BANGOR, Maine — A longtime employee of a downtown business has been identified as the man who was killed in Saturday night’s fatal hit-and-run incident on Main Street in Bangor.

Joshua R. Constantine, 37, of Bangor was killed when he was hit by a car on Main Street near the entrance to Shaw’s supermarket around 10:30 p.m. Saturday, police said.

Bangor police took possession of a silver 2000 Pontiac Bonneville they believe was involved in the hit-and-run from a Brewer residence on Sunday night and said a woman who lives there is a suspect in the case. She has not been charged.

“The manner of death was blunt impact injury to the head and the manner is listed as accidental,” Mark Belserene, administrator for the state medical examiner’s office, said Monday.

Constantine was an employee of Herbal Tea & Tobacco in downtown Bangor and lived on Patten Street, said a friend who is a fellow employee.

“Today our family is mourning the loss of our best friend and brother,” the Herbal Tea & Tobacco Facebook page states.

The company’s Facebook page was updated Sunday to feature photos of Constantine.

He is survived by his daughter, Kaya, described as “the light of his life” in his obituary in the Bangor Daily News.

Bangor police went to a residence on North Main Street in Brewer on Sunday and recovered the car they believe was involved, Sgt. Paul Edwards said.

“We spoke to a person of interest who has developed into a suspect,” the sergeant said Monday.

She is cooperating with investigators, Edwards said.

The Pontiac is being processed at the police station.

The car was traveling toward downtown in the left-hand lane when Constantine was hit. There is no crosswalk in the area of the collision and police still are trying to figure out where Constantine was heading when he was hit, Edwards said.

“No one knows which side he came from or which direction he was heading,” the sergeant said.

The Zac Brown Band was playing nearby at the Waterfront Concert pavilion. Constantine’s friend said he believes that Constantine had been at the concert and was heading home when he was struck by the car.

It is possible that charges will be lodged against the driver, but it is up to the Penobscot County district attorney’s office how to proceed, Edwards said.

“It may be in an indictment form,” the sergeant said, noting the woman’s case could be presented to the Penobscot County grand jury.

She also could be arrested or simply charged and given a court summons, Edwards said.

Police Detective Larry Morrill is the lead investigator in the case.

The only crosswalks on Main Street near Shaw’s are at the junctions with Buck Street, five blocks to the south, and Railroad Street, one block to the north.

Local and state transportation officials may consider adding another crosswalk now that a jaywalker has died, Edwards said.

“It could, as a result, be added to the list,” the sergeant said.

Constantine graduated from Bangor High School, Tilton (N.H.) Academy and the Outward Bound Adventure program, “where his love of nature and his spirit were nurtured and cultivated,” his obituary said.

“Josh’s love for skiing eventually led him to become an employee of Sugarloaf Mountain and Attitash Mountain,” it added. “Josh was a lifelong rock climbing enthusiast who established many rock climbing and bouldering routes around New England.”

He had worked for 15 years at Herbal Tea & Tobacco, where “he greeted customers and artisans with kindness and enthusiasm,” the obituary said.

Visiting hours are scheduled for 5-8 p.m. Thursday at the Brookings-Smith funeral home, 133 Center St., Bangor. Private graveside services will be held at Oak Grove Cemetery in Bangor and a celebration of his life is planned for a later date.

    charges MUST be filed for leaving the scene of an accident where a death occurred.

    1. First, it was a crash, not an accident. Accidents are unavoidable. This was very much avoidable.

      Second, it is possible that the pedestrian had fallen before being struck and that the driver may not have even realized she hit a person.

      Let’s let the evidence play out before saying it “must” have been a crime and that charges “must” be filed.

        1. There’s a difference between running over and hitting. You make it sound as though there’s no question that the pedestrian was standing straight up and was hit square, between the car’s headlights, and that he went under, or that a tire ran straight over him.

          There hasn’t been enough information published to assume either scenario.

And why would there be ANY question as to whether someone would be arrested for hitting and KILLING a man,  then driving away from the scene of the accident???? It must have been a heck of a night.  I almost ran over a man who was walking in the middle of Ohio Street, stumbling about and acting strangely – right in the middle of the road with absolutely nothing on that would reflect.  Yes, I did call 9-1-1.   Not a lot of lighting on Ohio Street past the interstate – he was difficult to see until you were upon him.  I cannot understand with all the lighting, the fact there is A LOT of pedestrians around listening to music, that about 50 yards from the accident there is a huge place where people are crossing from the concert and the road is shut off to the right, speed limit is 25 (usually less because of the crowds) – how does one not see someone crossing the road?  How does one not know there is something going on down town and be that much more cautious around that area?  And how does one drive away from a fellow man whom you have accidentally harmed and not help?  If I had hit that gentleman in the road, it would be an accident.  I would hopefully be found not at fault, but you do not leave an accident you create, especially when you hurt someone, unintentionially as it may be.

  13. There were hundreds, if not a few thousand people walking down the street at that time. I know I was. It’s quite plausible that she got tired of waiting for the crowd to pass and saw what she thought was an opening and then sped through, hit him and got spooked and took off. 

    Drivers coming onto Main Street at that time were not going any where due to the throng of fans streaming out of the Pavilion. 

    1. Let’s say that a cross walks with traffic lights were installed at every block-with cars jammed bewteen them. Would that be safe? There is nothing on the other side of the street, that’s why the cross walks are so far apart.

I went to the concert and parked behind Shaws Supermarket.  Both my wife and I were surprised that considering the amount of people we didnt see one police crossing guard!!  We, along with about 60 other people just crossed when we had a chance…as vehicles approached they had to to stop for us!   

    The show was great!  The organization and set-up was horrible.  No one could find our seats (ushers included)   We laughed at security because 3 people were smoking in an area that didnt allow it.  Security approached the youung woman and told her she couldnt smoke there but left the 2 “rough” looking guys alone!  Again, Zac Brown put on a GREAT show!  Everything else from inside the gates to outside up and down Maine St was nothing but CHAOS!!!!

    I’ll attend another show this Summer since I already have my tickets.  However, whoever is in charge needs to put their heads together so this sort of thing doesnt happen again…next time it may be behind the gate!

      2. Have you ever been to any major sporting event or concert? Just because its Bangor, Me doesnt excuse the fact that 10-15k people flooded that area. UMaine even provides crossing guards for hockey games and you’re only talking 5k people at the most!

        The problem with your statement is the coast was never clear to cross the street. Again, the area was flooded with people and cars going in all directions…pedestrians arent going to stand on the side of the street for an hour waiting for the steady flow of traffic to stop nor should they have to.

    1. that would be my guess, or maybe she had illegal substances in her car as well and needed to get rid of those too, who knows. That would seem to be a rational thing to assume but it would be only an assumption. I admit, it was one of those things that crossed my mind as well when I first read this story.

    2. That seems most likely to me.  In this day and age of traffic cameras, everyone having a camera phone, etc, it’s nearly impossible to get away with something like this.  The only reason to run would be to avoid a DUI charge.

  16. Maybe the reason she has not been charged yet is because she only owns the car. They have not proven yet whether or not she was actually driving the car when the hit and run occured. People who pass judgment on cases that the facts have not yet been proven scare the hell out of me. It’s people like you that seem to never do anything wrong in life. Good for you.

Regardless if someone died on Main St, there should have been adequate pedestrian crossings at the signals.  There’s a pedestrian signal at the entrance of Shaws, but that’s for crossing the entrance to Shaws.  Why was there never a pedestrian crossing installed to cross Main St is one thing I wonder.  Having 2 pedestrian crossings 6 blocks apart and having only one pedestrian crossing signal not working properly is inedaquate.  The only thing that makes this an issue now is because someone was run down and killed crossing the road.  It seems to never be a problem until someone dies.

    1.  There is apparently no curb cut on the other side for wheelchairs. Something to check out.

You harm another person you just can not, if you have any respect at all and value for life leave a person to die without getting them some help.  Nothing excuses having no conscience and killing someone and being able to walk/drive away. Honestly though, with the way things have been going in downtown Bangor…call me crazy…but if someone stepped out in front of you and you hit them…wouldn’t you be afraid of getting jumped by any of their friends?  Granted, I don’t think leaving the scene of an accident is a smart thing to do, but I think she should have at least went to Bangor PD and reported the accident.  That’s slightly higher on the decency scale than just going right home.  But, I heard the person of interest is a minor, so, I can understand being so frazzled and freaked out that you would drive off.  Nobody stops and looks any more either.  Even at the crosswalks…if the light says “Don’t Walk”, they just walk across anyway, because they think they have the right of way…

Just curious, have any of you ever used those lights for walking at the crosswalks down on Main Street or anywhere else for that matter.  They have certainly changed a lot with the timer on them…Of course it would be nice if Bangor would make these timers useful.  I am a big guy, and my running days are far behind me.  I still walk fairly fast but i gotta tell ya, i get about half way acrossed the streed and it goes back to DONT WALK, so do i go back or keep going?  Am i J-walking because i was not world class sprinter?  What is the rule on this?  I remember Driver’s Ed and i remember being told that as a motorist, you are responsible to see all around you on the road, to make sure you are driving defensively.  A dog might run out in front of you, a deer, or a dimly lit country road, maybe even a moose.  I dont believe that any of them use crosswalks but i could be wrong.  We are also supposed to keep an eye out for motorcycles, and bicyclists, so why praytell, would we not keep an eye out for a PERSON, even if they are NOT in a crosswalk??

I may have disagreed with you before in the past, but you sure hit the nail on the head with this one.  I completely agree.  WE are responsible for our vehicles at ALL times as drivers.  That doesn’t mean someone might walk out in front of us and we can’t avoid them, but…I’m a firm believer that MOST accidents CAN be prevented by defensive and alert driving.

  22.  Only one crosswalk? I’ve never been to any of the waterfront concerts, but I’m assuming that a good amount of the concert goers must park up in the auditorium parking lot.  Why didn’t anyone at City Hall figure out that on concert nights the pedestrian traffic would be sheer insanity?  Who’s the Einstein that came to the conclusion that only one crosswalk is adequate for a huge crowd of people who have to cross Main Street to get to the parking lot(s)? This is crazy!

    1. Cross walks without traffic lights are dangerous as (1) drivers often don’t observe the law and stop, and (2) walkers get tired of drivers not stopping and then venture out into traffic.

  23. It sounds like hitting the pedestrian was an accident but leaving the scene of an accident is a crime. Why didn’t she stay put? Had she been drinking? Was she the person driving the vehicle when this occurred? all questions that I’m sure will be answered in the near future.

    Yeah before we go adding more Crosswalks, even though there should be one on all sides of a traffic signal, educate the public on how to use them properly first. I don’t know how many people in Bangor alone, stand 2 feet from a crosswalk and they can’t push the button to cross, heck they even put a sign there “Push here to cross” do something else with the money first.

How many drivers in Bangor alone completely ignore the bright green crosswalk signs and the need to yield when someone is in a marked crosswalk?  Being either a driver or a pedestrian requires taking some responsibility to keep yourself and others safe.  People are far too eager to point out the shortcomings of pedestrians (of which there are many) and to fail to mention the shortcomings of drivers (of which there are also many).

      1. I rarely see any drivers yielding to somebody in the crosswalk.  Even standing there with my baby in a stroller waiting to cross, people speed past.

    2. I was driving home last night and I turned left on to Hammond Street from Union.  There was an older gentleman that stopped at the crosswalk, pressed the button (while people had a green light to turn on to Hammond Street mind you!) and just as soon as my car passed, he started walking.  Lack of crosswalks isn’t the problem, it’s lack of common sense that is the problem.  It’s sad people can’t wait thirty seconds to cross.

    So to sum up–    If you’re walking, watch out for cars, cross at crosswalks, and don’t dart out in front of cars. If you’re driving,  watch out for pedestrians, (especially kids, drunks and people darting out in front of you) yield to them whenever possible, and if, God forbid, you run someone over– STOP!

  28. I have to say that even if this man walked out in front of the vehicle, whoever was driving should have stopped. When they drove off it was a crime even if it was the mans fault. I have a feeling the one that drove off was either under the influence or just has no regard for a life. Whatever the reason was, they should be charged. I myself do not live in Brewer/Bangor area, but I went to the concert the other night. I pressed the button to walk and waited and waited to find out it does not work. So we had to cross the road not knowing if a vehicle was going to be speeding through. I feel it is up to the city to make sure these lights are working to properly to protect the pedestrians and they also need to have more crosswalks and lights for them. I just hope that this will wake not only the drivers up but also the city. My heart goes out to the victims family.

      Really? You couldn’t watch for oncoming traffic and confirm whether vehicles were slowing/stopping before you crossed? Is society that pathetic that we cannot do this simple thing?

If you read my comment you would know I am not blaming Josh.  I am just stating what no one else would say.  It is easy to remember a person without faults but in reality his drinking quite possibly contributed to his death.  Now it is time to let the court system adjudicate this case and hopefully his family can have some sense of closure.

Or did you mean to respond to Appalachian? OF COURSE the driver should have remained on the scene. And NO ONE should be casting unsubstantiated claims about the deceased. Got it now?

  34. An accident when it happened, a crime when the driver just kept going.  How can you do something like this and just leave a person laying there??–

    1. He was jaywalking- There is no crosswalk there and he shouldn’t have been crossing 5 lanes of traffic at that spot. 

      That being said, it’s a horrible tragedy that he was killed- and it was a horrible thing for the driver to drive off- I’m guessing there was a reason she did and it probably wasn’t just panic at the accident, but panic that she had something to hide. Condolences to Mr. Constantine’s family and friends.

        1. If she had stayed at the scene- I doubt she would be getting the judgement she is now.

        1. I’d love to know why she sped off- and I’m betting at least one of the reasons you give is correct. 
          Josh WAS jaywalking, doesn’t mean he deserved to be run down and left in the road by the car that hit him. But he WAS crossing where there was no crosswalk, you can’t argue that- it’s a fact.

          1. I’ve heard she is a minor, but I’ve also heard she’s not. We’ll have to wait and see.

          2. the pedestrian light at the closest crosswalk is BROKEN. appears everyone must jaywalk to cross the street by Dunkin Donuts.

          3. There should be a crosswalk at Shaws as well as WORKING cross lights on all the crosswalks. 

          4. Yes, there should indeed be a crosswalk at Shaw’s. I’ve “jaywalked” there many times myself. 

  35. I have a friend who saw this from what she stated it was horrible! Why leave if you hit someone?  Its a little different if you hit a chipmonk or something! Isnt that street well lit at night? If memory serves me it is so I dont see how her excuse could be didnt see him or see what she hit! My thoughts go out to his family and friends, RIP.

  36. What a disrespectful thing to post online for family members to read.   His blood alcohol content is irrelevant.  The issue at hand is not the accident itself. It’s the fact that the driver “sped away” and left his body lying in the road.

      1. they have released the victim’s name, and decided he was jaywalking, DESPITE the fact that the pedestrian light does not work at the crosswalk in question!  Seems to me he had no choice but to jaywalk.

          1. yes, there is a crosswalk at Dunkin Donuts, but the pedestrian crossing light doesn’t work. So if you want to cross anywhere near that area, including Shaw’s, you have no option but to jaywalk. Or walk six blocks to the next crosswalk.

          2. Aren’t you the person who went down yesterday to check it out? I think I remember you as saying there is no crosswalk at the light at Shaw’s, right?

          3. Yes. I drive on Main St. almost every day and had never noticed there was no crosswalk so went through there and looked.

      2. It is not benefiting anyone other than people who commit crimes should not be able to hid out.  Lets’s put her in the stockade in the middle of town and hang a sign from her next that says killer

Hit and Run is a crime rather it was driver error or pedestrian error…  I was thinking that she may have left to cover another factor, like drinking,  but now that I read she may be 16…  she probably got scared and left.  Either way charges should be filed soon, but I don’t think she should have her life defined by this error in judgement…  especially if they find it was pedestrian error and her mistake was being a scared kid.      I am good with them withholding her name at least until fault and circumstances have been determined.

  40. She had to have been speeding.  I honestly dont know how she could have not seen what she hit. I was working downtown during the concert and the streets were line with people…there had to have been a lot of witnesses.. Must have been if they found her car the very next day!  i was thinking how horrible it was because if she had stopped maybe he would still be alive.  Although I hope with all of the people down there that someone called the Police immediately

    1. Why did she have to be speeding? If you hit someone going 25mph the outcome is not going to be good.It was dark, that’s how she might not have seen him. I’m not defending the driver as she clearly sped away from the accident scene. If she were sober and Mr. Constantine was illegally crossing the road she would be in the clear. There are so many scenarios that could have occurred that we’ll all have to wait for a grand jury indictment that will more likely come soon.

        1. I’m certainly not one of those TV accident reconstruction experts, but I’m pretty sure that 25mph would be devasting to most people. I hope going forward that the city takes some serious measures to not have this sad story repeated. 10,000 people, some impaired- need some special precautions taken on their hehalf.

    2. Hello…. Yes she must have been speeding. Who cares if he was intoxicated…he was walking home like he should have been. It’s pretty hard to run over someone going 25 miles an hour and inflict those types of injuries. He may have crosses the street and possibly misjudged how fast the car was going. If she would have stopped like she should have this would all be a non issue…really a hit and run and people are defending this person. Cross walk or no cross walk this guy was run over and left…it’s disgusting that this is even being debated.

It’s really frustrating that so many days have passed and there is no indication that the supposed “person of interest” is going to be charged.  I’m thinking she knew exactly what she was doing when she left the scene of the accident.  She, or her family, have had several days and probably allot of cash to make her “case” solid, minor or not.
