BREWER, Maine — Two residents on Willow Way voiced their concerns about fireworks — one saying they are dangerous and should be outlawed and the other stressing the need for earlier time restrictions.
Brian Geaghan told city councilors that in his opinion fireworks “are not safe under any conditions” and questioned whether they did any research before approving a fireworks ordinance in November.
“I’ve done a little homework on fireworks. What I found when I talked to most of you is that you haven’t done your homework,” he said.
Military veterans who served in Afghanistan, grandmothers with shivering small dogs and parents with babies should not have to listen to fireworks being shot off next door, said Geaghan, who also asked if councilors have paid attention to firework injuries and fires that have recently made headlines in Maine.
On Jan. 1, the law banning fireworks in the state was lifted. Fireworks can only be fired from someone’s own property or if the property owner provides written permission.
Joseph Ferris and Mayor Jerry Goss took exception to Geaghan’s comments.
“I do take umbrage from the suggestion that I did no homework,” Ferris said. “We were looking at regulations that said this wasn’t permitted and that wasn’t permitted” and based the local ordinance on those rules.
In the early version of the state rules, “bottle rockets weren’t permitted,” Ferris said.
That changed when the state fire marshal issued a definition by rule “which allows for consumer fireworks, such a bottle rockets, spinners, etcetera … to be shot off,” explained Police Chief Perry Antone.
“Back when we discussed this, the fire marshal hadn’t written the rules,” he said. “Initially, they said they weren’t allowed because they were waiting for a definition by rule.”
When discussing the local rules last fall, “councilors did an extraordinary amount of homework” and also have been paying attention to recent news regarding them, Goss said.
One part of the ordinance also stated councilors could review the ordinance after a year to see if it needed to be modified, the mayor said.
Councilor Larry Doughty said he brought forward the discussion item because he’s hearing residents want to reduce the 10 p.m. curfew on shooting off fireworks.
Some residents have reported fireworks being discharged in the middle of the night, he said.
Joan Richert, who is a neighbor of Geaghan, said she wished fireworks weren’t allowed in town but since they are, she wants the council to drop the curfew to 9 p.m.
“Why should anyone be making that kind of racket after 9 o’clock?” she asked.
The fire department has not responded to any calls, Fire Chief Gary Parent said, and “since the law was passed, we’ve had 17 complaints total that have been reported to us,” Antone said. “Eleven of them were investigated and deemed legal under the law.”
Other calls included reports of people throwing lit fireworks onto the street and then driving away, he said. The last complaint was made on July 8, Antone said.
City attorney Joel Dearborn was asked to review the state rules and make a presentation to the city council in the coming months.



Where is the police chief getting his info? Because if missiles and bottle rockets are indeed legal, I want some. The stores don’t sell them and my reading of the law says they are illegal.

OLD ORCHARD BEACH, Maine (NEWS CENTER channel 6) — Officials say a fire that damaged an apartment building in Old Orchard Beach Saturday morning was caused by careless use of consumer fireworks.
Three firefighters were treated on scene.
Irresponsible reporting by WCSH. This incident has NOTHING to do with the new fireworks law.
The fire was caused by sparklers… which were legal long before the new law.
Oh Please! I was a firefighter in Maine for nine years. We had more problem with ammunition going off in homes with all the hunters in Maine. Maybe we should ban hunting. Get your facts straight. I would love to know out of all the people whining about fireworks go to the city to watch them on the fourth of July. Maine has bigger problems than people using fireworks. Get over it!

I’m more interested in seeing people take responsibility for their decisions, than take umbrage when questioned about them. Particularly when they are public servants.

I’m not sure if a comment made by the Brewer police chief is accurately reported in this article, but if so, he is wrong. I made a complaint two nights ago when fireworks were being lit well after 10:00 PM. The dispatcher said he wasn’t sure if the police would investigate. Thus far, these fireworks are nothing but a nuisance. Hopefully as we move away from summer, it will get better.
I live in Brewer, I wish I had known about fireworks being a topic the other night-I would have attended. There was no agenda posted online.
I find it hilarious that all of these so-called problems regarding Fireworks are happening in the first year that they are made legal in the state of Maine, even though many nanny towns and cities have banned them, they do not even come close to having the manpower to police them being used and set off. You cannot expect to have stores in the state sell the items and then expect people to keep them in their closets until the 4th of July rolls around. Either make them illegal as in the past or set a curfew and police it. Otherwise, please, stop all the complaining…its very annoying.
The one fire I read about sounded like it was started by kids using the fireworks. I am assuming that where the sale is limited to people 21 and over, providing them to minors is also illegal. I think if the poice in all towns were able to enforce the laws on the books, there would be a lot less issues. But I also think police forces would have to be doubled or tripled to enforce all of the laws on the books though, so they have to prioritize.

Someone should remind the lady who complained about fireworks after 9:00pm that it doesn’t get dark until that time for a lot of the summer. I guess to make her happy we should light them off at noontime.

Perhaps the complainers mentioned in the article would prefer fireworks to only be used between 11am-1pm, on the 4th Thursday of the month, with a paid supervisor appointed by the state and a 20 mile setback from all structures, trees and little animals? I live in town and have heard fireworks only a handful of times since the 4th and they have never been overly loud. They are legal, they are bringing extra income and tax money to the state….move on and find something else to protest.

While staying with relatives at their camp, every evening at 9-9:30 pm, we were “entertained” (this is a sarcastic comment) by fireworks from across the pond. This went on any where from 45 minutes to an hour each evening. And yes, I do expect that I can have some peace and quiet that late in the evening.

If this is such a problem on Willow Way, how come only two residents of that street are complaining? What about Clover Lane or Washington Street residents? Food for thought.
I live on Washington St. and I complained. Several times there have been people setting them off on the school property. When we called the police they said they could only tell them to stop if they were actually on the school grounds, if not they could set them off until 10 on their own property.
Where was it posted by the city council that fireworks would be a topic on Tuesday night-nowhere-the agenda was blank online. I think those folks came because they had contacted councilors and were told about it then. I would have attended had I known. The school superintendent having to live in Brewer was put out to a vote to let Brewer citizens decide-why would they not do the same for fireworks-majority rules….

I happen to enjoy my neighbors setting off fireworks…in fact, one neighbor had about $700 worth of fireworks and set them off around the 4th and our family stood in the driveway watching them…how much better can it get when you can see fireworks from your driveway?

Do you remember the time “One” lady complained in Portland that she brought her child to a hockey game and a fight broke out. I’m pretty sure she wanted to ban fighting at hockey games.
We ventured into a fireworks store to see all the hub-bub, and it looked like children in a candy store…until they saw the prices. WOW! I mean, who knew they were that pricey? And it wasn’t stopping many people from pulling out that credit card and dropping hundreds on items they could carry out by hand (meaning not too much).
And I would be miffed if they were legal and I had to fire them off before the sun went down – what’s the point in that? You can’t have a 9PM curfew in the mid-summer – it’s light out.
We’ve got a lot of crybabies around here in this state and locally – no loud music, no fireworks; basically, no revenue allowed in this area – people are spending money, keeping many of us employed – get a grip; buy some earplugs…
I agree the fireworks were kind of annoying — I live in Brewer, but I only heard them the week of the 4th. I can deal with that. There were definitely people setting them off fairly late though (after 11), which I thought was illegal except on the 4th or the weekend leading up to the 4th (if it doesn’t fall on a weekend).
And that police officer is wrong. Bottle rockets and missiles are illegal. Mortar/artillery-type fireworks are OK though (launched out of a tube)
