ROCKLAND, Maine — Three people charged in connection with a Monday night, Feb. 13, robbery at an Owls Head home made their initial court appearances Wednesday, Feb. 15, while the victim in the case was sentenced to jail for violating a condition of bail.

The most serious charges were lodged against Jessica L. Elwell, 21, of Owls Head; and Derrick A. Bustard, 19, of Rockland. Elwell was charged with robbery, two counts of stealing drugs, assault, theft and two counts of violating conditions of release. Bustard was charged with robbery, two counts of stealing drugs and assault.

A third suspect, Kristi M. Hall, 22, of Owls Head, was charged with two counts of stealing drugs and one count of theft.

The alleged victim of the robbery also was in 6th District Court Feb. 15 to answer to a criminal charge. Kimberly A. Vieira, 37, of Spruce Head, pleaded guilty to violating a condition of release by having consumed alcohol while she was on bail in a pending operating under the influence case.

Vieira was sentenced to 48 hours in jail for the bail violation.

Vieira called police Monday night to report that she had been assaulted and robbed of prescription medications, her cellphone and possibly a debit card, according to an affidavit filed by the Knox County Sheriffs Office in 6th District Court.

The victim had visible bruises on her face and a bloody nose, according to the affidavit.

Vieira claimed she was visiting at Hall’s residence in Owls Head when Elwell and Bustard came in and Elwell attacked her. Elwell and Bustard then stole the prescriptions that included suboxone and clonazepam as well as the other items and the pair and Hall fled the residence leaving the victim alone, according to the affidavit.

The sheriff’s office report noted that Vieira was extremely intoxicated — a test later determined her blood alcohol level at 0.23. She was taken to Pen Bay Medical Center in Rockport to be treated for her injuries and then arrested for the bail violation.

The department investigated her complaint and found the suspects at Elwell’s residence. Most of the medication was gone, according to the affidavit. The other items reported stolen were found in Elwell’s residence and vehicle.

The court papers also note that sneaker treads found in the blood where Vieira reported being attacked matched Bustard’s sneakers.

Judge Michael Westcott ordered Elwell held without bail on the motion sought by the district attorney to revoke her bail on a previous operating under the influence charge that is pending. He then set bail at $10,000 cash or $50,000 surety on the new charges.

Bail for Bustard was set at $500 cash and he was ordered to be put under house arrest. His father and older sister volunteered to watch him at the house where he must stay unless he is going to work.

Westcott told Bustard he was fortunate to have someone willing to be responsible for him.

Bail for Hall was set at $800 cash and she was ordered to report daily on weekdays to Maine Pre-Trial Services and on weekends to the Rockland Police Department.

  2. Just going out on a limb here, but i would like to know how the “victim” is associated with these kids.. Seems to me, at first thought, this was a drug deal gone robbery. I mean hello, shes “just visiting” with a 22 year old i guess “friend”, when her two other friends show up, (maybe the ones with the money?) they beat her up, and leave her at Halls residence? Either this trio doesn’t have a single brain cell, or they didnt expect their older “friend” to go to the police. Just saying… Why else would she bring all the drugs in with her?

    1. 0.23 …. it could be she just fell flat on her face; I know I couldn’t stand upright if I was that loaded.

  3. The only requirement for bail shall be to insure the presence of the defendant.  Anything else is outside the parameters of the Constitution. Period.

    1. Seriously? You think the problem here is the “government created black market”? You’d also have to make all drugs free. A major part of the problem is these fools don’t have jobs, ergo; they don’t have money; ergo they rob people.

Drug abuse is growing at such a rapid rate in the State of Maine, if it isn’t dealt with quickly and aggressively no one will be safe in there home’s, apartments or on the streets!   We need to stop creating laws to protect criminals that hinder police efforts to seek an arrest!  I don’t want the police going around harassing innocent people but in the case of a known drug user or dealer etc. they need a greater support and less restrictions placed on them by the system!  We need punishments that are equal to and that fit the crime!  I want the streets rid of these people so my family feels safe at home and out walking!!!!

I put in 25 years(air intercept controller) in the US Military and 20 years as a civilian air traffic controller so please…don’t feed me the worn out, liberal “how would you like to be employed ” mantra. I have never been unemployed because I have a work ethic and motivation and DON’T EXPECT others to take care of me. I have worked since I was 13. I own my home. I have money in the bank. I have never been arrested and I didn’t look for cheap thrills through drugs. So save your sanctimonious rhetoric for your fellow bleeding hearts. I EARNED MY WAY and because of MY efforts I am VERY far from needing anyone to take care of me. I also do volunteer work and ES, I also contribute to charities….of MY choosing.That’s how responsible people go through life. These people who EXPECT others to take care of them (Before they try to help themselves) need to look no further than the mirror to see who should be responsible for them. Time for people to take control of their own lives. You should be thankful that there still are many people who do work and are responsible because if not for the taxpayers, there’d be a hell of a lot more people dining in soup kitchens.

  8. From what I’ve seen, in about 99% of crimes against a person, the “victim” has made some very poor choices that lead them to be at high risk of having a crime committed against them–ie. hanging out with dirt bags, drug abuse, etc.  
         There was a recent case in Rockport where a young man and woman were arrested on drug charges after selling fake oxycontin to a DEA agent.  In my opinion, they were lucky he was DEA.  This particular crime could have very easily led to a murder if  someone addicted to oxycontin had received the fake drugs.  Come on people–think about the choices you’re making.

  10. Yes, she’s pretty now, but not for long.  She’s ruined her life.  The charges are serious.  If she’s convicted, she’ll go to prison for a term of years  and then probably end up a crack w***e,  lose her teeth, destroy her nasal septum, etc. and die young.
