ELLSWORTH, Maine — Ellsworth police are wondering why a Washington County sheriff gave the authority of a sheriff’s deputy to a doctor who had not completed the police academy training required by Maine law.
Sheriff Donnie Smith deputized Benjamin Newman, 72, who operates a small practice in Winter Harbor and is contracted as the jail doctor in Washington County. The question of Newman’s qualifications came to light when he was charged with reckless conduct on Dec. 26 after leaving a loaded 9 mm Walther police pistol in the bathroom of the L.L.Bean Outlet in Ellsworth.
In a conversation with police, Newman said he did not have a permit to carry a concealed weapon, but produced a Washington County Sheriff’s Office ID card that said he is a “special deputy.”
There’s no indication that Newman ever asserted authority as a regular deputy or acted as a deputy in any way. According to Newman, on the back side of the ID, there is text that states he “is a qualified law enforcement officer of the Washington County Sheriff’s Office” and as such “is authorized to carry a concealed firearm.” Lt. Harold Page of the Ellsworth Police Department verified that language was present on the ID.
That text raised a few eyebrows at the Ellsworth Police Department. Maine’s law prohibiting concealed carry by those without a permit makes exceptions for qualified law enforcement officers, but Newman is a contractor with the county, not an employee of the sheriff’s office.
“I don’t believe he meets the criteria under the [concealed carry] law, the exception that’s made for law enforcement officers to carry concealed weapons,” said Ellsworth Police Chief John DeLeo.
Maine law requires training — including firearm qualifications on the range — at the Maine Criminal Justice Academy for all police, sheriff’s deputies and game wardens, but not special deputies. The academy keeps a record of every police officer, sheriff’s deputy and game warden who has qualified in the state. According to Eric Parker, training manager and assistant director at the academy, Newman’s name is not on the list.
While you don’t have to be a qualified officer to receive a sheriff’s office ID — civil employees also get IDs, for example — Parker said whatever identification is distributed is supposed to make clear whether the bearer is a law enforcement officer or simply a civil employee. Newman, a contractor with the county, is neither.
“It should not give any indication that he is a law enforcement officer, obviously,” Parker said.
Newman said Friday that he didn’t ask to be deputized and was unsure why he was given the ID, but said he figured it had to do with his previous employment as a deputy in Seminole County, Fla., and his 40-year service in the U.S. Navy.
“I am not a qualified law enforcement officer in Maine, but it didn’t ring any bells because, quite frankly, I didn’t read it,” Newman said in an interview. “It was something [Smith] did, and I was grateful he had the confidence.”
Smith on Friday defended his choice to deputize Newman. He said the doctor needs the ID to access inmates at the jail, and said he didn’t know the doctor had used it as license to carry a concealed weapon.
“I can deputize anybody I want to, at any time I want to,” Smith said. “He is a special deputy, but that doesn’t necessarily give him the right to carry a concealed firearm.”
Smith made that assertion despite the fact that Newman’s ID card calls him a “qualified law enforcement officer” with the “right to carry a concealed firearm.” The sheriff drew a distinction between “deputies” and “special deputies” and said he had no knowledge of Newman using the ID in place of a concealed carry permit.
Maine law allows sheriffs to name anyone 18 or older as a “special deputy,” but stipulates they may only be activated in times of war or declared emergencies. Newman’s ID is valid until an expiration date of Nov. 19, 2016.
It is unclear why Newman’s ID presents him as a qualified officer if he was only meant to be a special deputy. Efforts by the Bangor Daily News to get clarification from Smith and Newman have been unsuccessful because after initial interviews both men have refused to speak with a reporter.
Other law enforcement officials are confused by Smith’s “special deputy” commission.
In Hancock County, Chief Deputy Richard Bishop said that his office has only full-time and part-time deputies (who also must qualify at the academy) and civil deputies, who have the authority to serve paperwork but not the power of arrest or the right to carry a concealed weapon. His description of a civil deputy matches the state’s definition of a special deputy.
“We don’t have special deputies,” he said. “I’ve never even heard of that. All our guys are certified through the academy.”
Chris Gardner, chairman of the Washington County commissioners, said Friday that he is still trying to work out all the details of Newman’s special deputy commission, but said he had full confidence in the sheriff.
“It does seem odd to me, but I’d have to defer to the sheriff to explain it,” he said. “It’s his office that gives these credentials, but as commissioners, we’re as interested as anyone to see how this took place.”
Glenn Ross, Penobscot County sheriff and president of the Maine Sheriffs’ Association, said questions about sheriffs following protocol are ultimately for the voters to decide. Ultimately, a sheriff is accountable only to residents in his or her county and the governor, who has the authority to remove a sheriff under extenuating circumstances.
“Politically, this could be a problem, but I don’t know whether the governor would take a position about a person being trained or not,” he said Wednesday. Ross also said ensuring appointed deputies are qualified is among the most important duties a sheriff has while in office.
“Once you give someone this authority, you’re giving them the broadest authority to make arrests, use deadly force,” he said. “You want to be doing that only if they have the training they need to have. That’s a paramount responsibility of a sheriff.”
Newman works only a handful of hours per week at the jail, Smith said. He will not be reprimanded for the reckless conduct charge, the sheriff said.

So basically this Smith guy is deputizing people without knowing how much power he is giving them. He hasn’t even read the card he hands out??!?!

But the law says he can only deputize in events of a declared emergency or war, so I am curious what event took place that warranted this. Does this mean just Washington County has special deputies running around and maybe the next time I visit someone is going to yell “Police, pull over now” from a rusty Chevrolet?

I’m not opposed to firearms and concealed carry permits, but I have a little trouble accepting the idea that a medical doctor can be an armed law enforcement officer.

If the comments in this article were not so incredulous it would be humorous. It never ceases to amaze me about human nature. All of these law enforcement officials had no comment on the assault weapons after those senseless homicides in Conn. None of them had any words of wisdom/criticism when Sheriff Glenn Ross told his friend, Bob Carlson, aka the sexual predator, that HE was under investigation, which may I remind everyone, lead to his suicide. NOW that Sheriff Smith is under scrutiny, they are all commenting on this article. These other law enforcement officials have an axe to grind when it comes to Sheriff Smith as he disagreed with the findings of the Maine State Police in regards to the Bob Carlson investigation. Sheriff Smith departed from the Maine Sheriffs Association when he realized that it was going to be the “ol boys network” when they circled the wagons around Sheriff Glenn Ross. Do they think the the public has such a short memory? These men didn’t think that Sheriff Ross did anything illegal or immoral and none of them had anything publicly to say about it. NOT ONE WORD! If Glenn Ross wasn’t prosecuted or asked to be relieved of his duties by the Governor, Sheriff Smith surely won’t. All he did was give a Doctor credentials to get into the WCJ and the Sheriff states that he had no idea that the Doctor was using it to carry a concealed weapon. I wonder did the Sheriff himself give that ID to the Doctor or did the jail personnel type it up? It really doesn’t matter because Sheriff Smith has already taken responsibility for giving the Doctor “special deputy status”. Wouldn’t it be nice if Glenn Ross would do the same in the Bob Carlson investigation?

Sheriff Smith is the one who discovered it! He is the one that reported it to the Commissioners and the Attorney Generals office, did you even read the article in its entirety? If so, did you understand it?
Oh I did….and it happened on his watch. Just like the Doctor with they “special Deputy” credentials with the full “LEO” powers including concealed carry. It happened on his watch but so far he isn’t taking responsibility for it.

Glenn Ross in my opinion should be prosecuted. But..in his defense as far as this article is concerned, he didn’t seem so side with or against you.. Oops, I mean with or against Sheriff Smith.
This is not about deflecting to sheriff Ross. It is however about a Sheriff making the wrong decisions like making a deputy of someone who should have not been able to carry a concealed weapon… And why he had the badge to begin with? Regardless, it is stupid to leave a gun in a public bathroom. A child could have picked it up and tried it on himself or someone else. Obviously the doctor is not capable of carrying a loaded weapon on his person….he is irresponsible.

If I were a doctor working on jailed inmates I’d certainly want a concealed weapon on me. Just having all the prisoners know that every time I walked in I was packing heat would make me feel safe.

Why did this doctor feel the need to conceal a weapon going to LL Beans? I am not for gun control, however, I may be for some moderated steps. I know a 24 year old girl applying for a concealed weapon permit. I wouldn’t trust this particular girl with a water gun and see absolutely no reason why she would need to have it concealed. If you look on the Maine.gov website there are so many people applying for concealed weapon permits they are posting there could be delays. Why do weapons need to be concealed? Carry it in a holster loud and proud if you feel you need to carry a gun in public. And let’s not forget what started this. It wasn’t the fact he had a concealed weapon on his person in LL Beans, it was because he “forgot” his loaded weapon in a public bathroom!
Why do people feel the need to carry a concealed weapon in Maine?
Well if you have been reading the headlines of the various newspapers and the rise in violent crime that would be one reason.
Another making others feel uncomfortable with open carry. Why display it and make people feel uncomfortable when you can carry concealed (with the proper licenses).
The delays in processing permits has been ongoing for over a year now. 90 days is not out of the question for new applicants.
But, this Doctor Deputy did not have a permit to carry a concealed weapon. His privilege for doing so was granted to him by Sheriff Smith himself who now says he doesn’t remember doing so!!
I have been reading the papers and have noticed the rise in violent crime. Seems to me all the more reason to carry a weapon out in the open. How uncomfortable are we knowing that there are people hiding weapons, loaded too, around their clothing? I for one would be more comfortable knowing where I stand. Good question.
First by holding the person that granted permission in the first place responsible. That would be Sheriff Smith. He circumvented the system by issuing a “special” Deputy commission to a contracted individual who had never completed the municipal law enforcement program at the Maine Criminal Justice Academy.
Second by holding the person (the doctor) criminally responsible for leaving a loaded firearm behind in a restroom (please note I did not say public restroom as this could have happened in your bathroom).
Third by making sure the doctor is never allowed a permit to carry a concealed weapon ever. He has demonstrated a total lack of awareness of the responsibility that comes with carrying a concealed weapon. (I will never forget my grandfather giving up his drivers license after hitting a dog….he said “that could have been a child” and he never drove again.)
I have no problem with people that hold a concealed weapons permit (myself being one of them) being asked to demonstrate firearm knowledge of basic safety requirements on a regular basis. If I wish to carry a concealed weapon I should at least be willing to take a refresher class including range time at each renewal.

I agree with your thoughts and your knowledge and awareness makes me wish more were just as responsible as you, however, I guess first I need to understand why concealed weapon permits are so handy. I would think they would be the exception, not the rule. This doctor cannot possibly be carrying a loaded gun into the prison so therefore, why did he feel it was okay to carry a loaded and concealed pistol into LL Beans? I myself would prefer a world where guns only existed for feeding oneself but I understand that is too much to ask.
I cannot answer why he felt the need to carry a loaded firearm into LLBean or why he “forgot” about it and left it behind.
However, let’s discuss your other points.
Maine is a “shall issue” state. That means if you are not a convicted felon, have a mental defect, other other prohibited status Maine “shall issue” the requested CWP.
What if Maine went to a “show need” state. That means you have to show a need for the CWP. Would that improve things? It would certainly limit the number of permits issued but would it “solve” anything or are we looking for a problem in Maine when there is no problem to be found?
Let’s look at another permit the state issues to almost any one asking for one…a Drivers License. It certainly is a privilege and not a right. It is regulated and you have to pass a written and drivers test before the state gives you a Drivers License.
What if we made that a “show need”. You have to have a reason before the state will give you a drivers license. i.e. a job that you need to drive to and from, etc…
Once you demonstrate the need someone needs to decide if that is a real need. Would you want someone else to decide if your need for a drivers license was a real need?
Wonder how long before he will resign, or what will happen. Who knows
