BANGOR, Maine — A local man was sentenced Monday at the Penobscot Judicial Center to five years in prison with all but nine months suspended on one count of gross sexual assault.

Casey Falvey, 21, of Bangor also was sentenced to four years of probation. He will be required to register as a sex offender for the rest of his life.

He will be incarcerated at the Penobscot County Jail because he was ordered to serve nine months behind bars.

Falvey began serving his sentence immediately after he was sentenced. He had been free on unsecured bail, according to his attorney Hunter Tzovarras of Bangor.

Tzovarras recommended the sentence imposed. Alice Clifford, deputy district attorney for Penobscot County, said that Falvey should be sentenced to 12 years in prison with all but four years suspended, followed by six years of probation.

By pleading guilty in October, Falvey admitted that in July 2014, he had sex with a then 13-year-old girl after he gave her alcohol.

The victim, who is not being identified by the Bangor Daily News, did not appear in court Monday. Her father told Superior Court Justice Ann Murray that he and his daughter had moved to northern Penobscot County because of the assault and that she has been in counseling.

“He preyed upon my daughter,” said the victim’s father, who is not being identified to protect her identity. “She has been in her own little prison for two years. Six months in jail is not enough.”

Falvey’s family said that he began turning his life around after he was indicted in September 2014 by the Penobscot County grand jury. He voluntarily entered a faith-based rehabilitation program and has been working with his father, who owns a landscaping business.

“He’s shown commitment to his new life,” Michael Falvey of Bangor, who raised his children as a single father, told the judge. “His mother left when he was in diapers. It’s been difficult for him.”

Casey Falvey apologized to his victim.

“I’m ready to accept whatever sentence you give,” he said.

In imposing the sentence, Murray said that she found the impact on the victim “quite significant.” The judge also said the mitigating factors in the case included: Falvey’s guilty plea; his remorse for the crime; and her conclusion that his substance abuse issues and immaturity contributed to the sexual assault.

“I’m favorably impressed that he’s been clean and sober for a period of time and made changes in his lifestyle for the better,” Murray said.

Falvey faced up to 30 years in prison and a fine of up to $50,000.
