SCARBOROUGH, Maine — A Scarborough town councilor facing a drunken driving charge has reached a plea deal that helps her avoid jail time.
Judith Roy was charged with operating under the influence and operating under the influence with a blood alcohol content of 0.15 percent, which carries a mandatory penalty of two days in jail.
Under the agreement, the 68-year-old Roy pleaded guilty to the lesser charge and the more serious charge was dismissed. She was fined $500 and her license was suspended for 90 days.
Prosecutors tell The Portland Press Herald such deals are common in similar cases.
A motorist reported an erratic driver on Black Point Road around 10 p.m. on Sept. 17. Police say the motorist followed Roy to her home, where they were met by police.

Similar cases meaning the defendant is a wealthy, well-connected politician?
Yes exactly- you or I wouldn’t stand a chance
This is an outrage! I’ve never seen this happen before (I know that it doesn’t mean it hasn’t). I guess it’s who you know, eh?
Or who you…
blow… into the breathalizer please ma’am…
where is MAD when you need them , she should go to jail just like everyone else does , she knows you should not drink and drive
MADD
…similar cases, what similar cases? I did not know that drunk driving had a lesser charge and a serious charge…maybe they are making it up as they go along. Is this ‘lesser’ charge going to remain on her record? Did her car get towed? Is she going to attend ‘classes’? Somehow I don’t think so. And they wonder why vigilantism is on the rise. You can’t fight city hall, but they all do have to sleep….
There is no “lesser charge” with OUI and it is mandatory to pay the amount and serve the 2 days..reagardless of you plee guilty or not. You can’t discredit a machine that reads yer blood alcohol level. So what was the deal? I think there is more to this story than what is being told because by the looks of it she got everything other than the jail time. Sounds fishy to me!
Don’t quote me on “this” but I think the margin of error for these machines are 0o.02%…….just sayin.
Yup…another example of the supposed elite being treated with kid gloves whereas you or I would be slammer bound with no questions asked.
Let’s just say that there ain’t to many double wides on the Black Point Rd. in Scarborough. $$$$$$
A B.A.C. of .15% and no jail time? This goes to prove that only the rich get justice; and the poor get lawyers, and henceforth, jail time.
She deserves the slammer. How many other infractions has she had?
aaaaaahhh…the benefits you get when you are part of the “club”..
I would imagine this is the first time this 68 year old has ever done this and she will never do it again. I bet ya she will be in the news again. Just hope the article doesn’t read, 68 year old intoxicated woman kills three with SUV.
OUI? Now a lesser charge? No WAY!!
I hope the state attourney general sees this article !
Keep giving plea deals to these drunks…..what kind of message are we sending to the youth today when people of authority get off or reduced charges for crimes they commit….they should hang her as well a all the other drunks….
Crony prosecutor? Never heard of this before. How many times has this been done in the state? We, the people are asking. Sounds like the state is going soft on drunk drivers. This is exactly what she is. A DRUNK DRIVER. I would understand the sentence if she would get DRUNK DRIVER tattooed on her forehead.
