BANGOR, Maine — The hours leading up to the first Independence Day celebration since Maine’s new fireworks law went into place were relatively quiet, according to rescue dispatchers across Maine.
Though there have been two fireworks-related incidents in recent days, most of July 4 passed with no major incidents. Of course, most of the fireworks-related action was set to begin after dark, though rain and fog rolling in along the coast was set to dampen some of the festivities.
John Gamage, a dispatcher in Knox County, said fireworks in Camden had been postponed until Thursday and that organizers of the celebration in Thomaston were contemplating doing the same because of fog. Festivities in Lewiston and Rumford also were postponed until Thursday, according to the Lewiston Sun Journal. Fireworks in Oxford were postponed, according to the Portland Press Herald.
Despite a lack of serious incidents on Independence Day, police dispatchers across the state said Wednesday that there has been a spike in recent days of people calling to ask about the new law, which went into effect on Jan. 1. In some cases, they called because they wanted to use fireworks legally; in others the callers were reporting concerns about fireworks in their neighborhoods. In many cases, the latter calls required response by an officer, said Gamage.
“We can’t see them from here so we need to make sure,” he said. As for routine complaints, Gamage said he has repeated the same elements of the new law to several callers in recent days. They include:
• The use of consumer fireworks is restricted to between 9 a.m. and 10 p.m., except on July 4 and December 31 and the weekends surrounding those dates, when fireworks are allowed until 12:30 a.m. the following day.
• Users of consumer fireworks must have a landowner’s permission to use fireworks there, or face a civil fine of between $50 and $500.
• Users of consumer fireworks must be at least 21 years old.
• Fireworks are not permitted in state parks, historic sites and public lands.
An on-duty investigator for the State Fire Marshal’s Office could not be reached late Wednesday evening, though a dispatcher for the Maine Department of Public Safety said there had been no major fireworks-related injuries Wednesday.
On Monday, Gov. Paul LePage and State Fire Marshal Joe Thomas stressed fireworks safety during a visit to a new consumer fireworks store in Scarborough. LePage repeated his long-held rationale for advocating for legalized fireworks in Maine.
“It’s all about the economy,” said LePage to the Bangor Daily News. “There’s a demand, and we want to make sure there’s an adequate supply, that it’s safe, [and] sold to people that are of age within the law. And it creates jobs.”
The new law allows municipalities to enact their own bans on fireworks, which has been done in 36 towns and cities in Maine.
Improper use of fireworks has resulted in serious incidents recently in Portland and Richmond, according to reports in the Bangor Daily News.
On Saturday, a Sabattus man had to have 17 stitches above his right eye after he tried to dry water-drenched fireworks with a torch on Lancaster Road in Richmond. One of the tubes went off and Jason Douglass, 34, was injured.
On Monday, children playing with sparklers in a 22-unit apartment building in Portland caused a fire that displaced residents in seven of the apartments. There were no serious injuries, though one firefighter was taken to a local hospital for evaluation.
And last Friday, a Saco man was arrested for selling fireworks illegally. Gregory Jutras, 21, allegedly was advertising fireworks for sale on the Internet. Undercover agents met Jutras in the parking lot of the Maine Mall to complete the sale of 16,000 firecrackers and other fireworks. Investigators said they found more fireworks intended for sale in Jutras’ car and apartment, and he was issued a summons for selling consumer fireworks without a license, as is required by law.

Why not list them?
While it would be nice to see a list in print, any landowner should know the laws of the town he owns his land in, and you must own the land your using the fireworks on or have permission of the landowner. No one can claim the excuse that they didnt know thier town had an ordinance banning them, if thats thier claim then they need to be a little more responsible. Ignorance of the law is no excuse.

The incident in Portland had nothing to do with the new law. Sparklers were legal in the past. So stop trying to make it a story.

The law says 21 and up so kids shouldnt be touching them. How many kids die every year in NH of fireworks related injuries? not many. the 5 years I lived down there I never once heard of a fireworks death or any serious injury.
Bangor has had a lot of booms tonight but it has not been annoying, at least to me it has not. Right now it is pretty quiet in my part of town.
Quiet up here in The County too. Maybe they’re holding out for better weather?
Not that I mind the fireworks law, but if Mr. Lepage is basing all of his legalization decisions on economics then why hasn’t the commercialization of marijuana been pursued outside of medical means? I’m pretty sure that would raise some money for the state :)
Federal law trumps state law.
Federal law may trump state law, but what happens if a majority of states legalize? I would think that the federal law would have to be overturned.
Interesting question and one that I do not have an answer for.
The Feds already withhold money if you do not have an OUI law that sets .08 as the threshold for intoxication and money if you don’t mandate the use of seatbelts do I could see them threatening to withhold dollars if you legalize the personal use of marijuana.

Jump ropes – a child might tie the end to their wrist, get in a car, toss the loose end out a window and a care coming in the opposite direction might snag it and severe the child’s hand.

There have been a few serious injuries already in the state. I’m sure that there were more injuries that went unreported as well. The pro fireworks people that do get burned are not going to report that it was due to fireworks. The CPSC reports that there were 9600 injuries in 2011. I would put money on it that there were way more injuries that went unreported!
I get injuries nearly everyday that I don’t report. So what? I’ve got a black thumb nail right now. I don’t see us outlawing Estwings.
My point was that the fireworks industry uses these injury reports saying that fireworks are safe because they don’t cause that many injuries compared to other things when in reality they cause more injuries than we realize. To say an explosive is safe is just idiotic and it’s all about money.

The commercial display in San Diego went off in 20 seconds last night due to a “technical glitch”.
Several years ago in Bar Harbor they also had a “technical glitch” when the fireworks on the barge all went off at once.

Of the three reported incidents leading up to the 4th here in Maine:
1 was caused by sparklers which have been legal for years, and
1 was caused by an adult “drying” out soak fireworks (I would suspect that he would check to see if a gun was loaded by pulling the trigger too), and
1 was caused by an adult “chaining” fireworks together and touching off a single fuse. He was to close when the “chain” went off.
So where are the 193 additional injuries?
It’s 7.00 am July5 and the state of Maine has not burned down.
Not yet anyways, it was raining in some towns and some events got postponed. There is still a few more shots at this. Besides if the state burned down, it would be someone launching fireworks on a dry day doing something stupid like aiming them at a bunch of trees

Last night on my way home from work, going past Thomaston harbor, a bunch of teens (perhaps early 20’s) got out of a car in front of a business and shot off a bunch of fireworks right on the road – this was about 11 pm.

We must repeal this fireworks law.It in no way adds to entitlements so lets spend thousands of taxpayer money to stop this and other laws that do not add to our entitlement budget.paid and authorized by the moonbats against america
Must we complain and demonize everything???? Fireworks are now legal and will hopefully stay legal. I purchased a rather small amount(less then $100) of cakes and fountains. I enjoyed the show, my wife enjoyed the show, my father enjoyed the show, my very elderly grandmother enjoyed it and a couple of children at the camp next to my property enjoyed it. It was a fun time for us and everyone else in the state who used fireworks. Like any activity there are going to be mild incidents to major stupidity. Also like any activity I believe a majority are going to be responsible and safe and the minority are going to somehow try and find a way to ruin it. If you don’t want to participate in this now legal activity that is your choice. If you witness someone being irresponsible talk to them about safety concerns or inform the authorities if you feel the need to do so. Like many I am tired of the gloom and doom crowd. Life if to be enjoyed so truly enjoy it.

As far as fireworks goes I already know that the stores are selling to people under 21. My neighbor bought some he’s 19… Shoots them every damn night!!! It is very bothersome hearing this night after night…

I know the only thing people who work in Augusta, and Yes Mr. LePage were just thinking of money rolling in. And nothing else. They never once thought about us Mainer’s who like peace and quit… Something has to be done to better in force the laws on this… There’s alot of reps, and the Gov who will not get my vote next election…
