HOWLAND, Maine — Bail was set at $10,000 cash Monday for each of four men arrested over the weekend after police say they brutally beat up two local men, leaving them with broken facial bones, broken ribs and missing teeth.

Brandon T. Summerson, 21, of Enfield; Howland brothers John T. McKinnon, 21, and Henry R. McKinnon, 27; and Charles W. Gardner, 20, also of Howland, each have been charged with two counts of aggravated assault in connection with the incident, according to Stephen McCausland, Maine Department of Public Safety spokesman.

“They were both severely beaten,” McCausland said of the two Howland victims, who are 30 and 31. The Bangor Daily News is withholding their names because they are victims. The assault took place on Friday outdoors at the junction of Caron Drive and River Road.

“[The 30-year-old] has 80 facial fractures and will need extensive facial reconstructive surgery,” Jim Aucoin, a Penobscot County assistant district attorney, told Superior Court Justice William Anderson in court Monday.

“The other victim has numerous fractures that include a broken eye socket, broken ribs and [some of] his teeth have … been knocked out,” according to an account of the assault on the Maine State Police website. “He’s in ICU [intensive care unit] with an unregulated heart beat.”

A dispute over money apparently sparked the fight, Aucoin said outside the courtroom.

The affidavit is not forthcoming, the judge said.

“They all admit being there but nobody admits to doing anything,” Anderson said. “It’s hard to delineate who did what. What we know is four people did beat up two people [and] the two people have very, very serious injuries.”

For that reason, all four arrested are facing the same high bail conditions, the judge said.

Anderson set bail at $10,000 cash and added several conditions, which bars them from contacting the victims and each other, and from possessing alcohol or illegal drugs. If any of the men are able to make bail, they also will be subject to random searches and testing and have a court-ordered curfew that requires them to be home between 8 p.m. and 6 a.m.

While discussing Gardner, Anderson asked if anyone wanted to speak and the young man’s father, William Gardner, stated firmly that, “at this time we chose not to post bail.” As William Gardner walked past a dozen of the suspects’ and victims’ family members, the mother of the 31-year-old victim said, “Thank you.”

William Gardner said the victim’s mother and his wife, Ellen, are close family friends. The women hugged when the Gardners left the courtroom.

“My son Charlie has no record. He’s 20 years old and he potentially has screwed himself,” Gardner’s father said as he was leaving the courthouse.

“It’s really hard because it’s a small town,” said the mother of the 31-year-old victim.

Maine State Police Sgt. David Millett and Troopers Larry Anderson and Keith Barton arrested Summerson and the McKinnon brothers at about 3:30 p.m. Saturday with assistance from Deputy Michael Knights of the Penobscot County Sheriff’s Office and Game Warden Mike Boyer, district leader for the Lincoln region.

Gardner was arrested Sunday.

“The assumption is [the assault] was done with more than just fists,” McCausland said. “We’re still trying to pin down what sparked this violent assault.”

The victims both remain at Eastern Maine Medical Center in Bangor, McCausland said.

John McKinnon has an assault conviction from 2011, Henry McKinnon has a drug possession conviction from 2009 and another conviction for cultivation of marijuana, and Summerson was convicted of criminal trespassing and criminal mischief in 2011, Aucoin said.

The 31-year-old victim is slowly recovering, said his mother, who did not want to be identified.

“The swelling is going down,” she said, but his doctors still “don’t know what is causing the erratic heartbeat.”

Tests are being done to see if her son had a previously unknown medical condition that was discovered after he was admitted at EMMC, or if the attack caused stress on his heart.

“He’ll be in there for a while,” the man’s mother said.

All four suspects remained behind bars Monday night, a jail official said.

          Don’t know how you are so sure of the facts.  Were you there?  One of the guys cheering these people on?  Well, for good measure, here’s my two cents worth.  These guys were looking for someone to hurt.  Before they started calling these victims to get them to come over, they were calling another young man from Howland to come meet them.  He had just had a run-in with Brandon Summerson, over Brandon harassing his girlfriend.  No money, no drugs, just a girl-friend.  I infer from this that they weren’t concerned about money or drugs at the time, they just wanted to hurt someone, ANYONE.

          1.  Good. And once you guys toss him over how about you stop bringing his name up in every thread. It gets really old. We all know he was a monster. He is now a dead monster, so how about you both stop perpetuating the hysteria?

          2.  Well clearly you know who let him get away with it. We all do. There’s at least a few big names floating around. How about you stop whining constantly and do something about it if it means that much to you? Clearly the law doesn’t care. Clearly you are for vigilante justice. So, why not handle it yourself? Otherwise, Id suggest we all move on with our lives. The law clearly doesn’t care, which is clearly a reflection of how twisted and sick our laws, lawmakers and law enforcers are. So either do something about it, or don’t and stop talking about it constantly. Hysteria is useless, really, it is.

    1. Was the bail set by a judge or by a bail commissioner? Either way, I personally don’t think  it is enough for this type of crime, but if it was set by a commissioner, it’s another example of why the commissioner system needs to be reviewed.

    2. I doubt they have the means to make the 8k. That’s a lot of cash for people in their position to just materialize. I doubt they have careers and piles of money sitting around. It hardly matters if its a $100 or a $100,000,000 bail if they cant post it. And yeah, the courts do need criminals. How else to do you think they stay in business?

        1. I didnt read that, but because you are from Howland I am inclined to believe you. I reasoned they would not have the means to come up with such a high bail and therefore a higher bail would have been irrelevant. I suppose now, given developments, a higher bail would have been required to keep them behind bars until trial. I couldnt foresee them having the means to post, I think my assumption they wouldnt be able to was logical. 10k cash is a lot.

    Andrea Jeanne Berwick, 24, of Berlin, was arrested on Feb. 4, on a Possession of Controlled Drugs charge. She was arrested at 6:30 p.m. at the Days Inn on South Main Street. Police allege Berwick was in possession of $10 worth of narcotics/green pills manufactured by Teva Pharmaceuticals. She was released on $2,000 personal recognizance bail and is due back in court on March 12.

People who grow up in “the sticks” do learn politeness and courteous behavoir, I believe it is the people who grew elsewhere who may lack civility for others, it is something your parents teach you as a child and you continue to practice thru out life, it definately has nothing to do with growing up in “the sticks”

Not only should this be considered attempted murder, we also need to consider the possibility that it was hate-motivated, given the nature of the injuries and how especially brutal the beatings were. That’s not how you beat someone who owes you money. That’s how you beat someone who you are convinced deserves to die.

  17. We are seeing the results of the last couple of generations; where punishment is not handed out, drugs have taken over, parents don’t care about raising their kids, and half of the state receives government help.  Maine is turning into a piece of garbage.

      1896: Heroin (manufactured by Bayer) is still available over the counter.

      1920: Prohibition of Alcohol. Fails miserably, creates organized crime. Repealed in 33.

      1960s: Counter culture at home see’s the explosion of LSD usage. MDMA hits the streets around the same period. Marijuana usage skyrockets and never subsides. Soldiers in Nam become introduced to Heroin and begin to use it.

      Late 1980s-90s: Cocaine, Crack and Heroin explode once again on the streets.

If these 4 losers have so much energy to get rid of, perhaps they should find something more constructive to do with it, such as working- a second job if they are not exhausted at the end of the day from their first job. If they can’t find a job, volunteer to do physical labor. They obviously have too much spare time on their hands. It used to be that a man of their age was busy working to provide for his family, not dragging the family name thru the mud. (Let’s hope they haven’t already fathered children & abandoned them!) In the unfortunate event that drugs are involved, perhaps they were underemployed to begin with, thus getting into mischief.       1. I’m not much of an open carry person. Many people just fear guns in general and I so no need to cause undo alarm. Also, there are enough bone heads like these four that may see the firearm as something to steal and bum rush a less than completely alert person. No need attracting any more attention to oneself. The absolute best place for a handgun is safely tucked in a holster ready for use by a trained responsible and sober adult. If the only marks on the weapon are from training and cleaning draws, all the better.

      2.  Heres a tip: Open carry isn’t illegal in this state. And, I agree, lets start using them for things other then paper targets. In fact, I vote we start using them on anyone and anything we (as the individual) feel is wrong. Brilliant. Cant wait to see how high the bodies get before someone figures out that perhaps there is a different answer then meeting violence with violence.

    1. Unfortunately they will make a plea bargain and make deals with some of them and they will get 30 days with all but a weekend suspended or some bogus garbage like that.   30. this is not self defense. give me a break. these scumbags think they are so cool. well they’ll see how cool they are sitting in prison. 80 fractures all teeth gone thats not self defense. these guys have no respect for anyone. i hope they go away for a very long time. one of them could have been something if he would have listened to his parents growing up. and no it’s not always poor parenting that causes the problem. this is sickening and i just cant wrap my head around how anyone can do such a thing to another human being. drugs or not this isnt right. aggravated assault my — thiey should be charged with attempted murder! i hope these victims recover and if they are involved in drugs clean themselves up and become productive members of society.

  31. C’mon state of Maine, you only raised their bails by $2000. You can certainly to do better than 10,000.  Set the bails higher on people who commit crimes rather than raising taxes higher for us working people. 

  32. So, why would bail be the same for all of them when one was convicted of assault already? That makes no sense to me. At least Gardner’s parents didn’t post bail.

He’s 20 years old and he potentially has screwed himself.”  Or phrased differently: “My son Charlie now has an arrrest record, probably an upcoming criminal conviction, and thanks to a Maine jury and judge – will likely serve at least one week in jail for nearly beating a man to death.  Other than that, he’s a great son – all a dad could ask for.”

  35. Such barbarism incites many to call for severe physical retribution. Understandably so. Several decades ago, horrible attacks on a person such as this, could have resulted in a merciless flogging. 

    Juxtaposed  – offense versus punishment – with such punishment, as gratifying to the senses as it is, doesn’t that put us in the same archaic  category as the barbarians who inflicted these vicious assaults on two victims?  

    Pessimists like myself, wager that the assailants will get suspended or reduced sentences. The more practical advocate hard labor, which apparently  the four have managed to elude for most of their 20-odd years.  But like flogging, the rock pile has gone, too.  

    It is understandable why some cry that they are scared to walk the streets.  More so, when we’re told four husky men beat and almost killed two other men over a pill.

How is saying that we need to ship off four people to Afghanistan to become human targets morally acceptable? Am I not justified in my stance?

  36. Gardner’s dad is a nice guy, isn’t he? “My son has never been in trouble. Ever. But he was changed with a crime and although police have no idea if he is actually involved, Im basically going to act like I’ve disowned him.”

    Guilty until proven innocent.

    1. Maybe he knows or suspects what his son is capable of? Just because he’s never been caught doesn’t mean he hasn’t been trouble.  

  37. still, it doesn’t matter anyone in there right mind should realize putting someones life in danger because you don’t have so much more money to put towards more alchol and drugs is pathetic. sorry walking around with a weapons is classy in your eyes  but it’s gonna get you chilllin in a jail cell and basically getting locked down in your house for a biit. They have to be related to some powerful people in that town to get such a small bail.  If they would have been growing a little weed in the back yard they would have got $50,000 bail.  They will probably get small sentences too.  Another example of our backwards priorities in our judicial system

Those injuries are caused by someone being stomped in the face repeatedly; it happened before in Bangor, again two brothers who beat a guy nearly to death; he literally had no face left when they were finished stomping on his face; criminally insane, and should be locked up forever, all of them

  48. i’ve known henry for years (went to school with him) and he has ALWAYS been trouble!!! he has been in these types of situations many times before and just has NOW gotten caught!!! now,is the time to LOCK HIM UP and the idiots that follow him, it will be good for Howland to get rid of a few more low lifes for a while!!! because its guys exactly like these 4 that give this town rep. it has…plenty of more GOOD people left, just got to do a little weeding!!!

  49. Thank you, Mr. Gardner, for doing the right thing. I remember what my former pastor told me years ago when my son was in a similar situation: “Dick, you have the rest of his life to be a good friend, right now you have to be a good father.” Tough decisions, but thank God there are people out there who are willing to make them.

  50. I just have to say that 3 of the men behind bars have no chance of ever changing and don’t have the support of 2 wonderful parents like 1 of the men behind bars does. Charlie Gardner’s parents, Will and Ellen Gardner are two of the nicest people I’ve ever met! They have tried over and over again to help Charlie find the right path, but each time he has continued down the wrong path. Please stop blaming the parents because the Gardner’s had nothing to do with Charlie’s actions. He is an adult and should be held 100% accountable for his own actions. It goes to show you that his Dad Will, is a great guy because lord knows they could’ve bailed Charlie out, but they didn’t. I just wish that people wouldn’t jump to assumptions on here. I grew up in Howland myself. It is not a bad place, yes there are some bad apples, but the entire town is not bad. 

  51. Didn’t see anything in the article that it is 8,000 bail. Seen $10,000. Some of the remarks posted are right on and others are just so crazy. Nice that we can make remarks about the article. Some stated were you there. That is a correct statement. If you weren’t there then state what you think they should get. Don’t blame this on the parents. Yea some don’t care, some do the best they can. We know there is a lot of drugs, more so then years ago. Don’t blame parents due to the kids making the choices they make. Blame the government and those that make it impossible for us to raise our kids like they did years ago. Put the fear of God in the kids and there wouldn’t be nearly the problems we have.
