WISCASSET, Maine — A convicted felon accused of attempting to strangle his girlfriend allegedly violated his bail by calling the district attorney’s office from the woman’s home and leaving a rifle on a nearby bed, where the deputy who arrested him could see it.

Herbert “Joe” A. Sund III, 48, who lived in Nobleboro with his girlfriend was arrested the night of April 17 after the woman called police from a neighbor’s home to report Sund attempted to strangle her.

The woman reported she had been “choked until almost passing out after being attacked by Mr. Sund,” Deputy Joel Seekins of the Lincoln County Sheriff’s Office wrote in an affidavit. The woman said she hit Sund in the head with a telephone before running to the neighbor’s home.

Sund, who was convicted in 1987 of robbery, said the woman attacked him and he tried to pin her arms to get her to stop.

Sund was indicted in May on a single count of aggravated assault, a Class B felony.

But on May 27, Sund allegedly called the district attorney’s office, asking to speak to the district attorney. According to court documents, caller ID revealed Sund called from the victim’s home, in violation of his bail.

Deputies allegedly found Sund in the woman’s bedroom shortly afterward, about 10 to 15 feet from a “bolt-action rifle” lying on a bed, according to documents.

He was arrested and charged with violation of conditions of release and possession of a firearm by a prohibited person.

Sund remained at Two Bridges Regional Jail Thursday, held without bail, according to a jail official. He is scheduled to appear in Lincoln County Superior Court July 27.
