FORT KENT, Maine — Local police have charged two men in connection with a motorcycle accident that killed a Fort Kent man earlier this month.

Donny McBreairty, 22, of St. John Plantation has been charged with operating under the influence and operating a motorcycle without a motorcycle license for his involvement in the accident that claimed the life of 19-year-old Colby Martin on Aug. 1, according to Fort Kent Police Chief Tom Pelletier.

Also charged is Matt Ouellette, 22, of Fort Kent, owner of the 2001 Harley-Davidson that McBreairty was operating when the accident occurred at 1:30 a.m. on Route 161 near the Fort Kent Golf Club.

Ouellette is charged with allowing the operation of an unregistered motorcycle and knowingly allowing it it to be driven by an individual lacking the proper license, Pelletier said Tuesday morning.

All charges are Class E misdemeanors punishable by up to six months in county jail and a fine of up to $1,000.

Pelletier stressed the charges do not indicate the men caused the accident.

Martin died when his 2009 Harley-Davidson collided with McBreairty’s motorcycle as Martin attempted to pass him heading east at a high rate of speed, the chief said.

At the time, Pelletier said, the impact caused both men to lose control and be ejected from the motorcycles.

Neither operator was wearing a helmet and Martin was pronounced dead at the scene.

Pelletier said excessive speed and alcohol were factors in the accident.

Both Ouellette and McBreairty have their first court appearances scheduled for Oct. 2 in Fort Kent District Court.
