An Old Town man is accused of assaulting a 15-year-old who was walking with friends Friday night.

The teenager and two friends were walking around 10:40 p.m. along Stillwater Avenue to the Old Town Plaza. They were being loud, using profanities and calling each other vulgar names, the trio — ages 15, 16 and 20 — told Old Town police.

Tyron Fox, 32, and his girlfriend were driving by and decided the group was targeting them, according to the police report filed in Penobscot County Superior Court. He exited the vehicle and approached the group, appearing ready to fight, they told police.

The 20-year-old tried to explain the group wasn’t talking to Fox and his girlfriend. Fox then grabbed the 15-year-old around the neck with one hand and applied “immense pressure,” the report said. The teenager told police he was worried he’d lose consciousness.

While still holding the teenager’s neck, Fox then slammed him on the ground over and over while also holding his clothing, the report said. The teenager was also punched on the right side of his face.

When police arrived, an officer could see “clearly discernable” and fresh marks on the side of the teenager’s neck, including visible marks from several fingers and a scratch that was still bleeding, the report said.

Fox is charged with one felony count of aggravated assault and one misdemeanor count of violation of condition of release. His attorney did not respond to a request for comment.

“The group insisted that there was no qualms with the vehicle or it’s [sic] occupants — the attack by all reasonable analysis seemed sporadic and unreasonable,” the officer wrote.

Fox and his girlfriend drove away, but the group had taken a picture of the license plate, the report said. Police went to the girlfriend’s home, where they interviewed her and Fox.

The girlfriend said she couldn’t see what was happening but asserted that because Fox was yelling, he could not be fighting, the report said.

When interviewed by police, Fox maintained he confronted the group but did not use any physical force, the report said.

Fox had his first court appearance Monday. He is being held without bail at the Penobscot County Jail in Bangor because he is accused of violating his bail conditions. In that case, which is still pending, Fox is charged with operating after revocation of his driver’s license.
