AUBURN, Maine — A jury has ruled that a Lewiston landlord was not responsible for a child tenant’s lead poisoning.

The jury determined after three and a half hours of deliberation that Double Eagle Properties LLC shouldn’t be held liable for the elevated blood-lead levels of the now 7-year-old boy, who according to his parents’ lawyer, has behavioral problems, a lowered IQ and learning disabilities.

A lawyer for the boy’s parents argued that the building’s owners should have replaced windows in the apartment that created dust that contained lead paint. They were asking for $11 million.

The Sun Journal reported that the lawyer called the verdict “really unfortunate.”

A lawyer for the defendants say the owners complied with all local, state and federal legal requirements regarding lead paint.

  1. More information is needed..how long did they live there, was the paint peeling or chipped?  I
    have been working in the rental business for 10 years and know that many landlords just don’t give
    a rat’s behind about the tenants…just get the money.

    1. Although not mentioned in this brief article, there certainly is much more information on this case.  Every time there is an elevated blood lead level in a child, an investigation through DHHS is initiated and conducted by a licensed lead risk assessor.

  2. should not code inforcement be held responsible since they give the ok to rent and live in  places when they do an inspection

  3. As long as land lords are getting their money, they could care less. It’s proven time and time again even more so now. You see previous articles about slum lords that get money from Maine state housing, and rural developement and most all of them should be condemed. Most have black mold, and lead paint. Problem is is the conde enforcement, and housing agencies have had their pockets lined by the land lords to make sure that all of these problems are never their fault!

  4. At just over 2 years of age he showed many times the recommended level of lead. After five years seems I’d had my child away from there long long ago and would have made sure my child was in a safe enviroment to prevent further damage.

    1. They didn’t care about the kid. All they wanted was a get rich quick scam. I’m glad it didn’t turn out the way they wanted it to.

  5. good another scam defeated, where are the parents, lead paint doesnt just atomize ,the kid was chewing on the window sills ? what eating paint chips ? please !
