BANGOR, Maine — The man who was shot in the foot by a homeowner after reportedly breaking into an Eddington house Saturday most likely will remain jailed until his case is resolved.
District Court Judge Jesse Gunther set bail for Darren Seidell, 30, at $50,000 cash or $100,000 surety at his first court appearance Monday at the Penobscot Judicial Center. Seidell, a local transient originally from Florida, is charged with burglary and theft. He appeared before Gunther through videoconference.
Seidell had a list of pharmacies and financial institutions he planned to rob, James Aucoin, assistant district attorney for Penobscot County, told Gunther on Monday when he asked that bail be set at $50,000 cash. In addition to the charges related to Saturday’s incident, Seidell reportedly owes more than $800 in unpaid fines for previous convictions.
Seidell said through the lawyer of the day, Benjamin Fowler of Bangor, that he was an unemployed chef and was unable to post any bail. Fowler suggested an unsecured bail be allowed.
“This clearly is not a case where an unsecured bond is warranted, particularly considering the magnitude of this alleged offense,” Gunther said. “Given his history, that amount of bail is not at all unreasonable.”
If he were to make bail, conditions include Seidell having no contact with the alleged victims, not being at their home and no possession of dangerous weapons. Seidell was discovered in the Riverside Drive home of Peter and Carol Roderick when she returned home from a quilting class around 2:45 p.m. Saturday, according to the affidavit filed with the court Monday.
The couple did not attend Monday’s court hearing.
Peter Roderick was heading into the kitchen for a cup of coffee when his wife arrived home, according to the affidavit. He told police he took some of her things upstairs, and saw a large man wearing a dark jacket and a black ski mask in the couple’s bedroom.
The homeowner followed Seidell downstairs where the two tussled, the affidavit stated. Peter Roderick ripped the jacket Seidell was wearing, then shot the still-masked intruder in the foot. Seidell ran toward a nearby home on Riverside Drive.
Peter Roderick said on Sunday that he has a concealed weapons permit. He shot Seidell with a 9 mm handgun the homeowner told investigators he always carries.
“[Seidell] was chased across the road” and first went left, running behind one house, then circled around and entered a second house, 491 Riverside Drive, directly across the street from the Rodericks’, the deputy chief said.
Maine State Police and Penobscot County Sheriff’s deputies arrived on scene in force and searched the area around neighboring homes on Riverside Drive, which also is known as Route 178.
The family that lives at the house Seidell had entered, who said he had been staying there a couple of days with a visiting relative, “waved us right in and brought us to him,” Morton said.
Seidell has numerous convictions since 2006 including for aggravated criminal trespass, criminal mischief, terrorizing, assault, harassment by telephone, marijuana possession, theft, operating without a license, violating protective orders, failure to appear and violating conditions of his release, according to prior court listings printed in the Bangor Daily News.
If convicted of the charges stemming from the incident Saturday, Seidell faces a penalty of up to 10 years in prison and a fine of $20,000 on the burglary charge alone.



You’d think a shot to the foot would incapacitate someone. Now I understand why police say they have to shoot to kill, especially when they’re up against armed criminals.

If he could run away while shot in the foot, I would think he would have cuffs on to the hospital, during treatment, and to the jail.

I don’t hear anybody talking about the perp suing the the person who shot him. I don’t think you can shoot people running or trying to get away even if they’re in your house. The homeowner could be charged!

3. A person in possession or control of a dwelling place or a person who is licensed or privileged to be therein is justified in using deadly force upon another person:
A. Under the circumstances enumerated in section 108; or
B. When the person reasonably believes that deadly force is necessary to prevent or terminate the commission of a criminal trespass by such other person, who the person reasonably believes:
(1) Has entered or is attempting to enter the dwelling place or has surreptitiously remained within the dwelling place without a license or privilege to do so; and
(2) Is committing or is likely to commit some other crime within the dwelling place.
4. A person may use deadly force under subsection 3, paragraph B only if the person first demands the person against whom such deadly force is to be used to terminate the criminal trespass and the trespasser fails to immediately comply with the demand, unless the person reasonably believes that it would be dangerous to the person or a 3rd person to make the demand.

Ive seen stupider things. He could be sitting in front of 12 jurers or he could’ve been being carried by 6 of his friends. I think the Homeowner did astounding. The police may have taken the mans life, given the same shot. He should thank his lucky stars that this man choose to spare his life, here he wouldn’t have recieved such a warm welcome.

As for “suing”, anyone can sue for anything, it doesn’t mean that the suit has merit.
Oh, sure, fine him $20k. He doesn’t have a cent and no assets but drugs. Glad the homeowner was “packing”. Check off one for the good guys.
Maybe part of the sentencing would be for him to have to clean up a crime scene and all the blood spread around.
He probably will learn some fancy foot work and wear steel toe boots to protect his feet next time.

If I were the judge, just for fun, i’d set bail at $50.000 cash, or run barefoot to the New Hampshire border.
Got a good idea that he will go back to Florida when he gets out where he will blend in better. Alot more elderly down there are on vacation, they don’t pack heat. His risks are much lower with easier prey.
Maine has a higher percentage of elderly than Florida. Maine is the oldest state in the nation.
