BANGOR, Maine — The Bangor man who survived being shot last week during a deadly home invasion in Hermon was arrested twice in the days following and for the second time has been released on bail.

Philip McIntyre, 19, was charged with burglary on Thursday after he was released from St. Joseph Hospital in Bangor — where he was treated for a gunshot wound to the leg — and was booked into Penobscot County Jail.

McIntyre was with Robert Dellairo, 30, also of Bangor, and an unidentified woman last week when they forced their way into a residence at the Duran Apartments on Outer Hammond Street in Hermon, according to police.

Both men were shot by Daniel Williams, 24, one of two men in the apartment, and Dellairo died later that day at Eastern Maine Medical Center from a gunshot wound to the pelvis.

A second unidentified woman also is involved in the home invasion, police say.

After being arrested for the burglary, McIntyre was released Thursday afternoon on $7,500 unsecured bail after paying a $60 fee to a bail commissioner, Penobscot County Chief Deputy Troy Morton said on Friday.

McIntyre posted “RIP bobby” and “love u bro” on his Facebook page shortly after being released from jail the first time.

McIntyre was arrested again on Friday night by Maine State Police Trooper Chris Cookson for three outstanding warrants — all for unpaid fines.

McIntyre was in court again on Tuesday at the Penobscot Judicial Center where he again agreed to make payments to take care of the fines.

The fines for the three cases totaled $700, and McIntyre was released on bail at around 2:30 p.m., according to a jail official.

McIntyre has been arrested at least four times over the past 18 months for failure to pay fines, according to court documents filed at the Penobscot Judicial Center. When he appeared before a judge on Jan. 6, McIntyre was ordered to pay fines totaling $1,200 at a rate of $50 a month.

Michael P. Roberts, deputy district attorney for Penobscot County, said Friday morning that his office had not yet received police reports or other paperwork about the shooting, and an assistant in the office said Tuesday that nothing had changed.

Maine State Police Lt. Christopher Coleman of the Major Crimes Unit is leading the investigation and is working with the Penobscot County Sheriff’s Office on the case.

McIntyre’s bail conditions, which are standard in most cases, include no contact with the victims, no returning to their address, no possession of firearms or other dangerous weapons, no use of alcohol or illegal drugs, and random searches for weapons and testing for alcohol and drug use. He also has a curfew and is not allowed out between 6 p.m and 8 a.m., the jail official said.

McIntyre has convictions for theft, disorderly conduct and failure to appear in court when ordered to appear, the court documents state.

Williams told the Bangor Daily News on Monday that he shot the two men to protect himself.

After McIntyre and Dellairo got into Williams’ apartment and started kicking and punching him and his roommate, Williams was able to break away and get to his bedroom, where he kept his .22-caliber handgun.

I “did what I had to do,” he said.

After shooting McIntyre in the leg, Williams pursued the three outside and said that Dellairo turned and lunged at him and he “fired off a couple surprised rounds,” striking Dellairo in the hip. That wound would prove to be fatal.

“I’m very banged up about it,” Williams said. “I’ve shed a lot of tears behind closed doors for Bobby Dellairo and his family.”

      1. His conditions NOW are not to be out between the 6PM-8AM, based on his charges of the home invasion. Unfortunately, one cannot be held for unpaid fines. They can be arrested for it, but not held.

    1.  He doesn’t need a job. If he isn’t now on disability he will soon be, gunshot wound to the leg is a free ticket.

I replied that since this guy had no income and couldn’t pay his fines, they should bring back chain gangs and have part of their labor earnings go toward their keep, and part toward their fine owed.   3. My question is why wasn’t he charge for the outstanding warrants when he was arrested for the break in? 

    1.  Plain and simple, jail overcrowding.  As the jails fill up from this lousy economy, courts are forced to release the lesser offenders.

      1.  Attempted Murder is a “lesser” offense?

        Now do you see why I advocate .40 S&W or better?

  4. Seems he should be thrown in jail and the key thrown away. He just keeps racking up charges. Why was he let out after he was arrested Thursday? Parenting at his age should have nothing to do with it at this point. He has been arrested and to court quite a few times. The jail and court system should have smartened him up. Apparently he doesn’t want to be productive.

  5. Penobscot County Law Enforcement, from the District Atty’s office down is the biggest joke in the country. They have the competency level of a knat. I am not surprised I got shafted by their office anymore. They are a joke.

  6. The computers (and the ones who input info) really need to get their acts together. There is no reason, in this day and age, why his warrants weren’t available upon his arrest for the invasion. 

    I know, it’s ‘expensive’, but look at the present alternative: CHAOS!    This state has to get it together. It’s not like making bail should be a crapshoot….

  8. no offense i personally believe this kid belongs behind bars as well after the whole invasion ordeal, however with that said. the state dropped the ball on this one, it’s SOP for the jail officers to do a warrant check on the inmate BEFORE releasing them. and the warrant check is both through national and local databases. there fore while he was in their custody this past weekend this should have been found. F for effort on the jail, justice, and bail system in the state of maine.

  9. Got to love the judicial system.  The police tag em and bag em and the judges release them back to the wild. Exactly how many times does one have to be arrested to be held over? Also another great lesson to all our youth do what you want it does not matter if the police come and get you you will be let out asap no problem.

  13. Yes, this is our judicial system working at it’s best. Why even give him bail? Throw his sorry butt in jail and let it rot there till his court hearing. He obviously is a repeat offender of numerous crimes and will continue to do so.  So he owes fines, and it’s obvious how he is getting the money, breaking into people homes. What a waste of tax-payers money with this back and forth to court . Do these judges have any brains or common sense in their heads?

If you are speeding in a car and have an accident and someone gets killed, it’s manslaughter and possible jail time but if you’re breaking into someone’s home with a friend and that friend gets killed you get put back on the street with no real charges? He should also be charged with at least involuntary manslaughter!

Speaking of our law enforcement, where is an update on the Robert Carlson investigation?   Last we heard the investigation was going to be wrapped up in a week.  It has been more than a month and nothing.  Home invasion and abusing children are both high level crimes.  Please do not let the Carlson investigation fade into the shadows.

  23. police sure do look stupid when things like this happen.. years ago i got jailed for a weekend for a ten dollar fee that was not even ordered to be paid for a year from date of court.i guess it depends on if the cops are doing there job or screwing off

But on the other hand considering his long running disregard of the law and courts leniency has long ago been lost. If he didn’t walk out of the house with anything he didn’t walk in with begs the question, WHY did he walk in. He should consider the fact that he’s still breathing means he is now living on borrowed time. The fact he was even with his buddies while they showed no concern for the civil rights of others while commiting serious life threatening attacks makes him just as guilty as his friend who’s bitter end was fully justified. So when all the facts are gathered, including what the others had to do with the crime, hopefully Justice will prevail and he shall finally pay his debt to society.

    2. Even as an old, card carrying liberal I can’t let that comment slide. I would never suggest that he “deserves” to be in a body bag, but it’ s a safe bet that he will end up in one soon. I just hope he doesn’t cause a decent citizen to be packed in one too. Now let’s look at what you said. “Stuck in a rut?” He’s certainly not “stuck in a rut.” There are a lot of people who are stuck in a rut …… often the ruts are hard work and low paying jobs. This bozo is swimming in the mud. As far as “loosing a friend:”  the friend wasn’t lost, he’s dead. He seems to be the one we can’t keep track of. Along with his now deceased friend, he invaded a home (while the young “ladies” waited outside.)  The friend was killed by a man who must now live with the pain of taking a life. You are right about him being under a lot of stress and I agree. His mental health should be a concern of every citizen. The best solution is that he put somewhere where he doesn’t have to worry about food, or bad people breaking into his home. Somewhere where he is protected from all of us insensitive people by nice, secure fences and razor wire (armed guards and dogs too.) Let’s not call the poor boy a criminal. I have known a few criminals (from con men to bank robbers and they would have been offended to hear him called a criminal. He’s one of the people who give crime a bad name. I think it would be nice if we had a mental health system that could give him the help that he needs. It would take place in a nice hospital  (behind the razor wire) and he would remain there until two psychiatrists state that he is no longer a danger to society. They would have to be careful,  because if they made a mistake they would not only be charged as accessories to any crimes he committed, but be permanently out of the head shrinking  business.  I haven’t seen his face book, and I don’t know his mother but I would suggest that she either take some parenting classes, or choose a different gene pool when she goes swimming. It appears that the one she was swimming in is too close to the outlet pipes from the sewage disposal plant.

Step back and think how you would feel if he burst through your door. He should have suffered the same fate of his good friend.
