ROCKLAND, Maine — The estate of a 25-year-old Rockland man who died last year from injuries he suffered after falling from the balcony of a downtown pub has sued the business.
The estate of Mark Boynton filed the lawsuit last week in Knox County Unified Court. His mother, Billi Robbins of South Thomaston, the personal representative of Boynton’s estate, filed the suit against Get Out Inc., which does business as the Time Out Pub of Rockland.
The lawsuit contends the Time Out Pub was negligent in the design of the deck, which is 17 feet above the paved parking area.
Boynton showed no signs of intoxication on the evening of the fall, according to the lawsuit. He was served two nonalcoholic beverages that evening at the bar.
The lawsuit points out the business knew customers would sit on the railing and provided seating close to the railing.
The incident occurred shortly after 11:30 p.m. at the pub on Main Street. The pub has a balcony on the back side of the building that faces the city’s waterfront Harbor Park. According to Rockland police Sgt. Donald Finnegan, Boynton was trying to sit on the rail of the balcony and fell backward, striking his head on the pavement below.
Boynton suffered critical injuries and was taken by ambulance to Pen Bay Medical Center in Rockport and then by ambulance to Maine Medical Center in Portland, where he died the next day.
The lawsuit does not state a specific amount of damages being sought. The attorneys for the estate are Mark Dunlap and Peter Thompson of Portland.
A representative of the Time Out Pub could not immediately be reached for comment.
