AUGUSTA, Maine — House Democrats on Tuesday plan to ask the Maine Supreme Judicial Court to issue a ruling on whether Treasurer Bruce Poliquin violated the Maine Constitution by actively engaging in commerce while in office.

Several weeks ago, Rep. Mark Dion, D-Portland, sent a letter to Attorney General William Schneider asking for his opinion on whether Poliquin had violated the state constitution.

The House member and former Cumberland County sheriff alleged that Poliquin, as sole owner of the private Popham Beach Club, engaged in commerce, which appears to violate Article V, Part 3 Sec. 3 of the Maine Constitution.

Dion presented more evidence earlier this month that Poliquin has been engaging in commerce, specifically that Poliquin is the sole owner of Dirigo Holdings LLC, and has been actively marketing and selling real estate.

In his five-page opinion issued earlier this month, Schneider wrote that Poliquin should “disassociate” himself from his business holdings and outlined steps the treasurer should take to ensure that he doesn’t violate the constitution in the future. He stopped short of opining on whether Poliquin committed any past violations.

“With respect to the Treasurer, any activities related to the active management of stock or other ownership interests should be handled by third persons in the absence of any authority suggesting that such activities are acceptable when undertaken directly,” Schneider wrote. “During the Treasurer’s term in office he should take steps to disassociate himself from the active management of any of the entities in which he is invested and any entities in which he is the sole owner or principal or agent.”

Schneider further wrote that the section of the constitution in question is “general and without limitation.”

On Monday, Dion said he wasn’t satisfied with the attorney general’s response.

On Tuesday, when the House is in session, Dion plans to file a “House Order Propounding Questions to the Justices of the Supreme Judicial Court.” If passed, the order would request the Maine supreme court to give its opinion on whether Poliquin’s actions prohibit him from continuing to serve in office.

“The opinion from the attorney general makes it clear that the Treasurer should not have engaged in lobbying the Phippsburg Planning Board on behalf of the Popham Beach Club, or overseeing his multimillion-dollar real estate developments,” Dion said in a statement. “If the attorney general will not hold Mr. Poliquin accountable, the responsibility falls to the Legislature which dictates our duty to seek guidance from the state’s supreme court.

“We have evidence that a constitutional officer has violated the constitution. You can’t break the law and simply walk away from it.”

Since the House is controlled by Republicans, it’s not likely Dion’s request will be approved but Republicans might be forced to defend Poliquin.

Poliquin has declined to talk to members of the media about Dion’s complaint, but during a recent Capitol for a Day event with Gov. Paul LePage in Madison, the treasurer said the attacks against him have been politically motivated.

On Wednesday, the Maine Ethics Commission is expected to rule on a complaint by the Maine Democratic Party that Poliquin failed to adequately disclose his finances.

According to the commission’s agenda, the staff recommends a finding that the 2010 income disclosure form filed by Poliquin did not comply with state requirements. However, staff did not recommend a penalty.

  1. Noooo….of course Bruce didn’t violate the State Constitution…wink, wink, nudge, nudge. He’s a “Right” honest man fer sure.  Just ask Paul LePage he’s already served as a character witness for Mr. Poliquin.  Those two are like two peas in a pod.  Happily back “slappin” their way though life at our expense. 

      1. Well I’m glad you asked. Allow me to assist you. The AG already spelled it out for you. Sadly he doesn’t have the will to follow through on clear violations of law pertaining to the Maine State Constitution. We can hope that the State Supreme Court would have more backbone but from my understanding such a proposal must clear a Republican/Tea Party legislature to reach them. Sadly we know there’s no backbones or ethics there…well that will be the case at least up till next November. Therefore it’s my prediction that the dirt and stench of Mr. Poliquin will stick to these folks like glue and ultimately aid in all their removals. I’m good with that. Hang around as long as you can Bruce. Still’s “pullin” for ya!

          2. No.  That’s a serious question.  If Mr. Poliquin is in office against the constitution, can’t I sue him for making a decision as treasurer, take it to the supreme court and get him kicked out of office that way?

          1. I’d like to think that the r’s will kick him out if he is in violation of the state constitution. When they rightly went after others( democrats) who violated the public trust, I believe most of them have enough integrity to do so with Poliquin.Even though I am a “liberal”, I still have faith that the legislature will do the right thing this time.

No, I’ve never seen the AG in a wheel chair, have no knowledge that he has paralisis, and am sure that if it is so I should clean up my comment above to make sure no one else who is as involved with the AG as you are might be offended. I really, really mean this, thanks. But you could have passed this info along with a bit more niceness. Stay strong! Hard times are ahead for the conservative cause. You try to be cute and when people call you out on it you come up with all kinds of examples how people misinterpet what you say and hence they are the one in the wrong. So refering to spines and whiplash and the attorney general(who happens to be paralyzed) all in the same sentence is just a coincidence on your part? Yes Im sure it was.

  2. Mr Poliquin has been in the public light for the past three years. Why is it now that Democrats are after him? He has been serving as Treasurer for over a year and it is within weeks of him researching Maine State Housing that the Democrats attack him? This is nothing but a ploy to distract people from the corruption left behind by decades of Democrat rule.

      1. It is people like Treasurer Poliquin and Sen. Jon Courtney who are draining the swamp. Dale McCormick is nothing more than a partisan hack and the Democrats are sticking up for her. When Republicans started to investigate the disgusting misspending at MSHA the Democrats started attacking Treasurer Poliquin. It is nothing more than diversion tactics.

Poliquin is the state treasurer.He didn’t file his sons income but claimed him as a dependent, and wrote off his college tuition. Also didn’t claim income for his business.Everyone knows you have to claim all income wether you make large repairs or not.Thus he is not qualified to be Treasurer.

    2. I don’t think there is anything wrong with the Dems calling him out on this, as I feel there is warranted concerns. That being said, this is in direct response to the investigation of the expenditures in question at MSHA and the heat being turned up on Dale McCormick. Nobody from the left should even try to deny this.

Its a witch hunt when the purported crime is itself a fantasy, e.g., being a witch, or a member of the communist party.. the former being a fantasy and the latter something that is PROTECTED by the constitution.  This is simply an attempt to hold a constitutional officer accountable for his actions.. which the AG has already determined to be inconsistent with the Maine constitution.  Is it political?  Damn straight it is!!  What’s wrong with politics?  Its how we decide how to rule ourselves.  Should we just give that up and turn it over to a ruling class?  No way Jose!!

     For the good of the state, maybe they should turn their attention towards MSHA, DHHS, Maine Municipal Bond Bank, and some of the other unmonitored agencies that have been the recipients of the taxpayer’s largess.

We have a House Speaker, Robert Nutting, who defrauded MaineCare, a Governor, Paul LePage, who wants to be exempt from Maine’s Freedom of Access Act, and a State Treasurer, Bruce Poliquin, who flouts the Maine Constitution.  Who says there isn’t honor among thieves?  These Republicans honor each other’s rights to be above the law.

      Mr. Demerritt who had to resign because his pizza business wasn’t paying in the sales taxes he had collected from customers.
       
      Mr. Brown who had to resign when he finally got it through his head that he was breaking state and federal law.
       
      Mr. Congdon who was fired when he decided the best way to grow the economy was to blame the people of Aroostook County for their problems.
       
      Mr. Olsen who couldn’t get along with fishermen.
       
      And that’s just the first year.  Can’t wait to see what happens next.

Maybe some one should look into his dealings as Sheriff!  Now he’s sucking off the state and News Center is holding the Mic for the Blow Hard. Bruce is making waves and cleaning up the mess of 20 years plus and the poor Dems just cant handle it. Ask Dion how many gifts he got from the Pike。

  7. If Poliquin is found to have violated the constitution, he
    needs to go. I am in the opinion that he has. If you are going to take a
    position such as he has you cannot continue to run your businesses and turn a
    blind eye to the constitution that you have sworn to uphold. If he is also
    found (it is fairly obvious he has) to have used the tree growth program contrary to
    its intent and guidelines, he needs to return (with interest) any property
    taxes owed to the municipality he cheated.

  8. Love how people in the poll decided Poliquin didn’t violate the Maine Constitution. Let’s see…according to the Constitution the Treasurer can’t engage in business…Poliquin (the Treasurer) is engaged in business. Hence, Constitution violated.

  9. While they are at it, I hope they ask the court whether or not Baldy broke the law along with his Liberal pirates by using tax payer money to create a wind energy ponzi scheme.
