Special Counsel Robert Hur finds that President Joe Biden willfully retained and shared classified documents but that prosecution is not appropriate as Biden is “a well-meaning, elderly man with a poor memory.” The implication is that he lacks the mental capacity to form the mens rea required to prove a crime.
The president disputes Hur’s assessment of his mental acuity but essentially saying, “I am not demented” is a proclamation as awkward to float as “I am not a crook.”
