suits against the company and the offender himself. Personally I’d would probably have quit then filed a suit but I guess some would simply rather just complain about it then do anything.

      1. Personally I had no interest in continuing to work in an atmosphere that was so disrespectful to women. And, in my profession, I did not find it difficult to find another job easily and was relieved to no longer have to work in that type of culture – so no, I did not feel the need to file a complaint, it was much easier to just move on. Most of my co-workers at the time did the same. I did mention on several occassions to my direct supervisor that I found many comments made by Sunburys CEO (often times in the presence of the former HR director who sat in on several meetings) to be offensive and ultimately again mentioned the culture in my exit interview, including in writing in my resignation letter. It was just not a good company to work for, and after a brief stint as an employee I happily moved on. If you are really curious Maineiac123 ask a few patients if they’ve noticed a high turnover of providers while under the care of a Sunbury practice….it’s not hard to get a new job as a health professional – check the want ads if you need more proof.

    1. I can think of two reasons: (1) There are no editors anymore, (2) The paper is so concerned now with producing a large volume of stories with a smaller staff that no one can be bothered with doing actual reporting.

  18. I just spoke with the current HR director at Sunbury Medical. She assured me that everything is being run in a professional manner on her watch. She is a brilliant and talented individual who would never turn a blind eye to this kind of behavior. She told me that she has never seen the CEO display anything but pure business and professionalism. Sounds like just another disgruntled employee to me.

    1. Yes, because calling up the current HR director obviously negates what appears to be years of sexual harassment.

    2. Oh sure. I’m sure she wouldn’t say the pig has kept it going since she was hired. 4 shareholders left….Careful Dave.

  19. This guy has creep written all over him. He frequents a restaurant I worked at and literally will request a female server. He will even look at the seating chart and pick out his favorite gal (or one of the only few who will put up with his inappropriate hugs etc.–$$$) … he comes in w/his wife (who’s surprisingly age appropriate for him and very sweet) … and he also comes in with his young ladies from work. He tips more when he’s NOT with his wife (gotta impress the youngins) … and he makes sure to park his Benz right next to the front door (NOT in a parking spot) I never know his title, but as soon as I saw the headline of this story, I knew it was him. Gross.

  20. Sound like sour grapes on this one. like maybe this gal is trying to cash in on a made-up tale after getting canned. She worked there for seven years — didn’t just quit in a huff after a couple months of all that supposed rude behavior. Now, according to a genuine human, word is the woman was not cool at all.

    Of course, there’s as much chance that the CEO really is a rude horndawg and mutton head who made strange remarks — some guys let being the ‘boss’ out in limited work areas really go to their heads (yep, both heads).

    She say — he say — and the truth lies somewhere in between.

    1. “liberal women” — ah right, those women who want to be treated like capable PEOPLE, not just filled-up bras.

    2. What one does or says around the kitchen table (or bedroom, for that matter) should stay there. The workplace is a public forum…get a grip.

  22. I don’t know about Sunbury, but would not be surprised. About 7-8 years ago, I interviewed for a clerical position at an area eye clinic, and was told that if I were offered the job I would be expected to wear skirts and dresses, and that what I was currently wearing would be considered inappropriate- (I wore a suit to the interview: dress slacks, blazer, button up blouse). I was incredulous, and asked why that was the case, and the HR person interviewing me said that it was Dr. So & So’s (the director of the clinic) preference! I nearly laughed out loud! Instead, I said that I didn’t want to work anywhere like that & thought it might be illegal to ask that of employees. Maybe not illegal, but disgusting.

  23. Years ago, a friend of mine was forced from her executive position at a large Maine non-profit. The new CEO had hired a stable of men who produced a threatening environment. After my friend left, I advised her to file suit against the company; she, ever the loyal foot-soldier, couldn’t countenence harming a company whose mission she deeply believed in. I sympathize with the woman in this article. Some men in power still reside in the “Madmen” era.

    1. Seems someone just did… it is the new wave of investigative reporting – get the ball rolling and let the anonymous readership do the dirty work.

  24. I know someone that worked there and said that Mann did not like anyone that stood up for them self’s. This person was told she had made mistakes weeks/months after they were suppose to have taken places. That means no way to prove if they did or not. Than Mann changed the way they were to to something and fired this person.
    This person met someone that still worked there and was told that after she was fired they changed back to the old way of doing things.
    With the high turn over they had with employees someone should have suspected something was going on.
    It looks like Mann, the CEO and the board put their profit a head of the truth.

As a former Sunbury employee, I must admit that my first thought was “it’s about time!” I’ve read the comments that are listed and can’t believe that people think that the HR director was making this up. Shortly after this gentleman became CEO, I realized that I was not going to be able to advance in the company and after a decade of service (yes, I worked very hard with the providers to maintain a high level of customer service for the patients) I moved on.
