PARIS, Maine — A Cornish man who pleaded guilty Friday to choking a woman into unconsciousness in February will be released from jail Monday based on time served.

Tyler D. Smith, 25, pleaded guilty to aggravated assault in Oxford County Superior Court. He was sentenced to six years, with all but six months suspended, and was given credit for time served. Smith has been held in Androscoggin County Jail in Auburn since his last arrest.

He will be on probation for two years and must undergo a psychological evaluation. He isn’t allowed to contact the woman or her immediate family and can’t use or possess illegal drugs.

In an affidavit by Sgt. Matthew Baker of the Oxford County Sheriff’s Office, Smith admitted to Baker that he had choked the woman twice and one time was afraid he had killed her. Smith told Baker that he and the woman had been fighting for weeks and “things were escalating,” the affidavit said.

The incident took place in Hiram.

Smith also was convicted of violating the conditions of his release. Another assault charge was dismissed.

  1. WOW – THAT was a nasty sentence — 6 months — what is wrong with the courts now? I thought that domestic violence was not being tolerated any more – you can see those ads on TV — ZERO TOLERANCE —  did I miss something??

  2. Wow!  I have to get control of myself.  I am envisioning my hand around the guy’s throat, and I am ENJOYING IT.

  3. Gee, that ought to deter future assaults. Time served…………………….. way to go courts.

  4. By any standard, that is way too light a sentence for someone that could have killed someone else. Time served plus 3 days-really??? If anyone thinks that is the type of sentence that deters anything, they are wrong. Dead wrong. Unfortunately, someone could wind up dead, and it is the judge in this case who will be wrong.

  5. Of course he will obey all the requirements, to stay away from the woman, etc. If he has done it twice he will do it again. If I were that woman I would move and fast.

  6. Why do people who commit domestic violence crimes or child abusers get most of their sentence suspended. These are crimes with high recidivism. 

  7. I used to go to school with this kid and he was always troubled. I had hoped his troubled life would have ended after high school. Either way slap him with time.

Amazing even our pompous governor is behind longer sentences for these crimes and yet we continue to see light sentences or no sentences and the victims scared to death because they are back out on the streets.  We have obviously learned nothing about this from the family lost in Dexter.  He CHOKED her into unconsciousness…Why wasnt this charged as ATTEMPTED MURDER???

    1. Our governor (who you refer to as pompous) has no jurisdiction over the courts.  Until JUDGES take this seriously these things will continue to happen.  And you’re right- it should have been charged as attempted murder.

    He was afraid he had killed her?! What did the defendant believe would happen when he cut off the victim’s supply of oxygen? This is a violent and dangerous criminal, and he should not be given the opportunity to offend again. Since the judicial system fails to protect the public from violent domestic offenders, women, beware! The guy’s name is public record. If you meet him, do not give him an opportunity to make you his next victim! People like this generally do not “get better”, and their rage comes on like a wild storm. Friendship, and especially LOVE, should NOT hurt.

  10. These light slaps on the wrist are disgusting…who will this guy hurt next. We need a domestic  violence site, just as we have sex offender site- certainly this state does not protect people, they give them a pass right back into the population.
