DEXTER, Maine — Dexter police seized marijuana plants and cultivating equipment while executing a warrant on Friday morning, according to Dexter Police Chief Kevin Wintle.
Wintle, along with Sgt. Alan Grinnell, went to the North Dexter Road residence of Marcus LaFountain, 26, to execute a warrant for unpaid fines at 9:20 a.m. Friday, the police chief said.
Grinnell went to the front entrance while Wintle said he went to the back. Grinnell knocked on the door and identified himself as a police officer.
“He was coming out of the attic onto the second floor. He was going to exit out the back into the woods,” Wintle said Monday. “Before he jumped, I explained who I was and pointed the Taser at him and ordered him down.”
LaFountain cooperated, and the Taser wasn’t deployed, said Wintle.
While LaFountain went back into the residence to retrieve some clothes, Wintle said he could smell marijuana.
“We could smell a heavy odor of marijuana inside the residence,” said Wintle. “He gave us consent to search the residence. We found cultivating marijuana in one of the back bedrooms. We also found marijuana in the garage area.”
Wintle said 10 mature marijuana plants were found, as well as cultivating instruments and lighting.
LaFountain was charged with cultivating marijuana, a Class D misdemeanor, and was taken to the Penobscot County Jail in Bangor. He’s scheduled to appear in Newport District Court on Oct. 17.

Lessons to learn, here:
1. Don’t go back to the house, or inside the house, ever. No matter what. If the police show up with an arrested warrant and you are outside in your underwear, do not go back into the house. They can legally follow you and enter your home without your consent or a warrant… and, to get cloths? Apparently this guy has never done time before. They’ll give you cloths, so going to get yours is pointless anyway.
2. If they ask to search it means they need your permission. Its not a good idea to consent when you are doing illegal things. Smelling marijuana is not probable cause, as is proved by this article. If it was, they’d have just stormed in there and got it.
3. If you are going to have fines, its probably better to pay them then wait for the bench warrant to be issued. Especially if you are going to be growing marijauna.
The idiocy of people never ceases to amaze me.
Once they smelled it they had reasonable cause. Just stand around and wait for a warrant. They ask for permission first because that is the easy way. The guy was going to be arrested, it’s not like he would be able to keep them at bay long enough to destroy evidence, The police would have gone in there one way or another after smelling it.
Wasn’t very smart of him to give them consent.
A Police CHIEF AND SERGEANT went to execute a warrant for UNPAID FINES? Hmmmm. Some pretty high rank for a petty warrant. Suppose they already knew something was up?
Dexter is a small town with a small Police force. The Chief was probably in the Office and the Sgt was working the shift. Smart tactics if you ask me. Even “petty warrants” as you put them, get police shot or killed. Just my 2 cents.
Um, duh guys. Dr. Sulac down around Augusta will write you a prescription for pot. Then he has the choice to grow it inside of the guide lines all he wants. Problem solved. Pot head has renewable pot, isn’t on the street supporting street drug dealers that cause REAL crime, and pretty well is minding his own business. But I am sure that this one guy is what is wrong with America and that medical pot is just an excuse doctors give losers so they don’t have to write an opiate script. Honestly, I’d rather know my neighbor was smoking a bale of weed a night than knowing he was on oxy-whatever…

Just a word to the unwise: if you’re doing something illegal, don’t draw attention to yourself!
Make sure you don’t speed and that all lights work, pay all fines, no loud parties….Keep your nose clean and fly under their radar! That way, you’ll delay the inevitable.
