BANGOR, Maine — A local man reportedly had two run-ins with police early Friday morning and was arrested after being warned not to drive.
Mickey Gargan of Bangor had been drinking Thursday evening and was warned by Officer Joe Baillargeon not to drive, according to Sgt. Bob Bishop, citing an arrest report.
Just before 3 a.m. Friday, Sgt. Larry Webster stopped Gargan’s vehicle on Hammond Street. Gargan was arrested and charged with operating under the influence when he failed field sobriety tests, Bishop said.
Bishop would not specify why police had to deal with Gargan earlier in the evening.



Stuck on Stupid…
Stupid should hurt. More importantly, if he was arrested (or was he? Article mentions an arrest report), why was he released the same night?????????? Part of the problem is a lack of holding people accountable, including the police IF they are in fact letting a drunk out the same night. Geesh. Thanks for protecting those of us obeying the law.
If your arrested for oui you are allowed to bail out of jail.
Apparently you dont “know2much” a lot of the time. Read the article. Doesnt say he was arrested , released and then arrested for oui..just says had a run in with police earlier. And if you are arrested, you can make bail and be released. The fact they arrested him for the oui shows they are doing their job.

I completely agree. Honestly there should be a “Stupid” clause for criminals. If you get arrested more than once in a day, “Stupid” clause kicks in and its an automatic 30 days in jail. Warned by police not to drive, and you do anyway and get arrested, well there goes the “Stupid” Clause. Maybe if some of these uneducated boneheads would just spend a little time behind bars, they would learn something…Totally rediculous.
Agreed. Why warn someone not to drive if they are in a position of not being safe behind the wheel. Either drive them home, get them a cab (and have them pick up their keys the next day) or arrest them for OUI if that is the case. Makes me wonder why they warned him not to drive and then let him go. Seems the stupid clause should equally apply to those charged with enforcing the law as well ;)
