WINTERPORT, Maine — A 24-year-old local man was arrested Friday night after he reportedly was driving his ATV while intoxicated at nearly three times the legal limit.

Jason Fogg, who has been staying at his father’s house in Winterport, came to the attention of the Waldo County Sheriff’s Office at 10:25 p.m. when dispatchers received a report of a domestic disturbance on the Boston Road.

“He was throwing things around inside the residence,” Chief Deputy Jeff Trafton said Monday. “It looks like he was arguing with his dad. He became belligerent and started beating on his dad’s truck. He jumped on a four-wheeler and took off.”

The incident was reported to police by a woman who also was at the home, Trafton said. When Deputy Kyle Wasiela arrived, he looked at the truck, which was not truly damaged, Trafton said, and spoke with the other people at the home when he heard the ATV coming. The deputy used a flashlight to signal to Fogg, the driver, and then yelled at him to stop, which he did.

“As he got off the ATV, it became very obvious to the deputy that he was under the influence,” Trafton said. “He was staggering and stumbling, slurring his words and smelling like booze.”

Wasiela asked if Fogg had had anything to drink, and Fogg told him he’d had “a few,” Trafton reported.

“The deputy said, ‘a few of what?’ He said it didn’t matter. He was going to jail anyway, and turned around and put his hands together,” Trafton said.

After conducting sobriety tests, Wasiela did charge Fogg with OUI. According to Trafton, Fogg resisted arrest when the deputy tried to put him in the cruiser, and he was charged with refusing to submit to arrest or detention. Fogg also was uncooperative at the Waldo County Jail, Trafton said, and jail staff used pepper spray and restraints to subdue him.

Test results from the Breathalyzer showed that Fogg had .23 percent blood alcohol content, much higher than the legal limit of .08 percent, Trafton said.
